As I drove this car off the lot after putting money down the lights have come on. First the check engine light then the breaks. All before making my first payment nothing but problem. Went back and forth 3 times with multiple calls, texts, and then telling me/husband to not contact him again. The break light is still on and obviously not fixed yet again. So dissatisfied with it not being of what it should have passed inspection for.Business response

On June 13, 2024, ******** **** Took delivery of the 2009 ***** 5 she purchased from my Dealership. As you can clearly see by the enclosed documentation, on the NYS Dealer Used Passenger Vehicle Limited Warranty, ******** initialed the mileage of 131,879. She also initialed paragraph #2 Exclusions. That paragraph clearly states vehicles with over 100,000 miles are excluded from any coverage by the dealer. Before she signed and initialed that document she was told that and understood that was NY state law. Then she was given another document to look at, understand and sign which was the AUL Limited warranty. This covers the driver train of the vehicle and was for 5 months and 5,000 miles. This warranty was free for her and coverage was limited to only the drive train, nothing else. I explained to her l furnish this to all my customers because the law states vehicles with over 100,000 miles are considered "as is". She said she understood. After several days, ******** called me and told me the check engine light was on and the brake light was on. I told her to get it to ***, the repair shop that had worked on the car and inspected it as I sublet work out as I don't have a repair facility. Shortly after that she did take the car to ***. *** called me to tell me someone had bumped the parking brake handle while in ********'s possession and raised the handle ever so slightly. It was just enough to turn on the brake light. He put it back in it's proper place. He also told me the check engine light was from the mass air flow sensor. I told him to fix it. Enclosed you will see the repair order from *** and parts bill from NAPA Auto Parts for that part. Several days went by and ********'s husband started to text me with threats and profanity. I told him to read the document, NYS Dealer Used Passenger Vehicle Limited Warranty. He said he had a Lawyer look at it and was told that only was for cars 4 years old and newer. Obviously a Lawyer would never say that. His name was not on any documents and was not part of the transaction so I told him not to contact me anymore. Apparently she again had a problem with the brakes and told me to get it towed and repair the brakes. So I did exactly that. *** put 2 new brake hoses that had started to leak, along with some new brake line that was aged. You can also see by the enclosed repair order and parts bill, I again repaired the car at no cost to ********. Apparently, a day or two after they picked up the car, the brake light came on again. I spoke with ******** two days ago and told her to get it back to *** to see what was causing the brake light. I told her maybe the same as last time, someone could have bumped it ever so slightly to cause it to go on. She said she already checked that, but she would be off work on Wednesday (today)so she would get it to him. NYS law specifically states vehicles with over 100,000 miles are not covered by the dealership.Initial Complaint

So I am trying to buy a truck from a dealership and started making payments on it on April 5 2024 2 weeks go by and the truck started giving me problems such as engine, noises and bogging then a few more days go by and my doorhandle breaks off. I talked to the dealership who is trying to sell me the vehicle and they proceeded to tell me that it’s either expected from 140,000 mile vehicle or that it was my fault for breaking the door handle then another few days go by and it continues to give me white smoke out of my exhaust so I talk to the dealership again and they take it to a shop, but the guy at the shop doesn’t even take the truck and instead he tells me that this truck is fine and tells me to leave so I leave nothing rude or anything like that and then a few more days go by and my front gas tank mount decides to fall off, so then I decided to take matters into my own hands and get the truck inpected for a second time by somebody of my choosing and the shop I took it to aka ***** **** **** told me that the truck should not have been deemed safe it had four wholes in the frame two up by the driver and passenger side and two in the back by the bed of the truck as well told me a few other things wrong with it I have a list of it then proceeded to tell me that the truck is not safe for the roads and would not pass the next inspection this was all done on may 3rd and may 5th is my one mark date right then on may 5th I’m driving right and then I take a turn and the truck front in gives out on me not even 1 month in and I can’t even drive the truck it’s a lemon and that’s not cool it’s parked out side my house right now till I know what to do with it it’s now may 13 and still not driving it keep in mind this truck is not bought fully I’m making payments on it ever 5th of a monthBusiness response

Dear Sirs; On 04/05/2024, ***** ********* took delivery of the 2010 ********* *********, VIN# *****************. New York State Lemon law says if any vehicle sold by a licensed dealer in NY state has over 100,000 miles on it at the time of sale, it is sold “As Is". You can clearly see by the enclosed document, New York State Used Passenger Vehicle Limited Warranty, ***** Initialed the mileage and the exclusion paragraph, and signed the bottom. He was explained to, and understood that was the law of NY state. He was also given a NVP extended warranty for a mechanical breakdown FREE of charge. I believe it is better to have it and not need it, than to need it and not have it. That is what my policy is for my customers. A copy of that is also enclosed. ***** did bring the truck by 2 weeks after he took delivery. The motor seemed to be running very smoothly, but there was some faint noise from under the truck sitting in park. Which I told him by just listening it sounds like an exhaust noise. He also agreed there was no smoke coming out of the rear at that time. I reminded him he has an extended warranty for a mechanical breakdown for his piece of mind, but I don't see any breakdown. The extended warranty is good in any registered repair shop in the country. Then he told me the inside door handle broke and wanted me to fix that. I told him someone apparently tried to open the door from the inside while the truck was running and all the doors locked. They must have pulled so hard that they broke the handle off. It is a piece of plastic. I have never seen that happen before. That was negligence by whoever pulled a handle on a locked door. I then told him to go to a repair shop I do business with very nearby and they would look at the truck when convenient for both parties, at no cost to him. I am not aware of any conversation with the shop owner but days later the shop owner told me the truck was running fine and no smoke was coming out of the exhaust. I was sold a lemon car. I was told it was ready for work and play in the description of the vehicle. It never said it had any problems or any issues and neither did the dealer he said I could just drive and within a week I had to fill the oil and then the wheel locked while I was driving and I almost crashed so I called the police and within another two months the wheel locked on me again and I got into a minor accident so now the dealer is not fixing the car after they reset the codes and I was hurt badly and I am now missing work and not able to move my carBusiness response

ON 03/11/2022 THE COMPLAINTANTSIGNED THE BILL OF SALE AS YOU CAN SEE BY THE DATE ON THE BOTTOM OF THE PAGEOF THE DOCUMENT. ALSO ENCLOSED IS THE REPAIR ORDER FROM *** THAT SHOWS THE VEHICLE WAS NYS INSPECTED, OILAND FILTER CHANGED, ANDA TURN SIGNALSWITCH REPLACED TO MEET NYS REGULATIONS FOR INSPECTION. THE NEXT DOCUMENTSHOWS IT DID IN FACT PASS REQUIREMENTS FORINSPECTION OF NY STATE WITH NO CODES PRESENT. ON MARCH 15, 2022 THE COMPLANTANT TOOK DELIVERY AND POSSESSION OF THE VEHICLE. YOU CAN CLEARLY SEE BY HER INITIALS ON NEW YORKSTATE DEALER USED PASSENGER VEHICLE LIMITED WARRANTY, SHE ACKNOWLEDGED THE MILEAGE OF 113,783 AND ALSO HER INITIALS ON THE EXCLUSIONS SECTION OF THE DOCUMENT, SHE WAS AWARENYS LEMON LAW STATES "ANY VEHICLE OVER 100,000 MILES IS EXCLUDED FROM ANY WARRANTYANDIS AS IS." ALSO AS YOU CAN CLEARLY SEE SHE SIGNED THE BOTTON OF THE ENTIRE DOCUMENT. SHE WAS ALSO GIVENAGOLD STANDARD 4 MONTH, 4,000 MILE EXTENDED WARRANTY FREE OF CHARGE, WHICHI DO GIVE TO ALL MY VEHICLES WITH OVER 100,000 MILES. A FEW DAYS AFTER SHE TOOK DELIVERY, SHE RETURNED WITH HER MOTHER WHO SCREAMED AT ME USING PROFANITYANDACCUSED ME OF SABOTAGING THE VEHICLE. I TOLD HER SHE HAD NOTHING TO DO WITH THE TRANSACTION, AND HER DAUGHTER NEEDS TO COMES INSIDE AND TALK WITH ME. SHE NEVER ASKED FOR ANY KIND OF HELP SHE ONLY SWORE AT ME AND ACCUSED ME. THEN THE POLICE ARRIVED AFTER THEY WERE CALLED BY THE IRRATE CUSTOMER. THE MOTHER CONTINUED HER TYRADE AND PROFANITY WITH 3 OFFICERS. THE OFFICERS CAMEINTO MY OFFICE ANDASKED ME WHAT I WANTED TO DO. I TOLD THEM TO SEND HER DOWNTO ***, THE INDEPENDENT REPAIR SHOP THAT HAD INSPECTED THE VEHICLE. THEY WENT TO *** WHERE APPARENTLY HE HAD CLEARED A CODE THAT POPPED UP AND SENT HER ON HER WAY. RECENTLY. ON JULY 18, 2022 4 MONTHS AND 3 DAYS AFTER DELIVERY, THE COMPLAINTANTCALLED ME IN A PANIC. SHE STATED THE STEERING HAD LOCKED UP AND SHE HITA POST AND HAD SOME MINOR DAMAGE TO THE VEHICLE. SHE AGAIN WAS YELLING AT ME AND NOT LETTING ME GET A WORD IN. Jul 23 22, 02:20p 1.2 THE BOTTOM LINE IS THE NYS LEMON LAW STATES A VEHICLE WITH OVER 100,000 MILES IS "AS IS". THAT IS WHY I GAVE HER THE GOLD STANDARD 4 MONTH WARRANTY FREE OF CHARGE. SHE COULD HAVE TAKEN HER CAR TO ANY REPAIR FACILITY OF HER CHOICE FOR ANYSORT OF BREAKDOWN, WHO EVER TOLD HER THE LEMON LAW GAVE HER 60 DAYS AS SHE INSISTED TO ME WAS COMPLETELY WRONG. SHE WAS AWARE OF ALL THAT AND INITIALLED AND SUGNED AS SUCH.
