    My company is based in Phoenix, AZ. We contract with the Labor Finders branch in Albuquerque NM to help with large projects. We have a branch there and back in March 2024, we posted a Driver position we had open on Indeed for Albuquerque. My HR Manager went through the candidates, and set phone interviews with a few that he liked. None of the candidates listed Labor Finders as a previous employer. We hired ******* ******** ******** and he worked for us for about 45 days, after which we terminated his employment. We recently received an invoice for $3,228.75 from Labor Finders in an attempt to charge us as they claim they had sent ****** ******** to my Albuquerque branch for a job. We were unaware ******** ******** was ever a temp sent to us, ******** ******** never indicated he worked for Labor Finders and did not disclose it on his employment application, and he responded to our Ad on Indeed. Stephen ******** ******** applied to our job on Indeed in this name, which even if we were to track all of the hundreds of Temp Labor we had, he was dispatched to us I believe as ******* ********. We also never agreed to terms to pay for an employee if one was hired. Though we would never knowingly do so. Given we have had hundreds of temps over the years, unless a candidate discloses their working for a Temp Agency and said Temp Agency provides us with an updated list of Temps we have had who are subject to the terms of their contract that I never signed, their demand for $3,228.75 is outlandish and we wish to see if you can help settle this matter.

    ******** (Labor Finders)

    Labor Finders is in the business of placing temporary and full-time hires with our clients. We sent our employee, Stephen McCorkle, to Offsite Equipment.com as a temporary associate. He served in this role for only two days. We later learned that he was encouraged by Offsite Equipment.com to apply for a full-time role at the company, which he did. Roughly two-and-a-half months later, Mr. McCorkle returned to work for us, and at that time informed us that he had been hired to work full-time at Offsite Equipment.com during that entire period, but that he had just been laid off and was now seeking a new assignment.

    Unfortunately, Offsite Equipment.com having hired Mr. McCorkle represents a clear violation of our terms and conditions, to which Offsite Equipment.com had explicitly agreed in writing.   (Our associates often transition to full-time employment with our clients, with our blessing. However, per our agreed-upon service terms that all clients sign up front, if a client wishes to hire our employee directly prior to them having worked through us for at least 480 hours, the client is responsible for a placement fee of up to, or in excess of, $3,000.00 ) Our local Albuquerque branch manager reached out to his contact at Offsite Equipment.com to let them know of their responsibility to cover the fee.

    Generally, our clients in such a situation acknowledge that they have made a mistake, and they work with us to negotiate a mutually-agreeable and equitable resolution. In this case, though, the Offsite Equipment.com representative told Labor Finders that they did not intend to pay the fee at all. As a next step, our Albuquerque branch sent Offsite Equipment.com an invoice for Mr. McCorkle's placement fee. Soon after we sent the invoice, Offsite Equipment.com began posting inaccurate and unfair negative reviews about Labor Finders on platforms like Google and LinkedIn, and now have filed this complaint with the Better Business Bureau. Despite this surprising escalation, we are still willing to give Offsite Equipment.com the benefit of the doubt and chalk up their initial violation of our agreed-upon terms to an honest mistake. As from the beginning, we remain eager to addressing this issue directly with the client and to reaching an equitable agreement with them, if we can.
