    Consumer had hail damage to his property last June. The company doing the installation of his new
    siding is doing a terrible job. Consumer is considering this work is fradulent and not meeting the
    manufacturing specifications.

    I am rejecting this response because:

    The owner of Tri-State Windows, Siding and Roofing, ******************* is not taking the siding my house seriously. His action towards the siding replacement I consider fraudulent. He has lied to me and to the building inspector. His installers continuously lie to me. The only reason that I see for their lies is so they can avoid the time, material and labor necessary to comply with the contract, building code and quality workmanship. On one occasion I tried to show ******************* the building code and he refused to look at it. The installers has caused damage to parts of the new installation and blame the damage on me.

    A quality siding company would have taken two weeks to do a quality installation of the siding, complied with the contract, and completely complied with the building code. Given the rain that this area had received, three weeks would be allowable to do a quality installation. It has been over three months since he started work on my house, and it is still far from being completed. The initial crews only worked from 9:00 AM until 2:30 PM with an hour for lunch. This was in April when the weather was cool, so temperature would not be a factor for their poor work ethics. 

    ******************* seems to not respond to anything for one to almost two weeks after anything is done. Then it is another week until he schedules crews to do the work. It has been over a week since he was here and he has yet to schedule crews to replace a corner, vent cover and flashing. I believe he is deliberately dragging this out just to harass me since I am adamant about contract compliance, building code compliance and quality workmanship. It seems that every time I inspect his work I find even more very bad workmanship and building code issues.

    At one time an installer named ** said to me that "I'm not paying for it". I took his statement as he was referring that my insurance is paying for the contract not me, so quality doesn't matter. This company has no idea how the contract is getting paid, and how it is getting paid should have no relevance about quality of workmanship, building code and contract compliance.

    I should not be the person that needs to inspect or supervise the work of the installation crews. They have asked me how I want things done, I should not have tell them how to do their job, That is *********************** or a project supervisor's job. If I am to tell the crews what is needed and how to do it, I should be paid.

    Besides non-compliance with the contract, non-compliance with the building code, poor workmanship and deliberate construction delays they are in violation of Toledo Municipal Code 941 for failing to control sediment runoff of a construction site.

    This is far from everything that they have said and done. At this point in time, if they are willing to refund my deposit, I am willing to relive them of their contractual obligation. This is so I can hire a quality company to completely remove and replace their poor workmanship of a siding job. If Tri-State Windows, Siding and Roofing, would ever complete my house to comply with the contract and building code I will need require them to have a 25 year Maintenance Surety Bond for repairing my house due to their poor quality workmanship.

    In 2021, we had a water issue in the basement where rain water was coming in through a corner of old siding that needed replaced. Another basement specialist told us to make sure the siding installer knew to add flashing to prevent it from happening in the future. I told Tri-State to add flashing, but he didn’t seem to listen or agree that flashing needed added. I didn’t say anything because they were supposed to have been the expert. I let it go and they went ahead replaced the old siding. Fast forward two years and the same water problem is back in the basement. We had a separate basement company come out to assess and discovered Tri-State failed to add any of the flashing or J-channels needed to ensure sufficient waterproofing. We called Tri-state to try and work out what happened. We had an appointment scheduled for 1pm and an hour after the scheduled appointment I called the office to say the owner never showed up. They told me he got held up and would be late. That’s fine, but a phone call letting me know he was running late would have been courteous. I’m told he’ll be back about 4:30. He finally shows up around 5:00 that evening. He tells us to run the hose on different spots of the house and call him with a report on where/when the water leaked into the basement. It looked like he was going to try and help. However, we called the next day with results and no one ever returned our call. We called again the next day and still no response. It’s been a week and the company has yet to respond to our request to look into the leak, fix our siding and/or explain why flashing and J-channels were never properly installed. Also, back in 2021, the crew installing the siding nailed the siding so deep into the side of the house the nails are sticking out into my laundry room. Additionally, the crew smashed a doorbell and it took multiple calls to get them to come back and fix that as well.

    The company said they were surprised of this complaint, as they have been already working with you to address the leak.  They said you contacted them about the current leak and although their schedule for the day was full, they were able to come out at the end of the day and assess the issue.  They performed a water test at the foundation, waited the proper amount of time (while still at your home) to rule out that the leak was coming from the foundation area. The next step was to do a water test at the siding area.  As it was getting late in the day, they instructed you on how to spray the siding (location of possible leak), so there was plenty of time for the water to travel to the where the leak was occurring.  You were to let the company know the results of the water test the next day.  The owner got your message that the leak was coming from the siding and they had you on the daily board and were trying to work you into the schedule.  Please call them to confirm a time/date to finish this repair.
