    On Sept. 12, 2023, a final judgment entry was filed in Warren County Common Pleas Court against defendant Lawrence Hurst dba True 2 Finish, finding that the defendant committed unfair and deceptive acts and practices in violation of the Consumer Sales Practices Act, and ordering the defendants to pay $4,980 in consumer damages and $44,989 in civil penalties. The judgement also prohibits the defendant from engaging in business as a supplier in any consumer transactions in Ohio until he has satisfied financial liabilities.

    In the judgment, the court also restated the below findings of fact, conclusions of law, and ordered relief included in the court's Aug. 11, 2023 order and entry granting default judgment against the defendants, including:

    - Defendant Lawrence Hurst formerly resided in Springfield, Ohio.

    - Defendant did business using the fictitious name "True 2 Finish" which was not registered with the Ohio Secretary of State.

    - Defendant was engaged in the business of soliciting, offering for sale, or selling home improvement goods or services to consumers.

    - On Oct. 15, 2015, the Attorney General of Ohio file a lawsuit against the defendant alleging that he had violated the Consumer Sales Practices Act in connection with the provision of home improvement work -State ex rel. v BL concrete Construction, LLC, Franklin County Case No. 15CV8819.

    - In that previous lawsuit, the court granted a default judgment against the defendant, and on Jan. 6, 2016, the court entered an entry and order assessing damages and civil penalties against him. Defendant was also ordered to pay$14,590.00 in consumer damages and na $10,000.00 civil penalty. Defendant was also enjoined from engaging in consumer transactions in Ohio as a supplier until he had paid all penalties and damages owned to the state of Ohio.

    - To date, defendant has not paid any of the consumer damages or civil penalties awarded by the judgment in Case No. 15 CV 819.

    - In the time since the 2016 default judgment, defendant solicited and sold home improvement goods and services at the residences of consumers.

    - Defendant did not have a retail business establishment having a fixed permanent location where the goods were exhibited or the services were offered for sale on a continuing basis.

    - Defendant solicited and sold home renovation goods and services to consumers and failed to deliver some of those goods and services within eight weeks.

    - Defendant accepted monetary deposits from consumers for the purchase of home renovation goods and services and failed to deliver those goods and services and has refused to refund consumers' deposits or  payments.

    - In some cases, after receiving payment, defendant began to provide contracted services, but then failed to complete the work.

    - When defendant did provide contracted home renovation services, he performed substandard, shoddy and incomplete work.

    - Defendant's performance of contracted home renovations services in a substandard, shoddy, or incomplete manner has resulted in harm to consumers.

    - Defendant did not notify consumers of their cancellation rights nor did he provide consumers with a notice of cancellation form.
