    $2000 invoice for materials that is supposed to have a $600 credit for not ordering paint. $1000 deductible for completed work. Roth Construction is refusing to refund the amount paid after providing zero work after dropping off the material and canceling/delaying multiple times. Their letter of agreement for the deposit specifically states that Roth would be doing all repairs and work on the house, but instead they are explicitly attempting to use a subcontractor. They are not allowing me to cancel the project without charging me ~$900 even though zero work has started.

    A refund for $2,244.47 will be issued to Mr. ********* out of the $3,000.00 collected to date.  Roth Construction Columbus will waive the 10% overhead and 10% profit provided for in the signed contract as a gesture of good will to Mr. *********.  Mr. ********* will only be charged for the materials ordered and delivered to his home.  Mr. *********’ s claim of his job being cancelled multiple times is ridiculous and unfounded.  Roth Construction Columbus is a general contractor and we use subcontractors to complete different scopes of work, it is stated in the Work Authorization.  Mr. ********* clearly has no interest in working in a cooperative manner with Roth Construction Columbus.

    Please review the timeline below for the ********* job.  You will find the job progressed very well up until it was time to install the vinyl siding on the home.  I’ve also included a copy contract signed by Mr. *********.  The signed contract will address Mr. *********’s claim or concern with subcontractors, deductibles, material draws and the 10% overhead and 10% profit line items. 

    12/14/2023 -     Work Authorization signed by Mr. ********* and Roth Construction Columbus received. 

    12/15/2023 -     Mr. ********* paid his insurance deductible

    12/19/2023 -     Mr. ********* was contacted for his selection meeting.  Mr. ********* said he was out of town and to leave the siding samples at the home. 

    12/27/2023 -     Selections complete. While confirming siding selection onsite, the Project Manager noticed there were two different existing siding profiles 4-inch and 4.5-inch on the home.  The home obviously had a previous siding repair completed.

    1/3/2024 -          After discussing a resolution to the two different siding profiles on the home, the siding was ordered.  Estimated time of arrival for the siding order was two weeks or 1/17/2024. 

    1/15/2024 -       Mr. ********* paid his materials draw invoice for $2,000.00.



    1/16/2024 -       Siding materials were delivered.  Mr. ********* did not unlock the gate to the rear yard as previously agreed so the materials were delivered to the side yard of the home.  Mr. ********* called to complain about the location of the materials so we sent a Roth employee back over to move the materials into rear yard after he unlocked the gate.

    1/17/2024 -       High Temp. 25° - Wind Chill 16°
                                    The siding installation crew arrived at the home, knocked on the door to let someone know they were onsite.  They were told by someone at the home, not Mr. *********, to leave and return on Monday, January 22, 2024 due to the cold temperatures.

    1/18/2024 -        Mr. ********* sent multiple text messages telling our Project Manager how “extremely unprofessional, we have been delayed for over a month” and “last minute cancellations and last-minute plans without giving exact times for work”.

    1/19/2024 -       High Temp. 23° - Wind Chill 10°
    After being berated by the homeowner on the 18th, the Project Manager had the siding crew leader return in the home in the afternoon to make the siding repairs and was told to “get off my property” by Mr. *********.

    1/22/2024 -       The Project Manager and the Estimator billed the project out.  A refund for $2,244.47 has been issued to Mr. *********.  The costs of materials delivered to the home were deducted from the $3,000.00 previously collected from Mr. *********.


    We respectfully request this BBB complaint be removed from our file based on the information provided.

    This documentation is full of incorrect information and lies from Roth Construction. First and foremost, I've not received a refund for $2,244.47, nor any contact implying I would be receiving this. This is two days after Roth stating that they issued it. In addition to this, there are a handful of incorrect documentation within their response:

    1.) The materials were delivered to Roth Construction on 1/12/24 with no contact telling me they had arrived.

    2.) The contractor made no attempt to contact or start work until I reached out on Monday 1/15/24 stating I had already paid the invoice and asking to plan a date to start work.

    3.) Roth's Letter of agreement for the deductible payment was for them to do all repairs, and they instead subcontracted installers to do the majority of the work.

    4.) I didn't hear back until the 16th that they would be arriving on the 17th for install (giving less than 1 day notice). The project manager refused to give me a time that they would arrive.

    5.) Roth dropped off the materials in the morning of the 17th, then the installers arrived some time after that. Then left not doing any work.

    6.) I have a ring recording that shows the installers did not talk to anyone at my home, and are lying.

    7.) I arrived at 1pm and asked the project manager when the installers would be there. He said he didn't know why they weren't working. He contacted them and replied to me, stating that they talked to, "a woman that told them it was freezing inside". He said that they would start work the next day instead.

    8.) I told him that makes no sense as to why someone would say it's, "freezing inside" and that the next day was roughly the same temperature. In addition I told him that NO ONE talked to the installers at my property. My (male) roommate was in the living room when they arrived and left without being talked to.

    9.) I asked what time the installers would arrive tomorrow, and he responded that," I will never get an exact time form my siding sub" and that, "there's no reason to be there".

    10.) On 1/18/24 at around noon the project manager last minute texted me that they were pushing the job till Monday, further cancelling work and delaying the project.

    11.) I texted in response, on 1/18/24, that there repeated last minute cancellations and refusal to plan specific times for work was unprofessional, and asked why the work could not be completed when they scheduled the day and knew the temperatures in advance.

    12.) The project manager again refused to start work and stated that it was, "out of his control", "the siding will get done", "all will be fine". He guaranteed that work could not be done that day.

    13.) After stating that, due to the unprofessional, I would be finding a different company to do the work and would be talking to my insurance.

    14.) The project manager then sent the installers back to my home without my permission in an attempt to harass me and force work to start so they would make money.

    15.) They arrived unannounced and uninvited on my property and without confirming any work they started slamming ladders against my house. They also drove their truck onto my lawn and illegally covered the sidewalk.

    16.) I told them the project was cancelled and that they need to speak to their boss about it, but NONE of them spoke English. They tried to put their subcontractor boss on speaker to try and translate. I informed them they should not be on my property.

    17.) I've been spending over a week trying to speak with insurance and get them to send a refund.

    18.) The project manager's response is demanding that I pay roughly $900 (20% of the full complete project) for them to do zero work for, "Profit and overhead".

    19.) He also snidely remarked that he wouldn't even have been able to provide a 1 year warranty because of issues in how the siding was originally installed (implying that they were going to do shoddy work and not fix the issue). He stated that the siding, "is failing and will continue to fail".

    20.) The project manager also stated to insurance that he, "would never step on [my] property again".

    In addition to this and multiple attempt to try and get a refund, Roth still has not agreed to refund anything and hasn't sent me anything. Their statement on 1/22/2024 has not happened and they have not contacted me about it.

    Mr. ********* continues to mis-remember the accurate timelines related to his project.  Roth Construction keeps detail job notes in order to protect ourselves from customers that mis-remember and attempt to convey inaccurate information to others in an attempt to disparage our business. This will be our final correspondence as it relates to the timelines related to Mr. *********’s job.

    Q: Could you provide BBB with a date that Blake Bisallion can expect to receive a refund of $2,244.47?

    A: The check is being processed today on 1/25/2024 and will be put into the U.S. Postal Services hands today.  I cannot provide a date and/or time the refund check will arrive to Mr. *********’s mailbox.

    Q: 1.) The materials were delivered to Roth Construction on 1/12/24 with no contact telling me they had arrived.

    A: The materials were picked up by Roth Construction Columbus on 1/16/24 from ****** ******** ******** on ******* **** and returned to Roth Construction Columbus.  Mr. ********* was contacted on 1/15/24 to let him know the materials had arrived and then again on the 1/16/24 regarding the schedule for delivery of the materials to his home.  The materials were then delivered on 1/17/24 and Mr. ********* failed to unlock the gate to his rear yard so the siding delivery was left in the side yard next to the locked gate. Mr. ********* confirmed at 3:49pm on 1/16/24 that he would have his roommate unlock the door.

    Q: 2.) The contractor made no attempt to contact or start work until I reached out on Monday 1/15/24 stating I had already paid the invoice and asking to plan a date to start work.

    A: Mr. ********* clearly doesn’t understand that the job cannot be started until materials on onsite and the contractor has been scheduled.

    A: Mr. ********* clearly did NOT read the contract he signed which states “All workman and subcontractors shall be highly skilled in their trade.”

    A: Mr. ********* confirmed at 3:49pm on 1/16/24 that he would have his roommate unlock the door. Mr. ********* complains about wanting to start the job before materials arrive and then complains about being given 1 day notice to start the job

    A: Mr. ********* should discuss this issue with his roommate, when the siding crew knocked on the door to announce themselves, they were told to return on Monday.

    A: Mr. ********* has a recording of installers not coming to the door?  Roth Construction Columbus doesn’t have the luxury of having a Ring recording of our sub-contractor not coming to the door.

He contacted them and replied to me, stating that they talked to, "a woman that told them it was freezing inside". He said that they would start work the next day instead.

    A: At this point the Project Manager didn’t know why the siding crew wasn’t on-site working and he also didn’t know the crew was told to come back on Monday, 1/22/24.

In addition I told him that NO ONE talked to the installers at my property. My (male) roommate was in the living room when they arrived and left without being talked to.

    A: Correct statement, as conveyed by Mr. *********.

    Roth provided an itemized list to ********** and I have made a list of things that they did not do. 7, 9, 10, 33, 35, 37 (absolutely no cleaning or painting of stucco, trim or baseboards was completed); 13 (did not reset blinds at my request); 18 (moved one love seat out/in once - my family had to move all the contents out and assisted the flooring guy with the two couches. Only two men showed up one day. Even though the men and myself repeatedly told the project manager that another person was needed move out contents); 30 & 31 (we never received the Berber carpet installation). I was told by Roth that ********** would not pay for the expenses, because of the additional roof expenses. I assumed that the items I listed would be removed from the revised estimate. Roth removed items #26 & #27, because my existing ceiling frame was still in good condition and I was told there was no need to purchase a new frame. It makes sense that those two items are striked out on the revised estimate. Now if Roth does not want to complete the work they are claiming they performed, then Roth should reimburse the items listed. If there is no reimbursement, I would like the work they claim that couldn’t be complete to be actually finished. I signed off with the knowledge that there was no additional money to get the cleaning and painting of the stucco and the new carpet of the steps. I was never shown this new revised estimate or I would not have signed off that the work was complete. I don’t know if it was intentional, but it seems sketchy that they would tell me that there was no additional money, but submit a bill to ********** like they actually completed the work. I also did not appreciate feeling like I had no choice to sign by the PM, after repeatedly saying that they spending too much money on this “little job” that has become bigger and that my porch was a mess and I should be happy with how it looks now. If i lived in a more privileged area he would not have said this.

    Jon K*********, Roth’s ******* *******, talked with Mrs. ******** on May 10th. Below is the Roth Construction Columbus’s response to Mrs. ********’s complaint.

    Item #7 – Seal & pain corner trim – 2 coats - Mrs. ****** selected a pre-finished interior trim which comes at a much higher price compared to unfinished.  All Seal & Paint money was used to purchase the pre-finished interior trim she selected.

    Item #9 – Clean Stucco – The stucco was cleaned; it was cover in spider webs.

    Item #10 – Seal & Paint Stucco – A credit has been issued.

    Item #33 – Seal & pain casing – 2 coats - Mrs. ****** selected a pre-finished interior trim which comes at a much higher price compared to unfinished.  All Seal & Paint money was used to purchase the pre-finished interior trim she selected.

    Item #35 – Seal & pain baseboard – 2 coats - Mrs. ****** selected a pre-finished interior trim which comes at a much higher price compared to unfinished.  All Seal & Paint money was used to purchase the pre-finished interior trim she selected.

    Item #37 – Seal & pain trim – 2 coats - Mrs. ****** selected a pre-finished interior trim which comes at a much higher price compared to unfinished.  All Seal & Paint money was used to purchase the pre-finished interior trim she selected.

    Item #13 – Detach & Reset Window Blinds – The window blinds were detached and Mrs. ****** took the blinds inside the home.  Mrs. ****** originally stated she did NOT want the blinds re-installed. The blinds were not made available on the last day of work to re-install.

    Item #18 – Contents – move out and reset – Contents were moved by Roth Construction during our work in the home.  If Mrs. ****** helped the flooring installer move items that was her decision, the flooring installers are paid to manipulate items in the home during flooring installation.

    Item #30 – Additional labor cost for Berber or patterned carpets – Glued down carpet was in the insurance estimate and Mrs. ****** chose sheet vinyl which required floor prep.  The money from this item was used to help offset the upgraded flooring costs, see text provided by Mrs. ******.

    Item #31 – Step charge for waterfall carpet installation – Glued down carpet was in the insurance estimate and Mrs. ****** chose to upgrade to sheet vinyl.  The money from this item was used to help offset the upgraded flooring costs, see text provided by Mrs. ******.

    Item #11 – R&R Suspended ceiling grid – The ceiling grid was removed around the permitter of the room due to the existing paneling being installed between the ceiling grid and the exterior wall. This is why a partial credit has been issued. The existing grid was not damaged so it was not replaced.

    Justin J****, ******* ******** had issued a credit to Mrs. ****** in the amount of $230.26 before this complaint was made.

    It is common practice in the insurance industry to submit supplements to the insurance company for additional work discovered during the re-construction process.  There is nothing “sketchy” about the process, we submit a request to the insurance company with supporting photos and a description of the work and it is approved or denied by the insurance company.

    Mrs. ****** was not forced to sign off or approve our work, in fact the walk-through meeting is the place to ask to have the blinds re-installed if that was Mrs. ******’s intention.  Also, “privilege” has nothing to do with our work at Roth Construction Columbus.  Our job is to return the home to its pre-loss condition 5 minutes before the damage occurred and that is what was done for Mrs. ******.

    I believe Mrs. ****** is happy with Roth Construction Columbus. We have agreed to address another punch item that was brought up in our conversation. I think Mrs. ******** will agree to have this complaint removed from our reviews.

    I accept the business's response to resolve this complaint. Roth management contacted me and listened to my concerns and worked with me to complete the work. Roth apologized for the inconvenience and oversight and any unintentional negative impact that may have been caused. I appreciate management and the project manager working with us to resolve.
