Contract was signed on 3/29/2022 for interior remodeling. Copy attached. Work commenced on 8/1/2022. Last work was completed on 8/30/2022. Approximately 70 % of the contracted work was left unfinished. Amount paid was $16,002. The following items were not completed: Tile, paint, and finish fireplace mantel install tv above fireplace install shoe molding secure baseboards install countertops install backsplash paint door moldings and change hardware on interior doors install transition strips on floors install sink and garbage disposal also floors are starting to "pop up". Numerous broken promises from ****** ****** to complete unfinished balance of contracted work. Work was still incomplete in January 2023 and homeowner had to contract for the work to be completed by other workers and purchase countertops, backsplash, flooring, and other materials. TPC/****** ****** have refused to refund balance for incomplete work and supplies as outlined to him in correspondence dated 9/29/2023 in the amount of $9271 which reflects the additional cost for labor and materials to finish the contracted work. On 11/16/2023, Mr. Artrip stated he would work to resolve this issue, however, to date, no resolution has been proposed.

In August of 2022 we signed a contract with TPC Inc in Baltimore Ohio for home renovation. They repeatedly failed to communicate after they received our deposit check of 50% of the total cost. They did not communicate a start date which in a sit-down meeting in August have been discussed at the end of September. I continued to reach out week after week for status on the start of the project. In mid-october life situation made it so that we would be selling the house we were looking to renovate. After some back and forth with the contractor and still no start to the work we requested a refund in early November 2022. From that point on it has been a nightmare. Eventually in January 2023 the contractor asked if he could give us 10 checks to cash over the course of 10 weeks to provide our refund. Three of the checks cleared the bank. Two of the checks bounced. He asked for more time to come up with money to refund us. At his request we stopped trying to cash any additional checks he issued. We are now sitting at the end of April 2023 and he still is a poor communicator in terms of status. And we still are short roughly 7,500 of our refund with no indication of when he will actually refund the money. We have also filed a complaint with the Ohio Attorney General. What is even more disturbing is that in his email dated April 21 2023 his signature is still indicating a BBB rating of A+. 1 but a check of your website shows that his rating is actually a D. I feel as if that is misrepresenting his business as well as the BBB. Is there anything you can do to help. Sincerely, ******** ******

I am rejecting this response because: TPC continues to act in bad faith and has yet to provide the full refund.  Attachment shows latest email traffic.

Tried unsuccessfully to have projects completed by the company, since we paid our deposit in January (2023) we have had very little communication with them until the beginning of March 2023 when we contacted them and told them if they could not complete the projects by the end of the month that we were done with them. They said they could do that and then failed to make any arrangements to do so or even communicate with us what was occuring to stop them. The last time they stated they would be starting was 2 weeks ago and they didn't show or contact us as to why. We then contacted them and told them we could no longer continue with their company because they continued to be unavailable. We understand they had issues/problems but this was never communicated to us until we reached out to severe ties with them. They have been given until April 10, 2023 to refund our deposit and either make arrangements to deliver the fixtures we paid for to us or arrange to purchase them from us.

We signed a contract with TPC Inc, Mr. Dwight W. A*****, *************** on 6/28/2022 with a deposit of $15,375.00 with a commitment the job would be complete on 8/4/2022. The deposit was for 50% of the signed contract. We paid additional payments on 8/8/2022 for $2600 and $5108.40 on 9/7/202. for portions of the project that were completed. TPC, INC last piece of the project was to provide and install new Cabinet doors, drawers, and self closing hardware. This to was supposed to be completed by an original date of August 4th 2022, which TPC, INC President Dwight A***** came up with the timeframe. We asked for a realistic timeframe before we signed in June, and asked for him to provide one he could make. This is the datehe came up with. After well over a combined hundred phone calls, emails, and text message by the home owners, the majority unanswered by TPC, INC; and after commitment after commitment missed, by TPC, finally in January 27th, 2023 TPC Inc, ********* Dwight A***** and the Home Owner agreed in email it was best to part ways and have TPC pay the home owner back the unused portion of the deposit. On January 30th 2023 Dwight A***** agreed to make make 4 payments of $1,309.82 (4 X 1309.82 = $5,239.28) starting Feb 15th, 2023 then March 15th, then April 15th and last payment on May 15th, 2023? Dwight missed making the first payment, and committed a couple of times after February 15th he was putting it in the mail, then finally asked on March 6th asked for more unspecified time until he received approval for a loan. The home owner let Dwight know this was unacceptable and I would file a complaint if I did not receive the first check by *** March 8th. As of March 12th I have not received a payment or a reply from Dwight A***** or TPC, INC.

    On January 30th 2023 Dwight A***** agreed to make make 4 payments of $1,309.82 (4 X 1309.82 = $5,239.28) starting Feb 15th, 2023 then March 15th, then April 15th and last payment on May 15th, 2023?

Dwight A*****/TPC has not made an of the payments.   This cannot be closed until Dwight A*****/TPC makes the total payments of $5239.28 or the two payments he missed so far of $1,309.82.

When will Dwight A*****/TPCmake full restitution?

BUYER BEWARE: WE DO NOT RECOMMEND TPC ! DO YOUR RESEARCH ! We entered into a complete master bath remodel contract with TPC on May 26, 2022. A substantial deposit was made on that day for our remodel. In addition, we were supplied with a calendar that laid out the process and timing of start and completion of remodel, which is one of the reasons we accepted TPC’s bid for the project. It should be noted that our remodel was supposed to be completed in October of 2022. Well, nearly 9 months after we signed the contract, issued down payment and gave Dwight two additional “draws”, unfortunately, we were left without a completed bathroom. Communication, or should we say, lack of, we thought was the issue. While communication is terrible, the real issue is money. The misuse, mis-appropriation and fraudulent way it is handled. Receiving down payments, asking for and receiving draws, in order to pay subcontractors and then NOT paying subcontractors for work they have done. This has left us vulnerable to liens by the subcontractors, as that is the law in the state of Ohio. While we could list all the calls made to Dwight A*****, the timeline of work, the days of waiting for someone to come to work on our project and no one showed, the emails sent to Dwight, the texts sent to Dwight, the in-person conversations with Dwight, all of which we do have documentation for, I will make it short and sweet. We were lied to on many, many occasions. We were promised completion dates, all of which have came and went. We were asked to accept less than acceptable quality of some goods. We have been left with the only way to finish this remodel is to pay others what we have already paid TPC to complete. TPC, Dwight A*****, Kevin S******* and any other entities of the company owe us money. They owe many people money. They have 5 current complaints against them with The State Attorney Generals Office, Please do your homework should you consider entering into any contract with TPC, Dwight A*****, Kevin S******* or any other associates of theirs. They steal client’s money and subcontractor’s labor.

    Business response

    03/24/2023

Our attorney has submitted a resolution procedure.  We have agreed to the customer's request even though we were not given the opportunity to complete the project nor were we paid for work that was not completed.

    Customer response

    03/27/2023

    TPC's ,response is categorically false.

     1.  TPC was in fact paid for work that was NOT completed.  That amount is $5,595 which is owed us.

    2.  TPC had more than ample time to complete all the work for our project, as we contracted with them on May 26, 2022 with a proposed completion date of October 7, 2022.  By Januaray 18, 2023, after no contact by TPC for 2 weeks straight, we had no choice but to consider our project abandoned.  We had to find a way to move forward in order to get the work completed, as our home had been torn up for several months, without an end in site.

    3. We have on multiple occasions requested that we be provided lien waiver/releases for the subcontractors whom in fact did do work on our project. We have never received those, and now have been put on notice from one of those sub-contractors that they intend to file a lien against us due to non-payment by TPC.  That lien is in the amount of $12,500, which TPC had our funds in their possession in order to pay the sub-contractors, yet they failed to do so.  So, frankly, they have misappropriated our money and not paid at least 3 of those sub-contractors as of the date of this response.

    4.  We have not received any communication or offer from an attorney of theirs.

Bluntly, they have stolen our money, not completed the work in a timely or appropriate fashion and have left us with having to pay others for work that was already paid for.

The only resolution to this is complete and total restitution of all monies owed us and our subcontractors, along with valid lien releases for all of those who did in fact do the work.

I first met with TPC Inc (aka The Painting Company Inc) Dwight A***** 6/22 to discuss remodel of my kitchen & master bath. He was responsive to emails/texts right up until I hired him & gave him $25,000 on July 7 2022. After this he would go weeks before responding to my calls/emails/texts. Per Dwights email on 6/28/22 I was given a start date the 1st part of August 2022. This date was delayed over 5 times, demo on my kitchen began 10/5/22. The guys he hired for the Demo tried to steal my microwave, and were rude. After 2 days of demo I was left with no sink, no working dishwasher, no flooring, no cabinets, exposed wires and torn drywall for a month. I had to do my dishes in the bathtub. On 10/11 cabinets were finally delivered after one poor excuse after the other from Dwight. You think this would be a good thing....however half of the cabinets were wrong. After more promises Dwight said he could get the correct cabinets quickly, to this date I still do not have 4 of the correct cabinets. Per Dwight's email on June 28th: kitchen will take 2 weeks not including countertops, bathroom will take 3 weeks start to finish not including glass. I have over 50 texts/emails from Dwight saying someone will be to my house today, 75% of the time no one shows. Someone shows up to work 1 to 2 days a week from 10 to 3pm. Per Dwights email June 30th (before I gave him the 25K) he states: we work full days, 8:30-9am to 4:30/5pm. The only time someone worked these hours was the tile installers, which brings me to the next issue: The tile in my kitchen was just installed on Nov 24th and 25th (yes Thanksgiving). They scratched my floor when moving appliances, broke fridge ice maker. I called Dwight every day in Oct, never retuned 1 call. Bath was demoed 11/9, he demanded another 10k, which was given to him. I have a kitchen that half complete and bathroom torn apart with exposed drywall/wires. Dwight stole $35k from me, he constantly lies & rarely follows through with his promises.

    Business response

    12/02/2022

This is completely inaccurate.  We have installed cabinets, tile and framing.  Tile work will begin tomorrow in the bathroom.

    Customer response

    12/08/2022

I am not disputing cabinets were installed, however I have serious quality concerns with the cabinets. Most of the cabinet door fronts have cracks, the pantry cabinets are not supported correctly, cabinet above fridge is not level, and many of the cabinet install screws were placed incorrectly. Tile floor has significant lippage in spots, etc. Although I appreciate people showing up to work this week I would like the BBB to be further involved with weekly updates until my concerns are addressed and the job is finished correctly. Dwight did send me an email saying he would address these concerns, which I appreciate, however until these promises are followed through on and the job is finished correctly I would like my complaint to remain open.

These issues are being addressed as discussed with client.  There is not an issue with the installation of the cabinets.  We are simply not done yet.  There is an uneven gap between the top of the cabinet and the ceiling.  This will be covered with molding.  The ceiling is not plumb, but the cabinets are- that is why all installers use a trim piece.  There was a complaint about screws in the back of the cabinets being exposed and spaced differently.  That is how cabinets are attached to the wall and we have to install screws where the wall framing is.  I have also offered to provide and install color match covers over the screw heads inside the cabinets.  I do not feel this is a standard practice, but we are providing this at no charge to the client.  Once we are given the time to complete the project, the end result will be exceptional.  If it is necessary to leave this open, that is fine with me.  I have complete confidence in the resolution of any client concerns.

Description: Hired TPC to remodel 2 bathrooms. A hall bathroom and a master bathroom. Remodel was to begin on 5/17/2022. After multiple no call/no shows from May until end of August TPC finally completed the hall bath on 8/28/2022. They were to start the master bath on 9/7/2022. I specifically discussed the no call/no show issues with the owner, Mr A*****, before agreeing to proceed with the master bath. They have again no called/no showed. I have requested my deposit for the master bathroom, $6415, to be refunded. The original signed agreement was that TPC would have 30 days to refund any deposit. I requested refund on 9/7. As of 10/7, TPC admits to owing my a refund in full (I have emails and text messages from the owner) but they will not return my funds. I am seeking my refund amount back so that we can find another contractor to complete this project. I have attempted to resolve this with Mr. A***** and he does not follow through. I agreed to allow him to make 3 equal payments occurring on 10/7, 10/14, and 10/21. He did not show on 10/7 to make the first payment.

    Business response

    11/28/2022

Balance of payments will be made to complete this refund.

    Customer response

    12/04/2022

I am rejecting this response because: until I have the refund I do not consider my complaint resolved.  Mr. A***** will not provide a payment schedule or offer a date when he will honor the refund.  By his contract, we were to receive our deposit refund within 30 days.  That date was 10/7.  We are now 2 months beyond.  How is this not considered theft?  If I walked into his business and took $5000 dollars I would be guilty of a crime.  How are his actions any different?  I believe this complaint should remain open and unresolved until Mr A***** returns my deposit.

Contracted TPC to remodel 2 bathrooms. Gave $5,150 deposit. Work was supposed to begin in April, then June, etc, etc. Repeated attempts at communication were met unanswered or I was given false updates ("we will be there tomorrow at 7am" which then no one would come, etc). I have documentation of these interactions because they were all over email or text. I even wrote a summary of our repeated communications and it spanned 5 pages. TPC only showed up once to partially demolish 1 bathroom, leaving it unable to be used, in August. I have now been without a bathroom for almost 60 days. I finally told them on Oct 5th the work needed to be done Nov 1st or I would file a complaint and ask for my deposit back and I was again lied to that "It will be done".

I paid a 50% deposit on 4/4/2022 to complete a walk-out basement to TPC Inc, owned and represented by Dwight A*****. Mr. A***** advised me that the work would be completed by the end of April 2022. After numerous attempts to contact Mr. A*****, I received communication on 6/16/2022 that the work would be completed the following week. After no communication the following week and many more attempts to contact Mr. A***** through calls and texts, I received a text message on 7/28/22 that the work would be completed from 8/8 - 8/9. After nobody showed up to perform any work, I contacted Mr. A***** on 8/9 and asked for a refund. On 8/10, Mr. A***** said he would refund my deposit. After another month of trying to contact Mr. A*****, I was told on 9/12 that I would receive the refund by the following Friday. After several more attempts to contact Mr. A*****, he responded on 10/3/22 with a promise to pay. Mr. A***** then emailed me on 10/7 asking to arrange refund payments. I responded to the email on 10/7 asking for clarity and dates for which payments would be made. There has again been no communication from Dwight A***** or any representative of T.P.C. Inc. There has been no work started or completed and this company has yet to refund my money.
