The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On Feb. 14, 2024 the Ohio Attorney General's office filed a civil lawsuit in Marion County Common Pleas Court against defendants Derek Barkley and Barkley Construction, LLC regarding providing home improvement and constructions goods and services to consumers for work on their residences in Marion and other counties in Ohio.
The lawsuit alleges the defendants failed to deliver some goods and services, failed to complete some work, provided shoddy and substandard work in some cases and failed to make corrections, and failed to refund some consumer deposits and payments when requested.
The state is asking that the court to order the defendants to pay damages to consumers, to pay civil penalties, and to prohibit the defendants from engaging in business in Ohio until they have satisfied all monetary obligations ordered by the court.
The matter is pending.
