    To whom it may concern, I was retained by ***************** to obtain a variance for the existing one story medical building with a cellar which ***************** wanted to enlarge.  The existing zoning precludes the as of right enlargement of this building as well as the conversion of the cellar space to medical offices which according to the *** is considered an enlargement of the non-conforming use and therefore a variance from the Board of Standards and Appeals is required.  When ****************** received unfavorable opinion of the potential for obtaining the variance, he then proceeded to continue the project with just a renovation of the existing building and no change of use.  As time went on, he insisted that he should be able to change the use of the cellar, and I refused to file an illegal plan.  We continued to do the work as requested with the alteration of the building which was completed, even to a recent amendment where he asked us to add a canopy over the exterior handicap ramp to the cellar space, but never paid for that work.  He continued to harass with threats to contact the State ************** and sent an invoice to me for 1.5 million dollars, and sent additional invoices to numerous members of my staff.  I sent him a letter of resignation several months ago, due to the lack of professionalism and harassment as well as his insistence that i file an illegal plan to the **** of Buildings.

    To even further help him, my staff told his assistant that if we continue, he must hire an expeditor, and we will only communicate with that expeditor to obtain his sign off. We don't need to speak with him, due to his lack of professionalism and harassments.

    Better Business Bureau:

    I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

    This letter is in response to the misleading and inaccurate statements
    made by Mr. ***** ********************** regarding the complaint I submitted.

    1. **Variance and Use of the Cellar:**
    Mr. ********************** falsely claims that we insisted on filing an illegal
    plan. The project's intent was always clear: to change the use of the
    cellar legally, following Mr. ************************ professional advice. Legal
    counsel confirmed in an email from ****** ********* on October 16,
    2018, that the Certificate of ************** already allowed Use Group
    4 (UG 4) use in the cellar, meaning only a change in occupancy was
    required, not a variance . Despite this, Mr. ********************** later
    contradicted his own previous advice, which led to unnecessary delays.

    2. **Lack of Communication and Unprofessional Behavior:**

    Mr. **********************s claim of maintaining communication is false. I made
    numerous attempts to contact him, to obtain the necessary mechanical
    drawings for completion of the project. His staff gave continuous
    excuses, including statements that ***** was unavailable, but he never
    returned the calls. Finally, I spoke with ***, who explicitly said,
    "***** does not care what we do and will not speak." This reflects
    clear unprofessionalism and refusal to resolve the matter.



    3. **Invoices for Mechanical Drawings Already Paid:**
    Contrary to Mr. **********************s claims, all invoices, for the mechanical
    drawings, have been paid. Despite this, Mr. ********************** continues to
    withhold the mechanical drawings, which are essential to the projects
    progress

    4. **Refusal to Communicate with Expeditors:**
    Mr. ********************** office claims to have communicated with our expeditors,
    but this is completely untrue. Despite providing the names of our
    expeditors, **Pirumal** and **Khanna**, multiple times, Mr. **********************s
    office refused to communicate, further delaying progress.

    5. **Unprofessional Conduct and Ethical Violations:**
    Mr. **********************s behavior has been unprofessional throughout this
    process. He has refused to communicate, provided false information,
    and filed incorrect applications, causing financial loss and delays.
    His disciplinary history, including a **May 17, 2022** fine for
    submitting incorrect applications, shows a pattern of misconduct

    6. **Misrepresentation of the Project's Intent:**
    Documentation, including **emails, texts, and phone records**, clearly
    shows that the primary intent of the project was to convert the cellar
    into medical offices. Despite paying several  thousand dollars, Mr.
    ********************** failed to file the correct applications

    **Conclusion:**
    Mr. **********************s actions have caused significant delays, financial
    losses, and undue stress for us. I respectfully request that the
    Better Business Bureau records these issues in Mr. **********************s business
    profile and notifies potential future clients of his unprofessional
    behavior. This situation has been ongoing for far too long, and it is
    important that future clients be aware of these serious issues.
