I received a notice that I have a collection from 1ST CRD SRVC on my credit report. It says it was opened on 6/27/2023 for $1,007 with account number *************************** in ********that I am not aware of nor am I responsible for. I never went into business with this company or signed any agreements with them so they should not be reporting anything on my credit. This is a violation of my rights as a consumer according to the **** and FDCPA. I would like for this collection to be removed asap or I will file a CFPB and FTC report.Business response

The account was placed with our office for collection on 06/27/2023, and First Credit Services (FCS) sent the Initial Notice of Validation to *********************** on 06/30/2023. Prior to this complaint we have had no written communication from him.
Upon receipt of the complaint, we contacted our client, *************************** to obtain verification. Although the agreement and payment history were supplied, the billing history was not provided. Accordingly, we have ceased collection of this account and returned it to our client. Any questions concerning the account should be directed to ****************************.
With regard to the credit reporting, as of the date of this response, as per TransUnion, this account is not being reported by FCS.

Dear BBB; First Credit Services; I demand that this be deleted from my credit report effective today as I do not recognized this account, no knowledge and no prior contractual obligations with this company and I need this removed from my credit report effective today. Plus i had paid off WOW gym. You violated my rights rights under 15 USC codes sections **** d, e f g of FCRA/FDCPA. Remove from my credit report. Delete now because I have not supplied proof under the doctrine of estoppel by silence. On 10/06/2023 we received a direct dispute from ******************* Upon receipt of the dispute we reached out to our client, Work Out World *******, ** to address the consumers concerns and requested full account validation. We attempted to provide a written response to Ms. ******** dispute at the address provided by her but that response was returned by **** as undeliverable. The letter advised ****************** that the account was closed back to Work Out World and we directed TransUnion to delete the tradeline. We confirmed through TransUnion that this account is not reporting to ************ credit file.
Any questions ****************** may have concerning the account should be directed to Work Out World.

The account was placed with our office for collection on 08/28/2023. First Credit Services (FCS) sent the Initial Notice of Validation to ******************************* on 08/31/2023. Upon receipt of the complaint, the account was marked to cease collections activity and the account was updated to a disputed status. We also reached out to our client, Golds Gym ********************** to assist in the investigation however, a response was not received prior to the required response date. Accordingly, we have closed the account and returned it to our client. Any questions concerning the account should be directed to Golds Gym. As part of the account closure a request was submitted to TransUnion to delete the tradeline. We are in receipt of the referenced complaint and appreciate the opportunity to resolve the consumers concern. Upon receipt of the complaint,all collection efforts ceased, and the account was placed in a disputed status. Below is a summary of the account activity.
On 04/26/2016 *************************** entered into a gym membership agreement with our client, ***************************** (the Gym). ********************** account went into default for non-payment,and the account was assigned to First Credit Services (FCS) for collections on 12/27/2022. Collection efforts began with the sending of the initial Notice of Validation on 12/30/2022.
Our office spoke with ******************** on 01/04/2023 and on 01/13/2023 to discuss the account and the amount due. During those two communications the Agent attempted to assist ******************** in resolving the account balance. Both calls ended with ******************** declining the settlement offer and stating he wanted to reach the Gym. Prior to this complaint ******************** made no requests for account validation.
We reached out to the Gym to provide verification, however, they did not timely respond to our request. Accordingly, we have ceased collections of this account and returned it to our client. Any questions concerning the account should be directed to the creditor. As part of the account closure a request was submitted to TransUnion to delete the tradeline. The contract went into default for non-payment and Crunch ***********, ** subsequently assigned the account to ********************** (FCS) for collections on 07/27/2023. Collection efforts began with the sending of the required Model of Validation Notice on 07/31/2023 informing him that the account was placed with our office for collections.
Our office is no longer handling the referenced account. We have directed TransUnion to delete the tradeline. I have been getting calls every day for the past month which identify as First Credit Services. Calls are always from a different number. They never leave a message, and if I answer the phone, they just hang up. I consider this harassment and want it to stop. The call today (9/25/2023) was from ###-###-#### at 2:22 p.m. Other numbers I have written down are: ###-###-#### on Sep. 28; ###-###-#### Sep 19; ###-###-#### Sep 20; ###-###-#### Sep 21; ###-###-#### (Sep 22). I am not aware of any past due or unpaid accounts, and if the caller just hangs up, it appears to be a scam.Business response

We are in receipt of the referenced complaint and appreciate the opportunity to resolve the concerns raised by ***** ****** in her complaint. Below is a summary of the account activity.
On 07/27/2023, *** ***** ************ *** assigned Ms. ******’s credit card ending in # 0051 to First Credit Services (“FCS”) for collection on behalf of ******* ** **** Services, Inc., the original creditor. Collection efforts began with the sending of the Model of Validation Notice on 07/31/2023 informing her that the account was placed with our office for collections and continued through 09/23/2023, when the account was placed in a cease & desist status following receipt of the written communication from Ms. ****** and the subject complaint.
It is our contention that FCS conducted itself in full compliance with state and federal laws governing communications with consumers while servicing this account. At no time did we speak with Ms. ****** or receive a request to cease and desist prior to 09/23/2023. The account will remain in a cease-and-desist status. Ms. ****** is welcome to contact our office to further discuss the account.
