******* committed per a signed contract to remove and reinstall new flooring. He also wrote to remove and reinstall new flooring. He also wrote prime and paint walls. There were no areas documented on the contract signed that would not be worked on by the contractor. However, the previous stated things were not completed at the end of his job. There were patches on the wall in the bathroom around the vanity that were not properly painted, there are patches and holes around the bathtub surround that were not properly caulked and painted, and there is spots in the flooring that were not finished and laid correctly. I spoke to ******* who completed the job himself directly multiple times requesting that he would come to finish the job. Through text messages, he stated that he would be able to come and complete the job, however, on the day that he promised to come he never showed and from then on out ignored my emails, messages, and phone calls. He took the full payment of $3, 800 but did not complete the work. I would like to be refunded for the amount it would have cost to remove the tile flooring from my bathroom. He simply placed the laminate flooring over top of the tile flooring without my permission. The contract stated that he would remove the tile flooring and did not and this was an expensive part of the job that he did not complete, yet, I had to pay for. I have tried numerous times to reach out to him but have been ignored on all accounts.

I agreed to do a bathroom remodel for ****** *****. Remove and reinstall trim, remove and install floor. Remove old tub and surround. Reinstall new. Remove old vanity and install new. Remove toilet and reinstall new. Prime and paint walls. At the time of installation date Miss ***** did not have any of the supplies she order from lowes and home depot. And said she had no way to get it to her house. I drove from Huber Heights, OH to Fairborn, Ohio to pick up the order to find out the order was not in stock. Had to make a second trip to Fairborn to pick up her order and another trip to Beavercreek because she ordered from two different places when there was a Lowes in Huber Heights. I spent my own time and gas to pick up Miss *****s material. We spoke about the floor on the difficulty of removing the tile and we agreed to lay the new floor over top. I did not make that decision on my own. Miss ***** was told previously she would need a plumber to change out water lines. She was unable to contact one so I had to have a Plumber come from Sidney to Huber Heights on more than one occasion to complete changing out the lines which held me up 2 days. I completed all the work listed for Miss ***** and even removed all material off sight. I collected half the price as deposit and was paid the other half when the bathroom was completed. No refund will be given as the job was completed.

    Complaint: ********

I am rejecting this response because:
As he stated in his response, "The job was completed", it was indeed NOT completed as the attached photos in the initial complaint show. He agreed to replace trim, it was not completely replaced as seen in the pictures. We did not have a formal conversation of any means regarding him placing laminate over the tile, if this were the case, I would have referred to the original contract where I paid additional for tile removal and asked that the price be adjusted to reflect that you weren't removing tile, which you explained being a very tedious job requiring additional money. Instead, you and your son decided to not remove the tile and when I walked in and saw you covering the tile, you said, oh yeah the tile is too hard to remove. There was no discussion! You had finished half of the flooring by then and at no point did you stop and come out to explain why you weren't removing tile. And if you finished the job, why is there text evidence supporting that you would come finish the job at a later time? This entire situation was absolutely ridiculous! I have given credit where it was due, instation of vanity and surround. However, the flooring and trim were not installed according to the agreement.

In response to the plumber and picking up supplies, those were things you agreed to do and your plumber was paid for the work they did. You were told before hand of picking up material and agreed before work began.

I am simply requesting a refund for you not removing the tile. It's a job you agreed to do and I paid for and a job you did not do.
    Sincerely,

    ****** *****
