            Contracted with concrete company for interior concrete staining of approximately **** sf of space, to match existing flooring in the rest of the house. A $2100 deposit was placed and 8 weeks went by before the job was started. They were supposed to float a skim coat before staining. We don't live nearby and had to wait until we were told the job was done. The floors were never skim coated and the walls in the entire house had floor stain splattered on them. We had just had the interior painted. The floors themselves in no way match the existing floors and have underlying cracks and paint visible. There is concrete debris dumped in our back and front yard and trash from the project all around the house. We informed the contact for the company of what we found, and the company placed a lien on our property to be paid in full. We are going to have to get the home repainted and the floors fixed. Sheppard Concrete did not fulfill their contract, ruined existing painted walls, surfaces, doors and cabinets and now has placed a lien on our property.

            Upon completion of the job, we invoiced the client for the work and had attempted to collect it for approximately 2 1/2 weeks. We received a phone call from the client and they told us that their spouse was in the hospital and that we were not to contact them again for any reason. We asked if we could call at a later date (to arrange collection of the balance amount) and we were told that we could do that if we wanted but they would not answer or respond. Approximately 3 days later we were forced to put a lien on the property. Approximately a week later, the client contacted us one afternoon and I made arrangements to meet with them the same day and spent about an hour with them addressing their concerns. We have had one conversation with them since, and I am confident that we will negotiate an acceptable remedy to include repainting due to our scope of work not being cleanup up properly upon completion. They are currently getting estimates and I expect to be in communication with them next week about the estimates they have for paint work.

            I am rejecting this response because:

            We were "sold" a concrete floor stain to "closely match" existing flooring by an individual who identified himself as the "owner of the company..." We later discovered he was not. The job that was done in no way approaches a match in color, hue, finish or technique. The stain did not go all the way to the walls and the transitions from stained concrete to exiting granite composite tile were left bare and incomplete. We have had 2 other companies who stain concrete into the property and were advised that the job was botched to such a degree that we will not likely be able to go back with stained concrete at all. We have signed statements to that effect. On seeing the job for the first time, the only response the true owner of the company had was to the effect that "alot of people like it like that. It looks industrial." We did not want an "industrial" look. They also mopped a "sealer" over our pre-existing stained concrete that has bubbled. So we will have to go back over our other flooring and have the stain bubbling buffed out. If the company could not do the job to our specifications, we should have been informed of this up front. We now have an entire house of flooring that needs to be reclaimed, as well as the remediation of the damage that was done to the walls, cabinets, doors, panelling, and woodwork. We also have discovered that the workers rinsed their mops out in our kitchen, bar and bathroom sinks. This has ruined a hammered copper bar sink and broke the plunger on the sink. Every time we visit the home, we find more damage.

            After our last conversation we was waiting on the customer to provide us estimates for the paint work that has to be done due to the clean up not being done correctly. As far as the stain work goes i strongly disagree with them. We provided the customer with a proposal that states we would be doing an acid stain, this is the only type of stain work we do. The acid reacts to the existing floor and creates an old stained factory floor look. It is impossible to match a 20 year old floor and we would not ever promise to do that. We will make contact with this customer in the morning on 11/15/2022 to see if we can make an appointment to drive to tulsa and meet with them. We will bring our proposal / agreement for the acid stained floor and ask that they bring any estimates for damages they claim so we can try to come to a final resolution of all concerns. In over 40 years we have always done our best to do good work and would like to try and resolve this matter with the customer in a thoughtful and appropriate way.
