    I bought a 2014 Kia Forte from Roberts Motors (DMV #7132080) on 6/14/2024. ($3000 Cash - remaining $6784.12 financed with an extended warranty with bank). At the time of purchase there was an EVAP code throwing that had gone off with a new cap (at the time) and a clicking noise that I addressed with dealer that we needed to have checked out. When I called Kia of Watertown to schedule an appt for the clicking noise, Kia informed me that there where 6 open recalls on this car and the soonest they could get the vehicle in was 7/29/2024. I immediately let Mike Roberts (owner) aware of recalls and the appt time and that the recalls needed to be done first. 7/29/2024 the vehicle was taken to Kia Service department. 1 of the 6 recalls was an updated anti-theft software which according to Kia I should have not been able to insure this vehicle without it. The clicking noise happened to be from the engine, I have documentation and pictures of scoring on the cylinder walls and the engine is shot and Kia is recommending it to be replaced and the EVAP canister was cracked and needed to be replaced. Upon further inspection, Kia found sections of break lines that had been repaired and said this vehicle should have NEVER passed NY State Inspection and should have NEVER been on the road. This vehicle was bought, titled, registered, and inspected through Roberts Motors at the time of purchase. I have made several attempts to contact Mr. Roberts and he has refused to contact me. I have called, texted, emailed and have tried to catch him at his place of business daily since 7/29/2024. The car is not safe and is un-drivable and now sits on my lawn and Mr. Roberts has refused to speak to me on a possible resolution. I have filed complaints with the Attorney Generals Office (intake # 1-*********) and with the New York Department of Safety (attached).

    Bus called stating that the car has been inspected and it is not unsafe and should be drivable. They drove this vehicle for 46 days and they took it to a new car dealership and of course they are going to say it needs all this work. The bought a vehicle that that is over 100,000 miles and they have an extended warranty if they need repairs on this vehicle. They want me to buy a new motor and that will not be the case.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    I do not agree with Mr. Roberts.  The car was only taken to Kia (big dealership) because it had 6 open recalls attached to the car that can only be done through the manufacturer and we took the earlies appointment to have all the recalls taken car of which was 7/29/2024.  Regardless of where the car was taken for an inspection, per my warranty documentation, any recalls would have been needed to be done first prior to any warranty.   During the first 30 days, the engine light came on (again) after Mr. Roberts reset it claiming it was an EVAP code and was fully made aware of the recalls and the timeframe we were looking at.  Mr. Roberts has avoided our efforts in resolving this, has refused to speak to since the day the car went into the shop.  It was just determined this past Wednesday, 9/4/2024, through an inspection with the New York State Department of Safety, Agent Thorne, that the brakes did meet NY inspection but during the timeframe of 7/29/2024 until now, Mr. Roberts has refused to discuss even the brake and EVAP issues with us which has delayed any resolution and use of this vehicle since 7/29/2024.
