    My brother had leased an apartment with The Bristol during his Army ************************ Course beginning in August 2023. I also began the same course and lived in the hotel the Army provided, and then later moved in with my brother. I was added to the lease. On January 16, 2024, the day my brother graduated from the course, we went to the office at The Bristol to take my brother off of the lease. On this day and during this meeting, I signed paperwork and gave The Bristol notice that I would vacate the apartment in February, under my orders from the Army relocating me to ********. I vacated the apartment on February 24th. I had the apartment professionally cleaned on February 25th. I have forwarded my Army orders to the Bristol multiple times. The problem is that The Bristol has left me numerous phone messages and now is calling my family members to charge me rent for March 2024 and is threatening eviction. This makes no sense, as I no longer live in the apartment. This complex advertises itself as military-friendly, but they are disregarding my army orders to try to charge more rent. I want billing adjusted to remove any charges for March in accordance with all of the information above and with my Army orders. Also, I would like my deposit refunded.

    The complainant states that they were a resident of "The Bristol" apartments which seems to be located in ******, **, but this complaint was sent to us at ********** on May apartments in ***, OK. This complaint does not look to be an accurate complaint for ********** on May.

    Dear ***********************,

    Thank you for reaching out to share your concerns.   I have reviewed your file and do not see where you were a lease holder at The Bristol Apartments in January of 2024.   You cannot give notice to vacate on an apartment that you are not on the lease for.

    Upon further investigation, I see that you in fact submitted an application to apply to be a lease holder on February 8, 2024, submitted a current pay stub and then signed a Lease Agreement on February 14, 2024,holding you responsible for the terms of that agreement.

    According to Section 24 of your signed Lease Agreement and the Service Member Civil Relief Act, you are required to provide your landlord written notice of your intent to end your lease early and a copy of your military orders.  Notice should be provided no fewer than 30 days in advance of planned early termination of the lease.  Notice must be hand-delivered or mailed through a private business carrier or using return receipt requested.

    The records show that you did not provide written notice of your intent to vacate along with your orders until yesterday, March 11,2024.   This holds you financially responsible for monies due through April 10, 2024.

    Again, we appreciate you sharing your concern, but we must uphold the requirements of the Lease Agreement, the Service Member Civil Relief Act and Fair Housing requirements.
