    January 30, 2024 we paid Oregon Asphalt LLC $8500 We live on a dead-end rural road. A pickup pulled into our driveway and the driver told my husband that they had some regrind asphalt from a nearby job and they could give a good price of $20 sq. ft to level, pack, lay, and roll the product. Sounded like a good deal so we agreed to a strip in front of our shop. Within 5-10 minutes several pickups, 4 dump trucks and 3 pieces of heavy equipment rolled onto our road. They immediately started aggressively doing the work, at times all 3 pieces of equipment running at the same time. This took us off guard and before we knew it, they had done the whole area, except in front of the shop, plus the south side driveway.They were to lay a small strip in front of our 36' wide shop. When asked about the cost were told a couple of times that a 100 sq. yard area would be around $2000 and was assured that they would take care of us. No verbal or paper contract was presented until they were a few minutes from finishing the area we actually agreed to. They did 4 times more than originally discussed then presented a contract for 4 times the amount they led us to believe it was going to be. They misled us on the dollar amount and on what the product was they were using.When we asked for an invoice stating the amount of product used and what kind of product they put down, we were told that they couldn't do that. They didn't know how much was in each of the dump trucks because it was loaded from their stockpile and not weighed.We have had one phone conversation and have sent a pre-complaint letter to Oregon Asphalt LLC as required by CCB before filing a formal complaint. The response was quite clear that they were not interested in working toward any kind of resolution to our concerns.We truly feel like we were scammed. We did not seek their services, they came on to our property. Doing business in this manner and taking advantage of the elderly should not be allowed.

    The only misleading information that is in the paragraph that you have wrote against my company is that you were misled in any way, shape or form your husband was told a price from the beginning and that price was stuck the whole time it did not change. Yes, we have lots of machines lots of equipment and lots of dump trucks. That is why there is cost involved your husband took it upon his self to do this project, and when it came time to get paid for the project The wife was unhappy about it. The signed and acknowledged contract, says to lay area in front of shop for agreed flat price with recycled asphalt. The work that was done out there for the exact amount that was signed. You also reach out to me asking me for a materials list or an invoice my invoice is my contract with my price on it stating what type of work is to be done and what type of product is to be used and you signed that and acknowledged it satisfactory of work completed, and you paid me when the job was finished

    I am rejecting this response because:

    The price we were given was $20 per square yard. We asked for a small area in front of our 36 shop and a small pad on the north side of the shop to park our 14 **. Due to the instability of the ground, the ** pad wasnt completed. There was no discussion of laying the south side driveway nor the area leading out to the road. **** became anxious with the additional work and asked a couple times about the price; each time he was given an example of 100 square yards would be $2000, which was about the size of the pad we expected. At this point, they had already done everything except what we asked for, and no measurements had been taken to confirm the size of the project we asked for. Therefore, there was no way for us to know the total cost of the project from the beginning, as indicated in your response.
    As for the contract, we were not presented with it until they were 2 hours into the job, when our son-in-law, a contractor, came and started asking questions. That is when a couple guys pulled **** away; only then, was he told of the total price. When they presented the contract, we were then told that the work was not warrantied,and that we had to sign off and pay the full amount before they completed the job, or they could put a lien on our property. Your staff was persistent and intimidating in stature. **** was overwhelmed and backed into a corner. He felt like he had no choice but to sign it.  Also,we never received the Information to Owner About Construction Liens Notice that is required by the *** to be given to the client.
    Section 1 of the contract description is handwritten with these words: To lay area in front of shop for agreed flat price before completing job. Clearly does not state the material used nor the amount of product. As a consumer, I believe that we have the right to inquire about this since your contract/invoice left out these details. When I asked for this information, you couldnt or wouldnt give it to me. Yes, **** signed it, under pressure (before the job was complete.) Yes,we paid you because it was made it clear that we had to.

    We can talk all day long about this at the end of the day you your son and **** had gotten a set price on paper that you signed before the job was done for $8,500 total and you signed that and paid that amount it also states in the contract you signed that there is no warranty when we sale recycled asphalt just like you paid for are sales are final it would be the same as putting you down loads of gravel we dont warranty that in example if I dump you a load of mulch Im not going to guarantee that mulch wont grow weeds through it also the Oregon statues and notices are on the contract you signed and acknowledged as well

    This complaint has not been satisfied. I became ill and have spent the last few days at the hospital for tests. I understand that the deadline has past and will accept that it is just the way things are sometimes. But, I want you to know that this company is very shady in how they conduct their "legit" business and made no effort to answer our questions about the materials used and the amount of material that they actually layed down. The owner was very rude and as much as told us to go fly a kite, he didn't have to give us anything. I would have been happy if he had just sincerely apologized and gave us the information we asked for originally.

    On February 21, **** a man came to my door from Oregon Asphalt LLC and said that they had leftover ground asphalt from another job and said he could cover my driveway.I asked him how much and he said *****. I said that was more than I could pay and he said he could do ****. I asked him if he had to know today and he said yes. So my driveway needed some work so I said yes. When they were done he told me it would be $10,000.00. I told him that he said $1.500.00. He said that was the feet. I told him that I could not pay that. He then said ********. I said that was more than I could pay. He then said *****. I still said too much. So he said ******** and that was it. After I paid him another guy brought up a contract. I found out after the fact that I'm not the only one who has been scammed by this company. "WOULD STRONGLY RECOMMEND THAT NO ONE USES THIS COMPANY'

    Beginning on 26 October: Oregon Asphalt LLC arrived to pave our driveway. The price was $8,000, for which I gave them a check. They did a sloppy job, leaving less than clear-cut edges, leaving black pebbles all around, and leaving an uneven, dipping surface. I stopped payment on the check. A person came to our house who identified himself as the owner of the company and father of the supervisor.I learned that what they had put down as paving was "recycled asphalt." I specified to them everything that was wrong with the work that they left and that they needed to put down regular asphalt. They did so, but created more problems by simply putting a new layer of asphalt on top of the recycled asphalt. In doing so, they raised the level of the driveway so that we no longer had a step leading to the entry to our house, the water meter that needs to be accessed monthly by the city was totally covered o ver with asphalt, pebbles were still scattered about, etc., etc.The "father" came back to be paid after the job was purportedly completed. I told him that I would give him only $5,500 because of the poor job they did and the level problems they left us with. He strenuously objected, telling me that he would report me to the ******************** and in fact at one point insulted me by calling me a name. Someone came back later and put down two pieces of metal over the water meter, metal that slips and slides any time a car drives over it, and is totally useless.Given my age (92) and how much stress this so-called "paving of our driveway" entailed, I finally agreed to give him a check for $6,000--an amount that far exceeds the totally incompetent, basically sloppy, and customer-oblivious stupid job that they did. I do not want this company to do any further work here in the form of "repair.". A $3,000 refund settlement is warranted.

    There has not been any calls received from this customer they where not happy with recycled asphalt so we installed hot mix asphalt at a discounted rate customer did recieve a partial refund and that price was set with wet ink on a contract which we have signed by ****** there will be no more money given back on are end and they where also aware before the asphalt was put down that it was going to be higher than there meter in the ground at the rate they where charged did not include raising that meter

    Our contract with Oregon Asphalt reads:

    OUR CONTRACT READS: "To grade base lay and compact hot -mix asphalt in driveway. For agreed flat price as stated below."

    1. THE CONTRACT SAYS NOTHING OF LAYING DOWN RECYCLED ASPHALT. 

    2. LAYING DOWN THE HOT-MIX OVER THE RECYCLED ASPHALT RAISED THE ***** OF OUR DRIVEWAY. THE HOT-MIX ON TOP OF THE RECYCLED ASPHALT COVERED OVER THE STEP LEADING FROM THE DRIVEWAY ONTO OUR PORCH, LEFT A GULF BETWEEN THE DRIVEWAY AND STEPS TO OUR GARDEN,, THUS MAKING IT IMPOSSIBLE TO ACCESS THE GARDEN WITH A WHEELBARROW, AND MADE THE WATER METER THAT IS READ MONTHLY BY THE CITY INACCESSIBLE.

    THE SUPERVISOR FAILED TO CONFER WITH US ABOUT SUCH CHANGES. THE RECYCLED ASPHALT SHOULD HAVE BEEN REMOVED AND THE HOT-MIX ASPHALT LAID DOWN AS SPECIFIED IN OUR CONTRACT.

    WE NO LONGER HAVE A VERY USEFUL AND PRACTICAL STEP LEADING FROM THE DRIVEWAY ONTO OUR PORCH. THERE IS A GULF BETWEEN OUR DRIVEWAY AND THE STEPS LEADING TO OUR GARDEN MAKING IT IMPOSSIBLE TO USE A WHEELBARROW UP THE STEPS FROM THE DRIVEWAY INTO OUR GARDEN. THE ***** GRATES PUT OVER THE *** DEEP HOLE HOUSING THE WATER METER--THE REMEDY BY OREGON ASPHALT---SLIDE, SLIP AND DO NOT STAY IN PLACE WHENEVER A CAR RUNS OVER THEM.

    I am rejecting this response because: I was not told to begin with that the ground was not solid enough for a single application of "hot-mix asphalt" and that two layers, the first of recycled asphalt, were to be laid down. Neither was any such information and specification given in the contract that I signed. In addition, the job done on both occasions was sloppy and incompetent, as detailed in my original complaint.

    On August 19, 2022, a man from Oregonian Construction, CCB# 233532, showed up unannounced at my 82 year old dad’s farm saying his paving crew had just done a job nearby, had some leftover asphalt and asked if my dad needed any paving done. The man said it would be $40 a yard to do this. My dad agreed to a pothole and sunken areas fill and he assumed it was $40 a “cubic” yard and thought it would be a $400 project. Never did the man stipulate what kind of “yard” would be used. There was no written estimate or written contract at the beginning of the project. The crew was of about 7 guys. Most of the vehicles did not have license plates. One worker was very outgoing to my dad and kept him distracted. When my dad asked twice where they had done work, the crew was evasive. There was a lot of chaos. A small boy of the crew was riding his bike around. My dad was overwhelmed and distracted and unable to stop the process. My brother was working in the orchard far away from the paving project the entire time and was not aware that of what the crew was doing. When he discovered the crew had paved most of the 300 feet driveway and told them to stop, the crew became verbally combative. My brother had to yell multiple times to stop and leave. A worker used a measuring wheel to measure the driveway’s length and said the bill was $14,000. My dad said he could not pay that. The price was dropped to $9000. My dad wrote a check and a worker took it. It was at this time that my dad met the owner, Austin Erstad. When my dad wrote the check, he was given a business receipt and he signed it. It is not a business contract, a business estimate, and was not offered at the start of the process. Austin Erstad told my dad his crew messed up in not clearly communicating. My dad and brother contacted their bank to stop the check. They feel they were scammed because my dad assumed the price was based on cubic yards, not square yards, he had agreed to only pot holes and sunken areas.

    Date of transaction: 03/04/2022 ************ came to our door on the morning of March 4, ************************************************ the area and had some ground up asphalt that they wanted to get rid of and they said that they could give us some for a couple hundred dollars. I said okay, they put down some and then they told me that they had more of the ground up asphalt and asked me if I wanted them to put down more to go the length of the driveway. They said that it would be $1800 to $2000 to finish it. I said okay. They put down more of the asphalt and then presented me with a **** for $9,000. This was totally unexpected and I never agreed to this amount before it was done. I think that their practice was very deceptive and I feel like I was scammed.

    This is ******************************* owner of Oregonian Construction I have received a letter from the bbb from a customer I did work for his information is ********************* address is ***** ************************* ***************************************** I have reached out twice to resolve this issue and also stopped by his place and left a card with my contact info and have yet to hear back from him the job is on contract for an agreed flat price before doing job and the work and materials put down was all stated in the contract that he signed and also signed off that he was satisfied with the work done when he wrote a check out there was a neighbor guy who shares a joint driveway with ************** and he came up to us near the end of the project and said that he thought that my price for ***** driveway was high and told me that he could come in and dump gravel for a lot less money and my answer was to him was of course he could but that is not the work we are doing here we graded the driveway and installed recycled asphalt ******** through a paving machine and compacted the materials when we were finished a lot more than just simply dumping gravel and spreading it his self I am writing this on 3-22-22 and I will try tomorrow to call ************** again in the morning if any other questions please email me at this email
