    The contract was signed on June 6, 2024. I asked for fence to be built in front and back yards. Rod iron for the front and privacy fence in back yard. The privacy fence is hideous and doesn't even go all the way around the backyard. They used my old posts and shoddy slats.cracked pieces of wood . It is a poorly do b e job. I was charged $8652.24 and I paid them $5000.00 up front. I have made my complaints to the owner and he refuses to fix it. I got an estimate to fix it and that is $1800.00. I refuse to pay them the rest of the money cause I'm very unhappy with the job they did. I was told by one of the employees that I am stupid and don't know where my property line is. I just want my fence done right. He has told me that he is putting a lien on my house. Knowing I was planning on saying it. That's alot of money to pay for a bad fence job.

    The issue Mrs. ****** is referring is not with the company Roger Hemming Contractors, LLC but with our sister company ******** **** ******** ***** * ******* ***.  Mrs. ****** signed a contract with ******** **** ******** ***** * ******* *** on June 7th 2024. Our crew began the tear down of the old fencing and put the wood fence in the backyard up starting June 26th.  They returned July 12th and started working on the panels in the front yard.  On August 19th they returned to install the gates.  In the time between June 20th and August 19th, Mrs. ****** was home when the crew was there and did not complain about any issues with the fence, nor did she call the company to say there was an issue.

    Mrs. ****** was sent her final invoice on  August 23rd 2024, and that is when she started complaining.  Her complaint was that she wanted the fence to be placed the other way.  We explained to her that we put the fence up facing the same way it came down and that we only do it the way she was wanting us to change it if there was a city ordinance.  I called the City of Russel to confirm that there was no city ordinance on the matter.

    Our employees have been nothing but respectful and professional with Mrs. ******.  She was never referred to as “stupid”.  However, Mrs. ****** was very hostile and rude towards multiple of our employees, cussing and calling them stupid. 

    In the contract with Mrs. ****** it states “If payments are not made as agreed in this contract ******** **** ******** ***** * ******* will exercise the right to shut down work on the project with no liability or obligation until payment/payments are brought to current status.  Payments delinquent over 10 days will be charged a 10% service charge and shall reoccur monthly until all monies are paid to ******** **** ******** ***** * *******”.  The payment was not received by 10 days after, September 3rd.  So now there will be a 10% charge for the month of August & September.  

    Mrs. ****** signed the contract knowing that if she did not pay there would be a lien placed on the property.  She was reminded of that during one of the phone calls we had with her.  She again was very hostile and using profanity towards us and stated she was not paying us another dime.  After she refused to pay, we did move forward with placing a lien on her property.

    In conclusion, Mrs. ****** had 7 weeks from June 26th (when the back fence went up) until August 19th (when the gates were put in) to address any issue she had with the fence.  Instead, she waited until it was time to pay to complain.  If she truly had an issue with her fence, she should have let us know as soon as possible.  Moving forward we request that Mrs. ****** pay the overdue amount of $3652.24 with the 10% late fee.  Once it is paid in full we would be more than happy to send her an estimate to make the changes she is requesting.

    I'm sorry but what he said iss all wrong. I have been complaining about the fence since it was finished, the front fence was not even done. I was very clear with what I wanted when the man came to do the estimate. I assumed he understood cause he kept repeating what I was saying. My dogs were supposed to be able to go from the front yard to the backyard, they cannot. The privacy fence should have gone all the way around my whole backyard and it does not. The side fence and front fence are facing the correct way but the back fence is backwards and there is no other side. The board that was screwed to the brick has already broke. The fence should have went behind my shed, it does not. The owner came to my house and I told him the privacy fence was not right and he would not listen and said there was nothing wrong with the fence. All this was said before the front fence was put up. The fence is not level. It does not go all the way around my backyard. I was the one that called city of ******* about the ordinance because the fence company told me that the city ordinance said the fence had to be backwards. They order the wrong fence for the front yard so they said I had to pay restocking fee when they knew what kind of fence I wanted. I made it very clear that I couldn't go more than a day or two without a front yard fence cause of my dogs. So they take down the front fence and the next day they bring the wrong fence so I have no front yard fence for a month and a half. Which caused me to have to get rid of one of my dogs. They never let me know when they were here or when they were coming back. I'm paying all this money for a crappy fence. It's embarrassing. They put cracked boards and broken board up. It's an all around crap job and I feel like I'm being bullied

    Tell us why here...The issue with Mrs. ****** had been resolved.  She had plenty of time to address the so-called issues she had with her fence and did not do so until it was time to pay.  If Mrs. ****** had raised concern about the fence before completion, we would have resolved the issue.  There were no issues with her fence, and she simply did not want to pay. We did the fence exactly how Mrs. ****** requested from the beginning and put it up according to the City of ******* ordinance.  Once we placed a lien on her property she called and harassed our office staff. She made multiple vulgar remarks and cussed our staff out.  Eventually, she did pay her final bill but continues to harass our business. Our employees and office staff have been nothing but professional to Mrs. ****** even though she has become very hostile. 
    She is reporting this issue as Roger Hemming Contractors, LLC, which has never done a job for her.  As previously stated, it was done by ******** **** ******** ***** * *******, LLC. Her continuing to harass and slander our company is not taken lightly. If she wishes to continue, we are prepared to take legal action.  We take pride in our work, reputation and treatment of our employees and the constant harassment will not be tolerated due to her simply being upset over her final bill.
