I was scammed by Evergreen Agent into thinking they know what they are doing and the program will actually work - I was promised either 2 closings, or that I will earn $30,000 by the end of the program, needless to say none of those promises were fulfilled. Throughout my time working the program, Ive faced multiple issues that, in my opinion, not only fall short of what was promised but also had significantly impacted my success in their program.Even though I started strong, in the last two months of the program, the number of leads I was receiving dropped significantly. I brought this up with my manager multiple times during our one-on-one meetings, and I was repeatedly assured they were looking into it, but there was no improvement. In fact, I later discovered that many of the ads they were running for me (which I was paying for) had the wrong state listed! Thats a huge oversight that directly affected my ability to reach the right audience. Even worse, more than half of the leads I was receiving had either disconnected phone numbers or numbers not in service. I was told they had a system in place that verifies numbers before passing them on, but clearly that was another sale ******** top it off, my original manager kept canceling our meetings, and at one point, I went over a month without a one-on-one. That lack of support made it hard to get any real help or feedback from the program. At this point, I feel like the company has failed to live up to their part of the agreement, which is why Im requesting a refund. Their mistakeslike the incorrect ads, bad leads, and inconsistent supportmade it impossible for me to be successful. They claim that I was denied a refund based on missing a few surveys and allegedly asking for it too late. However, I dont believe these things should have prevented my refund, as I made my calls every day as required. This company scammed me by signing a contract with me guaranteeing to refund the $9600 fee that I paid to work with them if I didn't make at least $30,000 in 6 months. It took them over 4 months to even start sending me leads, even with my weekly requests to get started. I also finished all of the "Education" requirements they point out in their contract and after the 6 month agreement was up I had no qualified leads let alone even a dollar of ROI. They also overcharged me during the 1 month that they finally produced bad leads. I have been in business for almost 20 years and own 3 businesses. I very much understand good business, quality leads and professional conduct. The only talent this business has are the salesman in the beginning that brings you in with a guarantee. He is very convincing that the Guarantee is real and that they produce incredible leads. I have been trying to get my refund for over a month now and the process had been a full week of emailing and calling them daily and then they respond by telling me that they will process the refund and get back to me in a week. They have been saying that for over a month and now they have completely cut off communication for over a week now. I am an incredibly easy person to work with and this company has been the worst business I have ever dealt with.Customer response

They are not willing to refund like the agreement says they will. They are offering to extend the service which is not my first choice so I am stuck with hiring an attorney which will cost about half of the amount being refunded plus the time and stress of dealing with the situation or continue with their service that I or anyone can produce for themselves for $500. I have attempted to talk with them again for about 3 weeks and they are hard to get ahold of.
This "Company" is a very small operation with very little talent that paints this grand picture and gives an offer that they can not deliver.

Evergreen advertised their program that they will guarantee me earning at least $30,000 in gross commission income in 6 months and to pay them back at the end of the program $12,000, and if not make at least what they promised, a full refund via original payment method will be issued. The contract also stipulated that the company will provide "all necessary tech to successfully do the work" and will provide an audit to be sure the technology is "in perfect work order". They know well that the technology didn't work from the beginning. I was not even able to install the Aloware app on my phone even if I addressed it multiple times with ***, but he did not take any measures. I called him from my Hubspot and he confirmed, my cell number calling him, not the aloware number. Requesting further assistance on Nov 21, 2023, nobody answered to my email. On February 5, 2024, I addressed again my issue, when *** answered back for me to reach out to ******* support with the answer "this is strange, I do remember this issue". I worked multiple hours with ******* on the phone to fix it to the general working order, but never worked as it was supposed to.Evergreen agent breached the contract by failing to provide technology in "perfect working order" which affected my ability to perform to the satisfaction of Evergreen standards, and I did not receive the technical support the contract obligated them to provide. After following the entire program, and making 0 profit, I found out that they do not want to close the account which inquires 24% APR interest and do not want to reimburse any money.Since I did not make any profit as they guaranteed in the contract, and they breached our contract failing to provide support, even if I finished all their program and I did my best to do the hard work with so much struggle, I would consider a fair resolution to keep their promise to close my account and to reimburse 50% from my expenses.Customer response

my initial engagement with Evergreen Agent was predicated on the understanding that a credit check was conducted as a routine measure to assess my ability to repay the initial amount of $1,700 for a 6-month sponsorship for the program. It was my understanding that I could then opt for a manageable monthly payment plan if I chose to proceed with the program. However, the reality of the situation has proven to be far more burdensome, with the actual terms of the agreement revealing an overwhelming debt exceeding $11,000.This discrepancy between what was initially communicated and the actual terms of the agreement has placed an immense financial strain on me. In order to meet the unexpected financial obligations imposed by Evergreen Agent, I have been forced to secure guaranteed income through full-time employment, thus significantly impacting my ability to continue my endeavors in real estate.Furthermore, despite my repeated requests, I have yet to receive the video recording of my initial Zoom call with Evergreen Agent, during which the program was explained to me. This recording is not only critical for my understanding of the agreement but also serves as evidence of the misrepresentation and misinformation that led to this predicament.It is important to note that I have only utilized one month of advertising and services provided by Evergreen Agent, yet I have paid significantly more than the value of the services rendered. It is deeply troubling and unjustifiable that Evergreen Agent would assert entitlement to $10,000 of my funds, particularly considering the extent to which I have been misled and misinformed.I am not the only one this has happened to as Evergreen staff has revealed to me that others were told and thought the same as I. *******, before your enrollment with us was made final, there were several steps. Taking out the loan clearly depicted the terms of the arrangement, including the amounts and what you'd be responsible for. You had to verify your identify, confirm you wanted to accept the terms AND even afterwards signed another contract with us that explained your responsible for the total costs. The reason you were denied a refund was because you didn't meet the terms to qualify. We're happy to work with you to find an alternative resolution and turn this into a win/win. I signed up with Evergreen Agent in July of 2023. I followed the program to the ** I had to develop my own excel tracking system because leads were not being imported into my CRM and I was not getting text notifications as I should. I asked for a refund for 2 months before I was told by the 2nd person in charge ***** they would work on it and once I was pushed back to my account manager *******************. She told me I did not qualify for a refund. False! So I read my contract again and found something interesting.Section IV Guarantee ..Evergreen Agent guarantees Client will earn at least $30,000 in **************** Income (GCI) or close 3 real estate transactions on or before the Programs Official End Date listed in section ?, otherwise a full refund via Clients original payment method will be issued as long as they meet all the conditions below*(a) Client must follow all Program And Participation Terms started in section ?(b) Client must fulfill all relevant obligations and requirements as outlined in section ?Section II covers their responsibilities not clients responsibility and section IV covers the guarantee. So the contract I signed does not address section III which covers clients responsibility, which I met. I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:I was not given the tools as described in Evergreens response. Leads were not being integrated into my CRM. I was not being notified on a consist basis on prospects that showed interest. I had to make due with what was given or the lack thereof, However, the main issue is that the binding contract that I signed was not followed. After review of the contract. I am requesting a refund for the sponsorship program as stated in the contract. I have also attached an executed copy of the agreement. Per section IV under (a) and (b). After quoting Sections II and IV below there is additional information provided as well.

Evergreen Agent guarantees Client will earn at least $30,000 in **************** Income (GCI) or close 3 real estate transactions on or before the Programs Official End Date listed in section ?, otherwise a full refund via Clients original payment method will be issued as long as

(a) Client must follow all Program And Participation Terms started in section ?

Courtesy Extension: If Client does not make $30,000 in GCI or close 3 transactions within the 6 month duration because of a failure to meet conditions (a) and (b) above, Client may continue to work with Evergreen Agent until they make $30,000 or close 3 transactions (whichever comes first) but will no longer be eligible for a refund because of a failure to meet the conditions above in the allotted time frame.

Evergreen Agent War Map Simulation
(a) We will provide access to our War Map simulation built on ****** Sheets
(b) The War Map is a tool used to easily identify key targets, actions and projected timelines for Client to achieve specific goals within the program including projections of the day Client will get the first leads, sign the first client and close the first deal
(c) Client will get access to this during their Onboarding Call Facebook, Instagram, ****** And YouTube Advertising Campaign Management
(a) We will create, manage, optimize and scale direct response Facebook, Instagram, ****** And/Or YouTube marketing campaigns to hit goals for paid client acquisition
(b) Provide copywriting for image and video ads including:
(i) Ad copy
(ii) Headline copy
(iii) Hooks and angles for video ads
(c) We will create, edit and enhance all images and videos to ensure we always have fresh new content to test in the campaigns
(d) We will advertise to one funnel/offer at a time
Evergreen Agent Funnel And Offer Creation
(a) We will create an offer to be the core focus of the above advertising campaigns (the lack of this is the biggest reason why most agents advertising campaigns fail)
(b) We will design and build a funnel consisting of a Landing Page or Lead Form, VSL Page and Application Page Evergreen Agent Elevator VSL Creation
(a) We will handle creation of all aspects of the Elevator VSL, a 3-7 minute Video Sales Letter, including scripting, recording, editing, uploading and management
(b) This Elevator VSL will be viewed by leads after opt-in to further enhance lead quality Conversion Rate Optimization Services

Evergreen Agent Tech Setup And Integration
(a) We will provide all necessary tech to successfully do the work during Clients time in the program at no additional cost except for a CRM and phone system
(b) If Client has CRM and phone system, we will fully integrate with it as long as it has all the necessary features
(c) If Client does not have a CRM, phone system or would prefer to use Evergreen Agents, we will handle the full setup and integration, however Client will be responsible for any
associated costs
(d) We will provide a full technical audit and live test to ensure tech is setup properly and is in perfect working order Leads, Exclusivity And Phone Number Validation
(a) Any leads provided will come with a name (first or full), email and phone number.
(b) Leads provided will never be sold or shared with any other party without your permission
(c) Real-time notifications of new lead generation will be sent to Client via SMS or mobile app notifications
(d) There is no accurate way to know whether a phone number entered actually belongs to the lead but custom code will to the funnels landing page to increase valid number
accuracy and further discourage leads from submitting inaccurate information
Attribution And Reporting
(a) All marketing campaign data will be tracked via the specific advertising platform where traffic is being ran, as well as HYROS for more detailed tracking of the customer journey and hyper-accuracy
(b) We will assess marketing performance and make strategic recommendations to ensure
consistency for Client goal achievement Evergreen Agent Team Building
(a) Evergreen Agent will provide consulting services and resources to assist Client with
building and/or expanding a team in their business*
(b) We will help Client recruit, hire and train an appointment setter to call leads and set appointments on Clients behalf
(c) After an appointment setter is in place, well help Client recruit and train local agents in Clients area to join Clients team
(d) Evergreen Agent will oversee the onboarding of new appointment setters and agents into Clients current marketing and sales systems
*An important part of business is knowing the right things to do in the proper sequence. When working with a Client, we will never guide them in a direction that were less than 100% certain is in their best interest. Even if a Client requests to begin Team Building, it may not be approved because Evergreen Agent does not believe the Client is ready for it. Only when both Client and Evergreen Agent agree that Client is ready for Team Building will it begin.
Lifetime License To Our On-Demand Training Platform
(a) We use a platform called, Skool to host essential training videos that Client will retain lifetime access to*
(b) These videos do not replace personalized help with our team but rather serve as a resource where Client can improve their skill set and get help on-demand with key areas
including lead generation, appointment setting and converting appointments to clients
Evergreen Agent ******************** And General ********************** consulting on marketing and sales process improvements based upon qualitative and quantitative data analysis
(b) Assist Client by recommending strategic changes to funnels, offers, advertising campaigns and sales processes in order to ensure sustainable client profitability
(c) When requested or when necessary, teach Client how to replicate any element of the marketing and sales process themselves
(d) Monthly strategy calls with your Account Manager
(e) Client will be assigned a dedicated Account Manager who is their main point of contact throughout the Program to assist with any general support requests and ensure progress is made
(f) Evergreen Agent will provide support via email ************************************* text message (account managers number will be provided during the Onboarding Call), and
zoom as needed (both in a 1-on-1 and group setting)
(g) Evergreen Agents official support hours are 9am-5pm ET, Monday through Friday. Any support request or correspondence received from Client outside of this window will be
responded to the following business day
(h) Evergreen Agent will do their best to provide a 24 hour turnaround response time during official support hours but does not guarantee response time
(i) Evergreen Agent offices are closed during US Federal holidays
Based on the contract that I signed I have met the obligations under Section IV. Not only have I done that as I have provided emails that reflect because of the technical issues on your end and me not receiving all leads via text and them not being imported into my CRM properly, that evergreen has not met all the terms of the contract agreement as well. It is my hope that the 12k will be forgiving/paid off. Thanks

On April 3, 2023, I signed an agreement with Evergreen Agent, LLC to enroll in their sponsorship program. The agreed amount of this program was $1,724.16. This amount was directly deposited into my bank account by ******************** as a loan with the agreement of Evergreen Agent to withdraw monthly payments of $287.36 until the $1,724.16 was paid back in full. My first payment was withdrawn from my account on 5/8/2023 and payments with withdrawn monthly. The $1,724.16 was paid in full on 10/6/23. Another payment was then withdrawn from my account on 11/7/23. This payment should be refunded in the amount of $287.36.I reached out via email to ***************************** who was my contact person and signed me up for their sponsorship to let him know that the extra payment was deducted and that it needed to be refunded and my account closed but no response from him. I emailed him and his partner ***** 4 times in the last month and no response from either of them. I did receive an email from the account manager ***** that requested to set up a time to discuss this on the phone, but I responded that there was nothing to discuss and that I needed a refund of the extra payment that was deducted and my account closed.I have not heard anything after my last email in response to ***********The only thing I want and should receive is $287.36 and my account closed with ********************, LLCCustomer response

At this time, I have been contacted directly by Evergreen Agent LLC regarding complaint ID ********, however my complaint has NOT been resolved because:
Evergreen Agent has responded that the amount of $1,724.24 was only for a portion of the sponsorship program and I still owe money even though it was made clear by ***************************** one of the owners in an email that the only amount that I would owe is $1,724.16.
The email is part of the attached documents.
I had to put a stop payment on my bank account which cost another $36.00 so they would not be able to deduct any more from my account. The total now that is due as a refund is $287.36 plus $36.00.
I have also requested MANY times to close my account but they have not.

The total cost for the program was $12,000. This is the EXACT amount listed in your contract as the total program cost. It appears you're confusing the total program cost with your reimbursement for the sponsorship program.
The loan you took out to finance the program was $12,000. We gave you $1,724.16 to cover your first 6 payments on the loan. Payments are being deducted from your account because you've used up all the money we gave you and the remainder of the loan needs to be paid.
We've spoken several times. Your agreement had a guarantee that stated if you met the terms, we would pay off the remaining balance of the loan. Unfortunately, you didn't complete the work of the program and even quit it early. Therefore, you do not qualify for the guarantee and are responsible for paying off the remainder of the loan.

Company tells you that if you do not get the business expected they would pay off the loan and apparently now I find out that you have to follow some contract rules that are NEVER told to you and your coach NEVER tells you to do these steps, very misleading!!! *****, we were very clear, specific and concise about the terms of our agreement. Per your agreement, we would pay off the balance of the loan if you didn't get the results you wanted, under the conditions that you met the terms of the guarantee. You didn't qualify for the guarantee and therefore you are responsible for paying off the balance.
Before you signed up we explained everything to you and then the contract clearly listed out the terms. We're up front about everything. I do see that you mentioned to your Account Manager that you never bothered to read the contract before signing it.
You hired us to help you with your lead generation and client acquisition for your real estate business. We generated you many leads with online ads and you didn't follow our recommendations for lead management, setting appointments and converting leads, which probably lead to your lack of results.
We've attempted to work with you on several occasions, each time agreeing to resolve your concerns, but every single time you've refused to take action. If you don't do anything then obviously you won't get any results.
Per your agreement, you were also responsible for paying your own ad spend for lead generation but when we sent you the bill you refused to pay.
We hope you have better success in the future but we are not responsible for your lack of action and inability to follow guidelines.

It was not until I heard from another unhappy client that you expected a Friday report and not one of your reps told me that even when U asked three times about your paying it off. I was still told that yes you would do that. You are now losing business since I put out in an agent ******** page all about it and several already told me you tried to hook them and now all agents if in the group know about your scam and have advised me to seek assistance from several agencies who will be doing including but not limited to the board of realtors. I have been scammed to pay $12000 for a system that does not work. Evergreen Agent LLC claims to have sponsorship for real estate agent and claim a system that produces revenue but not only is not sponsorship but they used my social security to finance the program. They do not hold themselves to deliver to the promise. I want them to release me from the $12000 loan that they used to finance the training program, a program that is not suppose to cost me any money. ****, you were never scammed. You reached out to us for help with marketing and sales for your business. Instead of paying $12,000 out of pocket for our help, you chose to enroll through our Sponsorship Program where the cost of the program would be financed and broken down to much smaller monthly payments and then we even covered the first 6 payments on your behalf.
We didn't take out the loan for you and use your information - we gave you the option and you decided to do it yourself. We explained everything to you before you signed up and took out the financing. Plus, throughout the financing process there are several confirmation steps that clearly review everything again and that confirm with you multiple times this is what you want to do.
As for the promise you said we don't deliver on, we've fulfilled the terms of the contract. We created a direct-response advertising campaign for you, generated dozens of leads for you, provided lead management and sales training as well as gave you a dedicated Account Manager to work directly with you to help with whatever you needed throughout the time with us.
We can't control what happens with leads once they're passed over to you. Because we understand how difficult real estate sales can be for some people, your contract had a conditional guarantee.
The guarantee stated that if you met the terms listed and did not achieve your desired results then we would issue a refund in full. Unfortunately, you did not meet the terms of the guarantee.
We understand this isn't the resolution you were hoping for. Your contract does have a courtesy extension in it so we'd still be willing to work with you for no additional cost.

Evergreen agent claimed the program was sponsored which means it is providing financial support. Once you sign the contract then you learn that it is not sponsorship rather they finance it through the agent. Evergreen is in charge of the the program and their system is full of glitch, and they change content on the expense of the agent.
I provided all the supporting document such as their ads that claims the program is sponsored. The issues with their faulty system and lack of coaching and discussion on expectation and requirement which is far from sponsorship, and constantly changing content and without extending duration.

Their coaching is faulty and they change content without taking responsibility for their faulty system. Furthermore, they did not share any ads about my business, they only delivered 4 clients. Their business model is set to get them the $12000 from the agents without keeping themselves committed to deliver what they promise.
They are scam, and I do NOT want to be one of those who finance their scam.

I was sold ******************************* through Evergreen Agent LLC in the amount of $9800 on August 17, 2022. I was sold on the fact that if I did not make any money with the program, they would refund the $9800. I was verbally told I would need to follow the program and they guaranteed at least 2 sales within 6 months. If not, I would get my money back.Per the Origins Agreement page 3 Section 7. Terms of Sale: Evergreen Agent will refund the total program cost of $9800 if I do not close 2 deals within 6 months.I have been working with ******************* and ******************* at Evergreen Agent for 14 months now and have done everything they asked me to do.After 6 months of no sales and due to my ******** account getting shut down, I was no longer able to do marketing on ********. I spoke with ******************* and asked for my money back and that I am no longer able to advertise on ********. ***** sold me on the idea of marketing on ******* and ******* I agreed to give it a try and continue to work with Evergreen Agent.After months of all new training and coaching for the new marketing to home sellers as a listing agent, I was approved the next step in their program. The plan was to spend $600 per month on marketing that Evergreen Agent would set up for me. After getting everything set up and starting to get new leads I realize that they are marketing to home buyers and using ********. This is not at all what I had agreed to. They did not do any marketing on ******* or ****** and I was not getting leads for home sellers. After discussing again with *****, they changed the marketing to home sellers on ********. Getting frustrated with the process I just want to start getting some leads and some potential new clients. After spending another $1800 on marketing I still have no business and have now cancelled the marketing spend. So now, it has been 14 months since I signed on with Evergreen Agent and I still have not had any return on my investment, no clients, no closings, no deals! I have asked for a refund of the original $9800 and then silence. No response from them.I am asking for a full refund of $9800. Thank you for your time and consideration.Customer response

We agreed to refund the total program cost under the conditions that you've met the terms and fulfilled your part of the agreement. We spoke about a year ago about how you did not qualify for the guarantee because you didn't do your part and yes, you weren't happy about it, but you acknowledged it and agreed. We were very clear on this before we started working together again.
The second time around we started to work together, the original plan was to use ******* and ****** for lead generation but we pivoted. Before we launched on your Pre-Launch Demo we explained the shift to ******** and you agreed to move forward.
We've generated dozens of leads for you. We've reviewed your dashboards where your marketing, as well as your sales data is tracked and found little to no sales activity on your part despite over 100 leads being generated for you.
Client acquisition in real estate is the byproduct of both marketing and sales. Both elements must be working effectively to get the results. I do see in our records you made mentions of poor quality leads in some cases, however that's to be expected. We were very clear before lead generation began that not all leads will be the best quality and you will deal with some tire kickers, bad numbers, uninterested people, etc. as is the case with all lead generation.
We tried to identify the constraints in the acquisition process but without the data from you, we're unable to do so.

*****, I acknowledge that you have put in significant work after we agreed to continue working together beyond the original term, however the guarantee is not applicable to that. Your original agreement was for a 6 month term which you did not meet the conditions for a refund and thus, you were denied. We did agree to work together beyond that and provide a courtesy extension but the guarantee does not extend beyond that initial 6 month term. We're happy to find alternative resolutions, perhaps even explore that ************** route if you're willing to put up the ad spend for it.Customer response

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:I did not get any business or close any deals within the first 6 months! As agreed in our contract, there would be a refund. The lack of business was due to my ******** account getting hacked. I am not able to use ******** for advertising. I was no longer able to access any of my accounts, and was blocked from ever using ******** advertising again. Evergreen Agent relies on ******** advertising. After explaining my situation Evergreen Agent agreed to help get leads through ****** and ******** (This never happened either). I believe that Evergreen Agent owes me a refund of $9800 due to them not being able generate business in the first 6 months or anytime after that. (I tried working with Evergreen Agent for 14 months before I quit). I keep jumping through hoops and spending more money and I have had nothing in return from my investment. I am not interested in working with Evergreen Agent. Please refund my money!
