    I bought a brand new 2024 Chevy 2500 including all the warranties towards the end of July. After only a month and a half of driving the vehicle the transmission went out; so I took it back to Melloy Chevy and it’s been there for 5 months due to them having the part on “back order”. I asked one of the many clueless dealers to either reimburse me the $30,000 I originally paid for the down payment or give me a vehicle of the same value. But they refused. And insisted on either giving me a a vehicle with the same value or reimbursing me the money and they also refused I just want the either the vehicle they promised or the money back I paid for the brand new vehicle.

    We spoke with our customer a couple of days before she filed this complaint. We explained that the part that the they need is on national backorder and is scheduled to be released in the 2nd or 3rd week in January 2025. In the meantime, we arranged for her to have a loaner vehicle. We absolutely understand that it is frustrating to be without your vehicle but we can not control the backorder situation. As soon as we receive the part we will begin to repair the vehicle.

    My boyfriend ******** ***** purchased a truck from Melloy Chevrolet in Los Lunas New Mexico on the 28th day of September, 2024. This Truck has been problem after problem since we’ve purchased the truck in September, about 2-3 weeks since buying the truck the first problem occurred the transmission bolts to hold the transmission in place were NOT THERE therefore the transmission was sliding back and forth when driven- the dealership fixed this problem BUT charged us around $260.00 and fought with us because the truck had to be on the “Powertrain” Warranty in my eyes that should have been fixed before the truck was sold and driven off the lot. and they tried BLAMING us for this matter. Now we are experiencing problems with the breaks, CV axle seal, Rotors, and Transmission lines leak. The dealership will charge us an excessive amount of money for these matters to be fixed because they are not on the “powertrain” warranty. We have not pulled anything nor went off roading in this vehicle it has stayed on pavement for the 2 months we’ve had it. The breaks and rotors are shredded and this should’ve been assessed in the “100% Guarantee Inspection” on the vehicle. They will continue to blame these matters on us and say that they did these inspections but how could we have all these problems in the matter of 2 months of having it and the vehicle is NEVER on rough terrain. We have repaired the rear rotors and breaks and now are going to have to repair the front.

    Attached is a copy of our Multipoint Inspection stating that the brakes were measured at 8mm which is considered an acceptable thickness and does not require replacement. However, we will contact Mr ***** and schedule a time for him to bring the vehicle in and reinspect the brakes and axel.

    I had called melloy Chevy looking for a vehicle they said no they did not have it. Two days pass and they call me back saying they have what I’m looking for but it’s in El Paso that they could have it down immediately and we could start paper work over phone for convenience I said yes so they asked if I had a down payment and I said I was hoping to do zero down and they advised against that and said even 500 would help get you approved I said let’s do 800 and I was approved now we just had to wait for car to arrive. car showed up next day and one of the workers drove it off the lot for awhile . I was on the phone with sales person when it happened we were about to do video chat Couldn’t do that cause employee was gone for to long. Next day early in the morning I show up and the car had some damage but they said they would fix it and took me inside to finish the paper work they had the paper work coming in very weirdly and very unorganized and the sales person was a little confused with papers himself so he had me finish the paper work with the finance manager. Now he said “your sales person went with you threw all this already are you ok with everything he told you” I said yes and he then started pointing where to sign vaguely explained some pages had his hand on the papers then kept papers and said I would get them back when I came back to get the car they said they still needed to clean it to come back in about 2-3 days and paper work would be finished when I came back they gave me paper work with no signatures different fonts and a price tag of 40k+ was originally quoted and qualified for 33k about 10 days after, I get a notification they ran my credit again for the new amount without my consent. I didn’t sign for 40k either I signed for 33k and I’ve tried to contact them to resolve this and they said leave a message and they will get back to me it’s now been a week with no response from them. This can’t be legal

    Mr ******* paid 31,995.00 for the vehicle. He also purchased anextended service agreement (5200.00) and gap insurance (900.00). With tax and fees, the total came to 39,839.30. He put 900.00 down and finanaced 39,039.30. I have attached a copy of the purchase agreement.

    I am rejecting this response because:
    I initialed on the price for 31,995.00 and on the 900.00 I never initialed for a service contract I did not want that because I was told that the car was still under warranty by Audi. You can clearly see where I initialed this contract was altered and sent to bank on later date and my credit was checked again 2 weeks after I was already approved without my permission this damaged my credit score even more because it was out of the time frame you get to purchase a car. Since I did not sign for the 5,200.00 and did not allow another credit check we need this resolved properly and have it taken off and/or refunded this has to be illegal.

    Mr ******* is welcome to cancel the extended service agreement if he chooses. We want to warn that he will not have the coverage of the extended service agreement once the vehicle is out of factory warranty if he cancels it. The prorated proceeds from the extended service agreement will be sent to the lender which will lower his payoff.

    I am rejecting this response because:

    I was sold this without wanting it and it greatly raised my monthly payment. If the extra 5,400 was never added my monthly would be barley over 500 a month this is long lasting effect and needs to be corrected appropriately I asked Marc at the Los lunas location to write me a check so I could have help paying my monthly until I can refinance at an appropriate time. He said to refinance now after he applies the 5,400 to the principle but that would further damage my credit and my lease to where I live is running out soon and with such credit I will be unable to get a home and it is going to leave me and my daughter homeless I’ve been patient and I’ve been reasonable and I do believe that this is a reasonable ask. And you can still take the extended warranty off. Marc told me you guys don’t have the proper tools to work on such car anyway, they couldn’t even take care of my service light. You guys sold me a service that you can’t properly provide for or have someone specialized in. He told me to go to Audi and pay 500 to take it off. what did I pay for exactly? Ruined credit larger bill these things affected my life directly as a single parent and you guys are bullying me into it. As a consumer I have rights and they should be respected. Sending buyer to another dealership without paying for problems that started when I bought the car.

    When Mr. ********* purchased the vehicle, he also purchased an extended service contract that has a 200.00 deductible. When he had a problem with the vehicle, we set an appointment with the volkswagen dealer in Albuquerque because the vehicle is still under factory warranty and Mr. ********* would not have to pay the 200.00 deductible. As it turns out, the problem that he was experiencing was not covered under warranty because the part was damaged and not a defective part. We did provide him with a loaner vehicle while the vehicle was in our shop for diagnosis.  


    The Volkswagen does have some aftermarket exhaust parts, but that does not affect the warranty. 


    After receiving this complaint, we contacted Mr. ********* and explained this to him and we think the issue has been resolved.

    We purchased a new vehicle from Melloy Chevrolet. The service engine light came on a few days later. We have been going back in forth between Ganado, Arizona and Los Lunes, New Mexico to have this problem corrected. To date they are probably billing GM for the services rendered. Never gave us a copy of what services were performed. The service department are not help at all and hard to work with. They knew about this problem and should have gave us another vehicle that did not have any problems.

    I am sorry that you had to bring your vehicle in multiple times. In this case, we were not able to diagnose the problem because the check engine light was not on when the vehicle came to us. We drove the vehicle several times but the light did not come on. We were finally able to trace the problem to an electrical problem. The vehicle has now been repaired and the owners have picked it up. Please understand that the dealership does not benefit from a vehicle having to be brought back several times. We strive to dignose and repair a vehicle on the first visit.
