    We contracted with ******************* the owner/proprietor of this business for custom cabinets. In August, 2022 we were told that the material for our cabinets was purchased and cut out and that our cabinets only needed to be put together. We were told only 2 or 3 weeks would be required. The first week of September 2022 we were promised delivery the last week of September. We contacted JH to ask the exact delivery date and we were then told that the cabinets would not be delivered in September but would be delivered within a day or two of Monday, October 3, 2022. Upon subsequent follow up we received a text after hours on September 30th that our cabinets would not be ready until sometime after October 14th (at the earliest). We had a contract/agreement for several dates (Sept and then by October 5, 2022). The owner clearly has no regard for agreements and deadlines. ** failed to meet the first agreed delivery timeline (a breach). We were forced to accept a delay of a few days (i.e, Oct 3-5). There is now a second breach of contract and I demanded our deposit be returned to us. Our kitchen project is significantly impacted. We do not have a functional kitchen or running water on the first floor. Our contractor is ready to take delivery and install based on JH's promise to deliver his product in Sept. 22. JH's promised breach of contract negatively impacts our project's timeline and has a domino effect on counters, running water, adversely impacts our contractors and our project causing significant hardship. In another week we will not even have a contractor on site to install (contractors on new job). The company's failure to deliver our cabinets the last week of Sept. 22 as agreed is nonperformance of a duty under contract and this non-performance is a breach. In PA this breach constitutes a material failure of performance and our deposit should be refunded as we are the non-breaching party and as such are discharged from its duties under the contract
