- Advertising Review:BBB sent correspondence to ADK Mobile Nurse Services on May 9, May 22, and May 31, 2023, requesting substantitation for medicinal and therapeutic claims on the website https://adkmobilenurse.com/.
The business did respond stating, "I would like to first draw attention to the word MAY as highlighted before. No promises are made that guarantee this works for everyone. The indications of the vitamins are scientifically what each of those vitamins / amino acids do in our body – this is their functions – from biology books. We are not “making claims” but explaining how each vitamin works in the human body."
BBB responded stating, "The use of the word “may”, or similar phrases in advertising does not negate the fact that the benefit is implied.
BBB Code of Advertising #1. Basic Principles of the Code
1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.
1.3 An advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true.
As stated in previous correspondence, BBB is requesting more information regarding the medicinal and therapeutic claims/statements, and any supporting evidence to support the claims. You may choose to substantiate, modify, or discontinue claims to achieve compliance with BBB’s Code of Advertising #34 Claimed Results which states:
Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data.
For medicinal and therapeutic claims, or claims to diagnose, treat, cure, mitigate, or prevent any illness or disease, scientific, clinical evidence from human clinical trials is preferred to support the claims. The dosing and amounts of specific vitamins and minerals should also be the same to ensure that the results of the cited clinical trials are accurate."
