Date of transaction was February 29, 2024 Amount paid: $30,250.00 I paid this company to build a 30'x40' pole barn.It has been built but there have been problems with the building.I requested them to fix the problem in March with follow up texts every couple of weeks. The builder, ****, continued to inform me that they would have someone out soon to fix the problem. They still have not fixed the original problem, which was that my garage door panels on the building are too short, leaving the wooden beams exposed. Now there are more problems to which I have informed **** of. He refuses to help and now ignores my texts and calls. Two of my newer problems are due to their work not being up to code. The building is too close to the edge of the pad. The building is 10 feet too close to the electrical pole. His mistakes are costing me thousands to fix.

    Re: ************************

When we built this barn, ************** had his pad ready and told us to build it on the pad. We did exactly that. He now insists that we move his barn or give him a refund. He complained his trim wasn't wide enough and I had planned on having one of my sub-contractors revisit the site to look at it; however, he started getting belligerent and threatening that we had to completely move his barn or refund it. I realized nothing we did, short of refunding or moving the entire building, would please him.  Regarding his door, he told the Overhead Door people to adjust it and how he wanted it adjusted and they did what he told them to do. ************** wants nothing short of having his barn moved from a site he told us to build on and that's something he should have checked into before he built his pad.  I will NOT deal with a hostile client who's problems are of his own making; further, I have checked with my attorney and was reassured moving his barn is not my responsibility.

I am rejecting this response because:   I never asked for the building to be moved, that is ridiculous.  I asked for help on the repairs and I asked for the trim to be fixed.  The trim was done incorrectly, it is not long enough. I was informed it would be fixed months ago and it has still not been fixed. The building was built too close to the electric lines, it is out of code.  The builder is responsible for building it up to code.  I am being charged to move the electric pole.

I would also like to note that **** claims I "started getting belligerent and threatening."  This is a lie, not once have I gotten rude with this man or acted belligerent in any way. I have never once threatened him in any way. If he wants to continues saying I did that I ask he provide proof of this.  However, **** did get belligerent and rude with me multiple times in a very unprofessional way.  I would also like to point out he never set foot on my property one time to make sure the building was being built correctly.  If he had I'm sure these mistakes would have been avoided.

In an effort to bring this complaint to a compromised solution, I am willing to send a sub-contractor out to check the building and repair any trim that needs to be repaired. We're not responsible for moving the building or repairing the overhead doors as that is his responsibility. He told us where to build the building and he took it upon himself to have the Overhead Door re-situated.

I want to make it clear that I have never asked for the building to be moved.

There has never been a repair needed for the overhead doors. The only problem is the panels that wrap around the door edges being too short. I never had the door re-situated. Please stop lying... I had the trim moved to where it is supposed to be, the man who did this from Sallisaw Overhead doors can attest to that. He told me they were unable to place the trim where it should be due to the panels being too short, causing a large gap.

I have reviewed the business response and accept this resolution on the premise that **** will personally be there during the repair and to look over the building with me.

In response to **** claiming that I "told them where to build it."  I hired an "expert" who I expected to provide their expert opinion on where the building should go and who should know the codes to build it up to standard.
The expert I hired should have informed me if the pad was too small, too close to the power lines, or any other problem he saw.  **** failed to do so which is causing me more money.
As the customer with zero experience/qualifications in building anything I simply had a pad made without any knowledge of it being in a good position and/or big enough for the building.
I hired experts with the expectance of them sharing with me what needed to be done.
