The contract was signed and a deposit was given on April 26 ,2022. I was told several things by **** during the planning stages that turned out to be incorrect. He made his drawing the way he said it had to be and priced it accordingly but when the job was started the guys doing the job did it the way I thought it should be done but **** never repriced the job until I was told it was done and then there were many extras added in order to absorb as much money as possible so he could make the max amount. I had water in my yard before they did the project and now I have the same water plus new water areas that are caused by the repair. I asked that a rototiller be brought out to dig the area and level it. That was never done. For all that was done I paid $7075.86 of which $4383.00 was for the drainage. Their invoice number is *********. The work was done June 10, 2022 - June 16, 2022. The last time I heard from them was on July 7 ,2022 when they came out to throw some dirt on the mounds that were there and put more grass seed and straw. I would like the job repaired so that there is no water puddling in my yard which was the original complaint and I would like the yard leveled out the way it was before they worked on it. I would like it either repaired or the money of the repair back so I can hire another company to fix what was never done correctly from the beginning.Business response

on 6/13/2023 we commenced work on patton drive
during project is was brought up to *** ******* we cannot run to storm sewer like originally proposed. due to new city ordinances
with this being said we had to re adjust. when the laser level was was up we also found the elevations of the property and decided with mr ******* to run piping a different way for proper flow
giving *** ******* $500 deduction from his bill
additional cost that was presented and also stated in contract
permit fees will be additional cost
permit fee $175
due to uncertain in current economy prices may change
only change was piping went up .40 a foot so raised bill $88
we also stated to mr ******* we will be back in 30 days to level topsoil seed and straw trench areas and that was commenced as well
we have pictures of before during and after we can present as well
work was done to scope of work presented and in a workman like manor

There is still water pooling in the yard. **** designed this project with the knowledge of the water areas when he started. Because of the way the work was performed I now have water pooling in new places that I never had water before. I paid to have this taken care of at the start.The daylilies were supposed to be removed from the area next to the shed. All that was done was some taken out and transplanted and the other cut down with a shovel and landscape paper put over them and the stone installed. I now have the plants growing between the rocks and the shed.
The yard was never graded after the 30 day period. When a grade is done things are level and this is far from that. I also have areas that have sunk where the trenching was performed and the trench line can be seen. When the trench work was performed the ground was wet and there was no way the guys could rake it out flat. All they did was put a couple of extra wheelbarrow loads of dirt on it and rake that out then seed and straw it. Nothing got put back to grade after.
Now that it has rained I can see that the old areas are still as wet as they were and I have new ponds that have formed.
I would like to receive what I have paid for and all the water areas old and new be taken care of and a decent final grade done so things are as level as they were in the beginning.

contract states
in back yard, trench and install drain tie as shown in drawling.
install a catch basin by shed and connecting downspouts.
backfill with 57 limestone
top-dress with topsoil
seed and straw
this is the work we performed
as for the material coming up by the shed we cannot guarantee nothing is going to come up as proper weed management is always the proper solution.
for the tile work we also explained to you that it will help but we cannot guarantee a full removal of water
I would love to come out and see what you have going on and see what we can address
we also recommended re-grading the back yard as well but wanted to see how the tile will do first

The reason for my rejection is that they have not offered any solution for the problem. The only responses are that they may not be able to fix the water problem and they are making false statements to try and cover their inabilities to perform a job that they were way over their head on. I showed the spots that I had water in the yard to **** and he drew up a plan to repair the concern. They also put extra dirt by the fence to try and route the water on that side of the yard to the back of my shed where the drain is but all that did was to cause a huge water problem in that spot along with the water concern that I hired them to fix. There is not a word in the paperwork about the work they are performing may not fix the water concern I am having and that my yard may need to be regraded to fix it.
The only thing that was written about grading was that they would come back in 30 days and grade the trench work. There was never any grading performed. I have sunken areas where the trench is and humps from where the dirt was never leveled out after the repair was done.
If anything was said about grading the complete yard why on earth would I put money into something that is not going to work. I am retired and disabled and ever penny I have is needed and I would have spent it the way that would fix the concern properly.
At this point the drain that they put in needs to be moved to a spot were it will collect the water, another drain put were they added the dirt and connect it to the drainage system and the grade done so the humps are gone and the sunken areas are covered up properly.

Please see uploaded documents. Contracted Sherman and Sons to repair patio, stairs, firepit and planter. Job not completed to my satisfaction. Standing water in several areas, job not completed, not leveled, a couple of pavers broken, top landing of steps is not aligned/leveled, huge gap between steps and sliding glass patio door, broken bottom/facing of patio door not replaced; it was suggested that I go to **** ***** to purchase the part. I was given a bag of sand to finish top of steps. Dumped sand/debris in common area behind my house. Broke water hose nozzle. Doubled price that I contracted for.Business response

We where called out to ******* *******s house on4-5-22 to look at her paver patio
When going there she went over with alex on to repair the patio
First recommendation is to start over and do a new patio as there was a decent amount of fixing needed to be done.
******* just wanted a repair done
With repairs we discussed with her we didn’t know how long it will take as there is many different factors involved in how the base was what is needed etc etc
I told her atleast 6 hrs to repair
We then started the work on 5/17
When my forman justin arrived he started to assess the areas in the patio he then started on the smaller area on the patio
Justin then called me to let me know that the steps are a mess and are going to take more time and he discussed with customer at that time it was going to be additional time. He said when talking to her she was upset and went inside.
I (alex) then called her to discuss with her on the situation as well
When I was talking to her I explained that there is a lot more going on under the patio that needs attention at that time I discussed with her I would recommend uplifting the patio and redoing to patio
The response was just fix the low areas and do the steps and was discussed with her at that time prior to rebuild it was going to take more time
She then agreed to the additional time and to not do the fire pit area
Justin continued the work
He then discussed with her he is going to need some additional pavers as some of them we cannot re-use she didn’t want to pay anymore so then justin discussed with her she can prolyl go to **** ***** and get that piece she needed. At the end of the job she was still upset about the price but we where upfront with her the whole time on how much labor it was going to take before we did it and okayed it
She even signed our signoff sheet to to acknowledge the work was completed and to her satisfaction
If she wants me to come out and discuss things with her I will be more than willing to
Thus was a time and material job and if she didn’t want us to continue we could of ended at any timestatement form foreman Justin
the planter box I did the best I can to fix without uplifting anymore pavers which would of resulted in additional cost which she didnt want to pay for
i never forced her to sign any paperwork i simply asked her to sign i stood about 5 ft away from her and told her im sorry it costed so much more i tried to do the work in a timely mannor if she didnt want to sign she could of simply told me no and closed the door
as for the standing water in the spots i did fix one spot that needed to be fixed and the area that was holding water still i informed her i cant fix that as well be would of been additional time and didnt want to do that
the pavers that where allready cracked where allready cracked when we arrived and just glued so i just glued them back together as she didnt want to spend any more money
yes i admit i did dump a barrel of #10 limestone behind her bed as i was going to clean up and totally forgot to clean up
as for the nozzel it was in working condition when i came to her house and also when i left i never even used her hose nozzel any disconnected it when i showed up and reconnected it when i left
summary this was a time and material job as first discussion I (Alex) explained I would recommend a full tear out and re-do but didn't want to pay for the cost
we let her know ahead of time when we where coming and scheduled when we where coming and if a job is not done we do return the next day
we explained before we needed more hours as quote was approximate and depend what is found once starting project
we tried our best to do the job for her and explained as we where going
the puddling was am area we needed to fix but we couldn't because she didn't want to pay more
the paver wasn't fixed because she didn't want to pay more
the steel trim on railing wasn't done because she didn't want to pay more
i am more than willing to come back to ******* house and walk through things with her and see what we can do
we never received a call or anything once job was completed and are always willing to look at solutions so both parties as happy
she did sign our form saying that job was complete and was satisfied with the work as well
unfortunately normally we do, do a job by a contracted price but with so many varibles that we cannot see we had to do time and material
for the reason of what we found doing this patio but where upfront with her the whole time as it will be more and the reasons why it will be more before we went ahead and did it
once again i am more than willing to come out take a look and see what resolution we can come together on
