    Advertisements should be truthful, sincere offers to sell. Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request.  All advertising that may mislead or deceive consumers should be avoided.

    BBB requested the following:

    Proof of USDOT

    Proof of business start date as the business advertises that they have been providing paving services since 1997. The business registered the LLC with NYS Department of State on February 14, 2022, but may have been operating as a DBA prior to this date.

    Substantiation for the claim "Monroe County's number one paving contractor".

    BBB's Code of Advertising #28. Objective Superlative Claims
    Superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, like “#1 in new car sales in the city,” can be proved or disproved.

    BBB also requested if there is an affiliation with the registered LLC for Monroe County Paving & Demolition, if any, since the phone numbers for both businesses are the same in their respective advertising.
