BBB reports on known government actions involving business’ marketplace conduct.
The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven.
February 25, 2022 the New York State Attorney General filed a temporary restraining order and preliminary injunction in Monroe County Supreme Court. Charges filed allege the business has engaged in unlawful deceptive acts and practices while operating the business and violating the New York Lien Law.
a. Respondents engaged in deceptive acts and practices when they took advance payments and deposits from consumers in New York State for contracts to perform home improvement, snowplowing, construction and landscaping services but failed to provide the
services and failed to refund the deposits and advance payments after promising to do so; and
b. Respondents engaged in a scheme to defraud consumers when they falsely obtained property from consumers by failing to maintain an escrow account for deposits using deposit funds for purposes not related to the consumer's project, in violation of the New York Lien Law; and
c. Respondents engaged in deceptive acts and practices when they performed shoddy home improvement work that resulted in damage to properties that had to be reconstructed and failed to repair the damage or refund payments to consumers.
