    Please see the attached document.

    Good afternoon,
     I am requesting assistance resolving an issue with our home paint contractor, Southwest
    Coatings, LLC, NM License #******. Our contact throughout the contract has been ***** ********. Mr. ******** is a neighbor. As neighbors, we did pay in advance for projects, and
    we were very hesitant to move forward with a complaint. I have two issues to address:
    1. Completion of house painting.
    a. We paid in full prior to job completion. This was at Mr. ******** request, so he
    could pay has employees.
    b. Over the course of months, he has failed to arrive on his stated work dates many
    times. Days are partially documented by text message conversation, but it is not a
    detailed record.
    c. The signed painting contract requires “Southwest Coatings, LLC will
    meticulously inspect exterior walls to make sure that job(s) performed are done
    correctly and that they meet with your complete satisfaction.”
    d. After months of phone discussion, we met with ***** on 21 Nov 2022 to inspect
    the work. He acknowledged the incomplete work, and his intent to complete it
    the following week. As of 11 Dec 2022, the work remains incomplete.
    e. As shown in attached pictures, poor work practices resulted in property damage.
    f. The property damage should be considered when discussing refund of the gutter
    installation money (see issue 2).
    g. The failure of Southwest Coatings to perform work as scheduled also resulted in
    extra expense to us, which should be considered.
    h. As of 03 Dec 2022, the work started in July is still incomplete. Failure to
    properly tape and mask throughout the process has resulted in damage to solar
    panels, windows, lawn furniture, newly installed gutters, and landscaping, as
    illustrated below:

    2. Refund of money for gutter purchase and installation.
    a. The contract for home exterior stucco repair and painting was signed 07 July
    2022. Approximately one week later, a second contract was signed for
    installation of gutters in addition to the stucco repair and painting. During the
    gutter contract discussion, I asked ***** if the gutters were seamless, and he
    stated they were. “Seamless” does not appear in the contract. ***** purchased
    seamed gutters, and we declined the installation when he delivered them. The
    text messages from 29 Sep 2022 below indicate ***** did not know what
    seamless gutters were, when he agreed to the verbal contract:
    ? *****: Good morning sir! I should have realized this sooner, but the gutters
    are not seamless like we discussed. We aren't looking to install seamed
    gutters.
    ? *****: Good morning ***** they are seamless when we're done with them
    they will be I have brackets they go over all the seams to make it seamless
    ? *****: I don't understand how a bracket removes the seam.
    ? *****: Once I start putting them on they will be seamless the guy that puts
    them on for me and he called in today we will be there first thing tomorrow
    and I'll show you don't worry sir I got you. And you have warranty on the
    gutters too
    ? *****: Can you help me understand how they will be seamless? My
    understanding is seamless gutters are formed from a roll to the required length
    and installed as a single part. There are no separate sections joined with
    brackets.
    ? *****: My understanding is they don't make that long of a gutter I bought
    what was required for your house I already spent a lot of money on all the
    gutters and paint please trust me I'll make it work for you guys please
    ? *****: You are right, you can't purchase seamless gutters off the shelf. It takes
    specialized equipment to form it on site, and there is a significant difference in
    cost and quality
    ? *****: Yeah I thought it was right but these gutters will work I promise you
    they will look good once you put them on and I guarantee they will leak.
    Won't. Lol.
    ? *****: I'm afraid I have to say no to those, they are really not what we
    expected.
    b. At Mr. ********’ request, we paid in advance for the gutter installation. This was
    to provide him funds for materials purchases.
    c. The signed contract requires “Southwest Coatings, LLC will meticulously inspect
    rain gutter installation to make sure the job(s) performed are done correctly and
    that they meet with our complete satisfaction.”
    d. No gutter installation was performed, and the material offered was unsatisfactory.
    e. We met with ***** on 21 Nov 2022. He agreed to a partial refund by 02 Dec
    2022. As of 11 Dec 2022, no money has been refunded.
    f. After this discussion, we hired a different contractor for gutter installation. They
    completed the work quickly.
    I would be grateful for any help you can provide in resolving these issues.

    Southwest Coatings, LLC, Ruben G*******, abandoned the exterior paint job on May 2, 2022, for the second time at the ******* *** * ******, **** ** ****** **** *** ****** NM. Mr. G******* asked for $1,500.00 more money to continue or else quit. He has been paid 50% of the agreed price, over $7,000.00, when we signed the exterior paint contract on 3-25-22, and the remaining balance is to be paid upon completion of the job. It has been over a month, but he promised to finish his work in two weeks. He also promised to bring his crew to finish his work fast; instead, he had only one man, Angel, working this whole time from morning to evening, before they quit. I am not sure, if Angel is paid what he supposed to or not, and if he even has a legal status to work in U.S. Mr. G******* had been cutting corners. He promised he would pressure wash the whole property, but he only washed some part of it. He promised he would seal all cracks, but he sealed only few cracks with cheap $2 Caulking tube from Walmart. He said, he would prime the whole building, but he did not even prime at all. He said, he would put two coats of paint, but he did not. His man painted over dirty surfaces. His man did not clean after each workday. He added water to the paint, and over spraying on doors, windows, and roof, etc... I am asking you to help me out to resolve this issue. He has to either finish his work right, or give me my money back, so I can hire a reliable contractor to finish the exterior paint at my business and clean up his mess. The building looks horrible, and it is affecting my business, and taking losses since he started. Thank you for giving me this opportunity to file my complaint. I want people to know, so they don't get screwed up. Thanks again.
