We gave Marc R**** $5850.00 with United Power Company to order a Generac generator on 4/30/2021. He was to order generator and hold in his warehouse until our condo was complete. I notified Marc R**** on 01/19/2022 that he could come anytime to install. After repeated cancellations from Marc he finally admitted he used our generator on another job but he assured me that another one was ordered for me. This company has 7 complaints (not including mine) for the same issue. This is clearly a business that is committing consumer fraud and he needs to be dealt with.Business response

Marc was to install generator today but instead he comes over and tells us our he used our generator on another job but he was going to make it right. He said he ordered another generator and it would be installed next week. He provided with a new invoice dated 3-10-2022. New invoice shows a zero balance.
He also told us that he would provide us with a tracking number to show that he ordered generator.

*** and I believed we were participating in a legal and valid business transaction with United Power Company when we gave you $5850.00. You have given me nothing but false promises as well as cheat us out of our money.
I requested detail from the Attorney General Office and after reading all of the cases I believe it is a common practice for you to take payment for goods/services and to long periods of time/if ever before delivering / installing.
This email is to let you know I am moving forward with actions against you for consumer fraud. Your deceptive business practice has caused us to suffer financial loss. I will be filing with the BBB and Attorney General and hiring a attorney.

Here is what his email said
I met ***** and *** around 2 years ago and serviced the generator at their previous home. They contacted me sometime after to let me know they were building a new home and want me to advise on the generator project. I went out multiple times to meet with the builders and contractors. Because of covid and multiple delays on product the home was not ready for move in for 8 months. During that time, I made several trips to the site to consult on the generator layout with contractors. Around November I delivered the 200-amp Generac Transfer Switch($980.00) and consulted with the contractor on the installation and layout. As time went by, we were on hold because of the house not being completed. Around January 19th ***** informed me that they closed on the home and would be moving in. I made a trip to her home around 3 weeks ago and tested the transfer switch to make sure everything was correct. I then came back and sat down with her and her husband to inform them that the generator was now out of stock and that we would be on a short delay before completion. We all agreed on this as I sincerely apologized to both of them. They are both great people and I clearly understand the issue. I have grown to know the **** family as I coached their grandson in baseball. I sent ***** an email and text message addressing this yesterday. Per your request I will have this completely resolved on or before April 20th. I respect the **** family and will have this done!

Let me start at the beginning. In April 2021 Marc came to our house and stated there was a 3 month plus wait for equipment. He suggested we buy it now and when it arrived he would hold in his warehouse so we would have equipment when ready to install. He promised us it would go untouched until needed for our job. This was not the case. After numerous excuses he came to us and told us he let our equipment (that was already paid for) go to someone else. It was not out of stock as he stated in his email to you. Most of the rest of his email I agree with. We agreed on the first couple of delays to get new equipment because we didn’t really have a choice. He also provided us with a new invoice that stated we owed him no more money for the install because of all the delays. Right now we are waiting for the 4-20-2022 deadline which will be the last. He has not provided us with a tracking number (as promised) or proof that this equipment has actually been ordered.

I have not heard from Marc to resolve this compliant. He said he would have it completely resolved by 4-20-2022 which is in 2 days. He has another complaint against him since I filed mine. I want to move forward with this matter. I have talked to Columbus POLICE and was told I could press charges against him by going to talk to prosecutor. Could you please call me so I can discuss with you.

Our next step is to file theft charges against Marc which will happen next week.
I am taking copies of all the Attorney General complaints, along with emails I received from the individuals who filed the complaints, a copy of a judgement from Delaware county from 11/2021 and documentation regarding my compliant.
I will keep you informed of any changes in my situation.

Marc came to our house at 9:30am, he had his plumber meet him here. NO Generator in his truck. After looking at the job Marc discovered he needed a couple of supplies that he didn’t have. Their wasn’t enough wire coming out of the junction box. He left at 2pm to gather up suppliers. My husband called him after he left and asked him if he really had our generator. He said he make a couple calls and get back with us in 1 hr.
At 4:15pm he called back and said as soon as Steve called him back he would let me know a time. He said Steve had all the supplies but assured me it would be done today. Marc R**** never called back.
