    I am writing you today about Fisher’s and Son’s Construction Company, ** **** ******* ****** **** *** ****, phone number ************. I acquired the company to do repairs my foundation and steps and to place rails around my side porch. The proposal by ***** ****** **. of Fisher’s and Son’s Construction Company, which I will attach and include, was accepted proposal by ***** ****** **., of Fisher’s and Son’s Construction Company and myself, ******** ******. It stated the following: concrete steps will be repaired using 5,000 PSI concrete. All damage concrete on foundation will be repaired. Crack damage concrete on front steps will be repaired. New railings will be installed on side porch and steps. Owner is responsible for purchases of rails. Contractor responsible for purchase of cement. All work will be performed professionally and is guaranteed. This proposal was signed by ***** ****** **, of Fisher’s and Son’s Construction Company and myself, ******** ******, on August 4th 2021, at which time, I paid approximately half of the $750 which was $380, per contract proposal copy. ***** *********,., of Fisher’s and Son’s Construction Company start the repairs in a day or two and then gave the concrete several days to dry and harden. ***** ****** **., of Fisher’s and Son’s came by after a few delays do to family issues, which I, ******** ******, did Fisher’s and Son’s Construction Company had no problems with the job at times, because of the climate of events around the corona virus. Final $375 was paid August 15th/16th 2021. I informed Mr. ***** ****** **., that time that I wanted railing like my front porch has. Mr. ***** ****** **., did not pick up the railing that I asked for, and his only statement was that **** ***** which I do have a credit card for only had the particular one that he chose because I pay for it on the phone while he was there, him being my contractor. He did state that he could have picked up what I wanted someplace else but he chose not to do it. I had other methods of paying for the correct product that I requested, but he never gave me a chance. On August 15th, late in the evening, Mr. ***** ****** **., and another man came to finish my railings. Around my side porch. They did not leave until after 12 midnight on August 16th. Told me to not use the steps until a couple of days, so the cement could set. The next day as I was going out the front door I noticed that the railing on the platform of my steps on the right hand side was not straight. I called Mr. ***** ****** **., and he came and said he would be over to correct the issue. He did try straightening the railing so it was not at an angling away from the house. I had notices, two days after he installed part rails, it rained and the rail started to rust, and I pointed it out to Mr. ***** ****** **.. I request wrought iron like the front of my home, and Mr. ***** ****** **., claimed that **** ***** didn’t have wrought iron railing, he would have to get it from somewhere else. I told him that that’s what I requested at the beginning. I found off from **** ***** that there was a three-month or 90 day return policy on products, and I also informed Mr. ***** ****** **., of Fisher and sons construction company that I wanted him to dismantle the railing so that it could be returned. Mr. ***** ****** **., never came back to finish putting up the rally not would he take them down when I found out **** ****** would take them back since they were rusting and he knew all along what really I wanted but it didn’t wait for his money. And that is where it lay as of today October 6th 2021. Mr. ***** ****** **., was giving adequate time to finish the job and has not done so. If ***** ****** **., from Fisher’s and Son’s Construction Company, would have taken the rails, I would have been satisfied and returned the railings. On the other hand, if he would have returned and finished the railings, I would have been satisfied. My plan to replace the railing with what I asked him for in the first place, wrought iron, when I replace my driveway. Now. The only remedy is fix the railings and making sure that it is secure it pass the 90 day return policy.
