    A contract was signed by the contractor and me on February 19, 2024 to replace the roof on my house and repair all of the damaged areas in the house, garage and back porch. On February 9, 2024, *** ****** was given a check for $19,319.79 as a down payment to begin the work and provide an estimate for an additional work that was required but had not been identified by my insurance company. *** ****** immediately cashed the check. *** ****** has not begun any work at my residence nor provided any estimates for additional work, nor provided a schedule of when the work will begin. It is now more than five months. *** ****** does not answer the phone, he does not return phone calls when a message is left, he does not respond to text messages, he does not respond to emails and he has not picked up the certified letter that was mailed to him. Damage due to recent rainstorms continues to occur to the inside of the house, garage and back porch. The damage is getting worse because of the additional water leaking through the roof. There is a possibility of mold because of the moisture accumulating in the damaged areas.

    We have a contract with her. She is also obligated to her insurance co. She hired a public adjuster.  I haven't been moving forward because I am waiting for the public adjuster that she hired to complete his assessment. She called the police on me and my company accusing us of fraud. The police said it was not related to fraud.

    The business owner, ****** ******, has not responded to my emails, texts, phone calls and letters.  He has not picked up the two certified letters that I sent to him.  He responds to my phone calls with his standard response "Can I call you later?"  And then, he doesn't call.  After the Rio Rancho police called him, he sent me a text "Justin received the calls from the officers.  Give me a call when you get a chance".  I called him and got his voicemail.  He didn't answer again.  Then, he sent another text "Yes call me and we can work it out to get your money back".  Then, I got a text "Can I call you later? Im going to send you an email shortly".  He also told the officer that he would send an email that same day.  He has not sent any email or responded to my inquiries. When he finally answered the phone on the following Monday, he said he would bring me a check on Friday after he talked to his attorney and got all the paperwork ready. He didn't call, email, text or come to my house on Friday. 

    *** ****** does not have a contract with the public adjuster and is not authorized to talk to the public adjuster. Therefore, he should not be "waiting for the public adjuster.... to complete his assessment". He should not even know what the public adjuster is assessing even if he is doing any assessing.   There is nothing in his contract with me that says he has to wait for the public adjuster to finish his assessment. Additional work cannot be submitted to the insurance company without *** ****** providing the information to me.  I am still waiting for *** ****** to provide me with information including the cost of materials and labor for what additional work is needed to start the job if there is additional work required.  He should be starting the job and has made no attempt to begin the work.  He has not given me a timeframe when he intends to start the work and when it will be completed.  

    It appears to be fraud when a contractor takes your money and disappears with it and doesn't do the work that he was contracted to do and does not respond to any attempts of communication with him.
