    I bought a new boat From Tiger Marina, which is the repair shop inside Copper Kettle. I had an old boat and trailer. Tiger Marina was disposing of my old boat due to it not being repairable. I was to keep the trailer for the new boat I purchased. I leased a dock with Copper Kettle because the fork driver walked out on them the day I spoke to them. Tiger Marina wasn't sure when they were going to be able to get my old boat off of the trailer. He asked me to get a dock for a month until they could figure everything out. I leased a dock from Copper Kettle Marina for two months. They were able to get my old boat off the trailer sooner than expected so I called Copper Kettle Marina and asked them if I would be able to cancel the 2nd month.The Last I spoke with told me that it wouldn't be a problem and that she would reimburse my card on file. She never did. I reached out to talk with her but she was unavailable and another guy answered the phone. He seemed angry by the story and said that she was on vacation and He would get with her when she came back. I did not hear anything from them. I was not reimbursed so I called back. They became argumentative and said that there are no refunds. I would have kept my boat there and used what I paid for that f they would have told me that but was under the impression that if I get my boat out before the 1 st months expiration date that I would be reimbursed for the 2nd month. This is not a complaint on Tiger Marina whom I purchased the boat but rather Copper Kettle Marina. Tiger Marina is a repair shop inside Copper Kettle.

    There seems to be a misconception about the forklift operator 'walking out'. We had already hired another forklift operator, so there was never a time we did not have someone to operate it.

    **** prepaid for 2 months, and signed a contract stating there are no refunds on dockage. 

    Although we are glad **** was able to get his boat back sooner than expected, we cannot offer refunds on utilized rented space.

    Hello Ms. *****,  

    We received your correspondence sharing ****** *****’s concerns with us. I appreciate the opportunity to respond. 

    I reviewed this August 1, 2023 claim involving Mr. *****’s 2003 Toyota Corolla, driven by Skylar Scoot. I hope you find this information helpful with providing a summary. 

    We obtained a statement from Ms. Scoot saying she left the mall and driving home in the 2003 Toyota Corolla when this loss occurred. She said a vehicle in front of her suddenly stopped and she tried to brake but couldn’t avoid rear-ending the vehicle.

    We verified this loss as a motor vehicle loss event. Since Mr. ***** did not carry Collision coverage on his policy with us, we were unable to help him with his property damage claim for his 2003 Toyota Corolla or address any associated tow or storage charges from this loss. 

    We provided Mr. ***** with an update, and he requested we reimburse his tow expenses, but we were unable to accommodate his request. We explained that his Roadside Assistance Coverage applies only to a covered emergency as defined by his policy provisions which say the following on page 26:


    PART V—ROADSIDE ASSISTANCE COVERAGE 

    INSURING AGREEMENT 
    If you pay the premium for this coverage, we will pay for our authorized service representative to provide the following services when necessary due to a covered emergency:
    1. towing of a covered disabled auto to the nearest qualified repair facility; and 
    2. labor on a covered disabled auto at the place of disablement. 

    If a covered disabled auto is towed to any place other than the nearest qualified repair facility, you will be responsible for any additional charges incurred.

    ADDITIONAL DEFINITIONS 

    When used in this Part V: 
    2. “Covered emergency” means a disablement that is a result of: 
    a. mechanical or electrical breakdown; 
    b. battery failure; 
    c. insufficient supply of fuel, oil, water, or other fluid; 
    d. flat tire; 
    e. lock-out; or 
    f. entrapment in snow, mud, water or sand within 100 feet of a road or highway. 

    Since the accident does not meet the definition of being a covered emergency, we were unable to help him with any tow or storage costs.
