    We contracted K.S. Woodworks to build an outdoor living space in August of 2023 and was completed at the end of October 2023. There is an (1) year workmanship warranty (see attached contract). Contractor was paid in full. Included in this project was a concrete pad and it has multiple cracks and getting worse. Vertical post needs to be repaired (not vertical level). Roof flashing is coming apart. Shingles do not cover the entire roof structure and need repair. Front existing gutter was damaged by a truck delivering materials and it needs replaced/repaired. The contractor refuses to call us back and will not accept our calls. He has responded by email and stated he will not make requested repairs to the cracked concrete (we did not get to address any of the other repairs except the concrete). Since he refused talking to us we have not had the opportunity to address the other issues we stated in this report. Our concern is we have (1) year to get these resolved and that leaves us just a few months.

    Prior to construction of this project, The customer had a terribly cracked and uneven driveway.  As a result, there was a clause put in the contract in regards to this.  There had been signs that the driveway was lifted and repaired at least twice.  According to the customer one of the small pieces of equipment used in construction(under 4500 lbs) caused these cracks to worsen to the point that replacement was necessary.  He was insistent on taking money off the contract, but being out of my area of expertise, I handed this to my insurance company to deal with.  The insurance company determined that any damages that may have occurred was strictly a result of the pre existing damage. An engineering consultant determined the same thing. After receiving news of the claim denial, the customer threatened to sue my company if I did not provide inaccurate information to the insurance company on his behalf.  I told the customer that I would not be doing that, he sent a response proclaiming his disrespect and disappoint and I never heard anything else.

    During the construction process, the customer verbally assaulted a long time business subcontractor and friend of mine in regards to this incident. The subcontractor was made so uncomfortable that he left as quickly as possible. Both the subcontractor and I noted this gutter damage and driveway damage before the project began.  The customer explained that the gutter damage was from an appliance delivery truck or something of the sort.  He mentioned that one of my delivery trucks did it and I let the issue pass, but it did make me skeptical of his character.

    In regards to the patio, my concrete subcontractor was dealing with family issues, so I was in need of somebody to handle the additional concrete. The customer mentioned that his Nephew was in the business, so we all agreed to let his nephew proceed with the concrete.  Not having dealt with this person before introduced risk to the project, but the Customer assured me he was the expert.  This exact situation was dealt with in the contract as well.

    I am the type of person to always handle any concerns a customer has with the work I do--However, in this case, The customer has created an environment in which it is not safe to do so.  Both my Insurance company and legal team have highly discouraged me entering the property, and knowing the level of verbal abuse and blame gaming this customer is capable of, I am not comfortable with it.

    As far as the signed agreement. I know we sat at our kitchen table with K*** and both signed the bottom page of the warranty that we supplied in the original complaint. However, K*** took that with him and we never received a copy for ourselves.
    The final payment was $500 less due to the fact that we purchased the mantels for the fireplaces and since they were added in the contract both parties were in agreement that the final price was $72,500.
    Also, K*** stated in his response that my nephew did the concrete work. My nephew works for ****** ******** *** ********. ****** offered to do all the demo and prep. K*** refused and did it all himself. K*** was not even at my home the day of the pour, I have an email stating he had another appointment if you would like me to send that to you. ****** ******** *** ******** have a BBB rating of A+.
