The vehicle in question, a 2005 Chevy Avalanche, was purchased by me ($3,000 down payment placed) on 05-06-2022. My home burned down and I had to take leave from my place of employment due to this. The only place I had to go, to shelter my 6 children, is at my sisters home in Ohio. I called and spoke to the car lot on 05-20-2022 and relayed to them the address and phone number in which I could be reached. On 05-21-2022 the vehicle was towed from my sisters home. The tow company notified me that the car lot had put a repossession order in 3 days prior. The paperwork the tow truck driver showed me said it was due to non-payment, despite the payment not showing due until the following month. I could not reach the car lot until Monday (05-23-2022). The woman that spoke to me on the phone initially told me that the truck was repossessed due to the tracker box being unplugged. When I called back for clarification, she informed me it "pinged" in Missouri. When I asked her why she said it was repossessed for not working she did not have an answer. She informed me that the owner of the car lot would "more than likely" not be returning the vehicle to me. She also stated that he would personally call me to tell me why. Several hours later, he still had not called. I had to call their sister lot in Muskogee because they would not answer my phone calls. When I was able to reach the Muskogee lot, I asked for a refund. I told them that $3,000 was a very expensive two week rental. They told me that they were not informed of a refund policy. I still cannot reach the car lot in Mcalester. (Please see attached)

    Business response

    06/24/2022

Business Response /* (1000, 5, 2022/05/26) */ My name is Brandy ********* and I work for EZ-Pay used Cars in Mcalester Ok. I attempted to contact customer to pick up title on 05/20/2022. I left a message. Customer called back and I told her the title was ready to be picked up. She explained that she was in Ohio and asked if I could mail it. After she told me the address to send title to, I asked if vehicle was in Ohio, she replied "No" I got a rental. After we spoke, I used our GPS and the vehicle was not in Mcalester. I hired a repossession company on 05/20/22, not before. Only because we were lied to about the location of the vehicle. We always answer the phone, our office hours are Mon-Fri 9-6 and Sat 9-2. We mailed a letter out stating customers options for other financing. Consumer Response /* (3000, 7, 2022/05/30) */ (The consumer indicated he/she DID NOT accept the response from the business.) I do accept this casual response from EZPay. The phone that was called and a message left on it burned in the home fire. I have not received phone calls (on my true and correct phone number that they are in possession of) or any additional correspondence. The respondent is the salesman that initiated the car sale originally. I called the car lot in a timely fashion, after the home fire. They were willingly given my address and phone number. I had to temporarily change both due to the fire. The lot is content is repossessing a vehicle after 2 weeks of use and a $3,000.00 loss. Business Response /* (1000, 12, 2022/06/09) */ Contact Name and Title: Brandy ********* Contact Phone: XXXXXXXXXXX Contact Email: *************@gmail.com I called the customer on the phone number she provided when she purchased the vehicle and left a message that her title was ready for pick up. She then returned my call and told me that she was in Ohio due to circumstances she could not control. I had asked her if she had driven the vehicle to Ohio. She replied no that she had gotten a rental and that the vehicle was here in Mcalester. She gave me her sisters address to send title. I tried locating the vehicle after we hung up and it located last in Missouri, and that had been several hours prior to our conversation. I tried to locate the vehicle several times and our GPS could not locate it. In these circumstances, she was untruthful, our tracker had been disconnected, so this calls for automatic repossession. (Please see attached) Consumer Response /* (3000, 15, 2022/06/10) */ (The consumer indicated he/she DID NOT accept the response from the business.) This establishment has taken my down payment of $3,000.00 and will not refund any of it.
