    On 1/30/2024 I purchased a 2013 **** ***** **** Commercial vehicle for $13,200 from this Dealer and due to the condition of the vehicle, I requested a full refund plus transportation shipping cost refund of $14,900. I found the vehicle advertised on **** ****** online and figured the sites enrollment department would vette, qualify and trust this dealership to post multiple vehicles, never had I been more wrong! For the following reasons 1. Owner Made false STATEMENTS to the amount of rust on the vehicle and its durability 2. Major safety concerns to be on public roadways, vehicle frame is fractured and degraded BEYOND the point of repair. They welded metal plates on sections to cover up major rust spots.. 3. VEHICLE WILL NOT PASS INSPECTION in Texas where I reside or New York After calling 4 times and emailing 3 times since 1/30/2024 date of purchase, the Sales Manager cursed me out and took 0 accountability and hung up in my face all 4 times. His Response as a Dealer is Combative, Uncooperative, Insulting and DECEPTIVE both on the phone and the one email he responded with! Ive given this dealer a fair chance to rectify the situation and refund the money back in full, but the Owner refuses and doubles down on the lies that the vehicle has insignificant rust damage and is perfectly fine for public roadways / safety. I would like for every person who sees this to NEVER consider purchasing from this lot. They will manipulate, deceive, coerce and defraud you out of your money! , Defrauded Customer

    m responding to the above file number ******** Mr. ***** corresponded with Joe T***** at South Point Auto Plaza in reference to a 2013 **** ****. The representative at the dealership supplied the buyer with all detailed information that was requested. The buyer was advised that this vehicle is a 2013 **** work truck with a utility box, and a 10 foot snowplow. Vehicle mileage at time of sale was 151850. The customer requested multiple pictures to show the rust on the vehicle which were sent to him. The customer was advised that this vehicle has been used as a snowplow vehicle in the north east for the past 11 years as well as a utility tool truck. Customer agreed to purchase the vehicle in as is condition that I will enclose will show the vehicle condition and these pictures were sent to the customer, customer agreed to buy it and as his condition and negotiate the price to $13,200. The customer had the option to fly in or sent a representative to look over the vehicle . Before the agreement was made, I had given the customer a discount of $1800. I will attach all text conversations and pictures that was forwarded to the buyer. The buyer advised me after receiving the vehicle in Texas that he was intending to use it for a tow truck and had to remove the box to be able to do so, and was advised that he will not be able to use it for such a heavy load. This vehicle was not built for a tow truck. I did not sell it as a tow truck. After the customer was advised, he cannot use it for his purpose. He came up with this complaint that’s non-valid and not legitimate. 
    I’m not offering any kind of refund on this vehicle it was sold as is and it’s a commercial vehicle with 150+ thousand  miles. The condition of the vehicle was displayed by pictures on my website and pictures that were sent directly to the customer that were close up pictures that show the rest, which is on the body and has no structural effect or roadworthy effect on the vehicle. Customer did not supply any evidence of this vehicle being unsafe, or unworthy to be on public highway. I not obligated to do a New York State inspection. sell this vehicle out State.

    Attached are pictures and texting between me and the customer. I’ll send you several emails if the attachments are to big. please keep in mind that this vehicle has been in the northeast weather, all its life that was explained to the customer. He was well aware of the vehicle was a work truck utility box with a snowplow, and all pictures were sent to him for review before committing to purchases vehicle, I found out that after he received the vehicle. His intentions was to remove the back box and convert it to a tow truck. This vehicle was not billed for a tow truck, and he had buyers remorse.

    I purchased a 2008 **** **** used vehicle on 11/19/2021 for $27,966.37. Pay $9,000 down payment by delivering $500 in credit card and $8,500 cash. Finance $18,966.37 through ******** ********* ****. I used the vehicle for 3 weeks and I had mechanical problems with the engine. I took it to a mechanical garage on 12/14/2021 for evaluation and they suggested that I return it to the dealer. I returned it to the dealer on 12/17/2021, 28 days after purchase and I understand that by law I have a minimum 30-day warranty. The dealer received the vehicle for me however he refused to refund my $9,000 down payment. I notified the bank and they canceled the financing by having the dealer return the money to the bank. 3 months passed without getting a response, nor having received anything from the dealer. On 09/03/2022 I receive an email from the dealer at my residence that included a check for $2,311.57 with a refund document indicating that the dealer sold the vehicle on 01/03/2022 for the amount of $22,300 and He made me an adjustment for the repair of the vehicle's engine. In the end, he confiscated and used my money from the down payment to repair the vehicle and only returned the difference to me, leaving $6,688.43 pending, not including the expenses and losses that I have incurred since the date that he did not return the down payment. I consider that this case is a fraud or scam as well as others that the dealer usually does since I did an online investigation reviewing the reviews and many people have been victims of this dealer. Thanks for your time. I hope you can help me as soon as possible as I need my money urgently.
