After making multiple efforts to Amendola Fence ** to correct their poor workmanship and complete the project On April 7th 2023, the project was initiated. Amendola's cut the gate posts too short which was brought to their attention. The text message reply from was "ok no biggie will have field supervisor stop by next week". April 12th, via text message I inquired "when are the guys coming back"? I was then told "should be by the end of the week". On April 25th a partial delivery and installation was performed, at this time the gate posts were cut/ installed incorrectly and deceitfully covered up with black screws holding the gate construction together. A photo of this was sent via text message owner who did not acknowledge nor respond. on May 4th 2023, I again sent Amendola Fence a text as well as a photo of the broken bottom hinge holding the front gate. I had informed them " wish they would have taken into consideration where the gate holes were drilled" since it cracked the new masonry stones. I was informed the issues would be corrected via text message on June 14th which did not occur. Again, on June 23rd I was informed the two pieces of glass that were missing as well as everything damaged will be corrected on Friday June 19th. This did not occur, Amendola failed to commit to their obligations. After many months of frustration and not being able to open and close the front double Gates, on July 19th (three months later) Amendola Fence once again failed on their obligations I have had two independent fence companies inspect the structural integrity of the glass fence, they both have informed me the glass fence will have to be completely taken apart and the posts require concrete. We live on the bay and frequently see wind gusts over 50 mph that could create a potential hazard with the current fence installation At this juncture, there is a lack of honesty and trust in Amendola Fence **mpany, and we no longer want them working at our home.Business response

I hope this letter finds you well. I am writing to provide a response to ** ******* claim concerning the purchase and installation of a *** railing with tempered glass inserts from our company. We appreciate the opportunity to clarify the situation and present our perspective on this matter.
The claim that *************** makes referencing Amendolas refusing to correct the matter of screws and posts is false. Amendolas sent representatives to inspect his claims and offered multiple dates to return/correct the matter. Our responses were ignored.
The customer also alleges that the railing they purchased from our company is not strong enough and,therefore, refuses to pay for the product and installation. We would like to assert that the railing provided to the customer is in full compliance with industry standards and local building codes. Our company takes pride in adhering to all regulatory requirements to ensure the safety and satisfaction of our clients. The specific claim that the posts should have cement inside would not work with this specific installation. *** posts cannot be filled with cement, as cement expands. Upon expansion of cement, the posts would crack. In addition, the product is core drilled, which means there are internal commercial grade pipes cemented into the masonry. The *** posts are a sleeve over the pipe. This is standard practice and ** ******* signed contract also confirms how the installation would be done (core-drilled).
Amendolas Fence installs dozens of tempered-glass railings every year, and our track record with glass installations speaks for itself. We do not have problems with any previous clients glass railings, and ** ******* is no different.
The installation of the railing was carried out by our trained and experienced professionals, who followed best practices and ensured that it met or exceeded the necessary structural requirements. We have records of the installation process, which can attest to the fact that the railing was installed according to industry standards.
Furthermore, it is essential to note that the customer did not request any specific upgrades or modifications to the railing at the time of purchase. The contract states the glass is to be residential grade. *************** requested the upgrade to commercial grade 3/8 at no additional charge, which we agreed to. So, Amendolas has installed a premium commercial grade glass railing for a standard residential grade cost. Besides this change, any additional features or enhancements beyond the standard product would naturally incur additional costs. In this case, the customer did not pay for any such upgrades, nor did they communicate any dissatisfaction or concerns regarding the railing until after installation of the glass.
*************** has only paid 50% for a project which is 99% completed. Amendolas Fence is willing to offer a credit as there is 1 post that needs to be replaced, as well as 1 missing glass panel. The value of these two items is $490 including labor. The remaining balance of $8010 is still unpaid and remains over-due.Customer response

As per the contract, I requested two gates which were installed. One gate is sagging. Also, I never included the broken piece of beveled glass. They left all the plastic covering on the glass which took me hours to remove with a heat gun and razor not to mention. There are remnants left in one of the photos. Attached, Please see the photos. Amendolas failure to state a completion date on the contract is the a violation. Amendola Fence delayed initiating the construction as they had not contacting me until 3 weeks after signing a contract (March 5th, 2023). Samples were never shown as promised . The measurements were not performed in a timely matter. Amendola Fence worked in a piecemeal fashion leaving multiple items in my flower beds, front lawn, backyard for months that were not protected in wrapping, these photos were sent to you on a previous email. They performed poor workmanship, incorrectly measured the glass on 2 separate occasions. I did not request to make any changes.
Four months after I signed a contract, On June 23rd **** sent me a text message: Received majority of glass just waiting on 2 pieces. Please keep in mind that this piecemeal project started on April 6th with delivered fence posts and materials left uncovered in the outdoor elements, 2 months prior as depicted in the photos I had sent.
The only individuals that ever arrived at my home were a ***** of Spanish gentlemen, only one had spoken broken English, the other I could not communicate with. Unfortunately, despite my efforts, the companies President nor **** volunteered to evaluate my concerns, nor visit the project site.
As per *********************************** initial letter dated on August 21st, she states "I requested to change from a gate to regular panel, so the piece of glass had to be reordered". Please refer to the photo I had sent you today. There is a 12 inch wide dock catwalk underneath where a glass fence would be placed. To get to this level, one must walk up 2 steps. Logic would be not to install a gate there, as one would essentially have to risk jumping off of a 2 ft platform onto a 12 inch wide dock. Therefore installing a gate would hazardous. Please note that I never requested a $2,000 dollar charity commercial glass upgrade.
As per Amendola Fence Co *********************************** dishonest comment, who was never once involved in her customers dissatisfaction " *** ****************** has not let us complete the project as he has constantly ignored our attempts to set up an appointment to finish his projects". I would like to refresh your memory from the prior text messages I had submitted:

Thank you for the response. Please note that we have made numerous attempts to resolve the issues that the client claims. As seen in the previous text message attachments, the client refuses to allow us back on the property to resolve any outstanding items. The client sent profane text messages in which he criticized our professional installers, whom have been installing high-end fencing and railing for decades. *************** continues to make the claim that Amendola's would not rectify his complaints. Three full days were spent installing the fence and railing at his home. After *************** mentioned the items he was not satisfied with, a field supervisor stopped by to review the outstanding items with him. After that, Amendola's fence offered two different return dates, both of which were ignored by **************** Instead of responding to confirm the new date, he sent a message stating he would be submitting the complaint to BBB. We made every effort to address the concerns yet *************** continuously ignored our attempts. Amendola's fence has always responded to the client in a timely manner, and instead of allowing us to fix the issue, he said he will not allow us on the property. In addition, the claim he makes stating the railing needs to be taken apart and redone is false. *************** ordered a residential grade railing. Amendolas upgrading to a commercial grade glass at no additional charge. The integrity of his railing meets local building code and ordinance, and exceeds the structural requirements of a railing. We do not have issues with our glass railing installations, and our track record speaks for itself. We are requesting the detailed the copies of the reports/plans from the two other companies that *************** received quotes from, so we can review/respond in further detail. Additionally, we are happy to pass along a $490 credit to the client for the post and the glass panel. Thank you!Customer response

Attached, please find recent photos. These are Amendolas fence companys deficiencies:
Fence posts between tempered glass are manually Twistable. I would be surprised if Wind gusts over 50 mph would hold up as concreting the posts would be superior vs drilling 1 foot deep galvanized pipe into the *** posts. Amendola's previous field inspector informed me that the gate would have to be reconstructed as it was installed 3 inches further than the side of the house, leaving less than 1 1/2 inches between gates. It takes muscle to lift the gate and push it over in order for the latch to close properly, Ive been doing this for months in order for the gates to close properly. The gate hardware is now defective. The tempered glass is supported by upper and lower *** railings that are secured in by a single 3 inch decking. The placement of a single s**** which appears as cosmetic versus structural integrity. The front gate corner post was installed incorrectly by Amendola fence. Attempted to dishonestly cover up their mistake by installing black screws. Despite the gate being installed incorrectly, the bottom section has already started to rust. We recently installed brand new pavers, which were damaged due to Amendola cutting corners with installation and not properly aligning the posts. As I mentioned earlier, they had dropped off all original materials without the tempered glass and for months all materials were left on the front lawn and backyard, the exterior elements, creating many scratches in the *** material. They incorrectly measured on two occasions the width and correct count of the tempered glass and had to re-order. We are still missing a large section of glass during this many month ordeal and we lost Patio cushions due to coastal winds. Masonry work will be needed with paver replacement due to the above. Post caps were not glued into place despite asking workers on two occasions. The left side of the house gate is missing a post cap. The right side of the house is missing a post cap. Amendola is in violation with Nassau County for failure to state a completion date on their contract at the very least. The County commissioner's office is investigating this current situation.
Unfortunately I was unable to amicably resolve these deficiencies with Amendola fence.In order for the BBB to appropriately process your response, you MUST answer the question above.

Hi amendola installed the fence in our home before closing. It is has been over a year of follow-*** and follow-through due to poorly installed fence post and gate on the right side of my home.Subsequent to my first complaint last year, Amendola agreed to come take a look at the fence post in question, if I removed the complaint, for which I have.Fast forwarding to this year, Amendola contacted a third party vendor to come and take a look at the misaligned fence post. They gave me two options.1.Remove the cement footing of the post, and lift the post, with NO reassurance no damage to the foundation of my home or gas line (for which runs under it ) will occur 2. Pay for a smaller fence gate (600 dollars. Unfortunately the builder **************** feels is he is not responsible for any of the fence issues in the home. In fact he feels the fence company may have caused other defects in my home with respect to water penetration in my basement.What is beyond my understanding is. 1. **** reports warranty is transferred to me. 2. **** reports, I the owner of the home do not have a warranty.To resolve this issue, I would like a new gate installed for now.Business response

We have a contract with the contractor whom built this clients home. Our warranty is non-transferrable, however even if the client was the original purchaser, gates and gate posts are only warranted for 90 days. The client who is the new homeowner wants a new gate installed and/or new gate posts installed. Even though Amendolas does not currently have a warranty with the current homeowner, we still offered to fix the post at no charge to do the right thing with the customer. However upon arrival, the gate post has a gas line running directly under the post, and the homeowner was advised it would be a danger to remove/replace the gate post. As of last week, the homeowner was speaking with our installation department about different options on purchasing new fencing and installing it in a different location, and we left off that he would get back to us. Since then, we have not heard from him. Please note that if a new gate is to be made, the client will have to pay for it.Customer response
