- Pending Government Action:Government Action: BBB reports on known government actions involving business’ marketplace conduct:PA v. Curtis Total Service
The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On June 16, 2022, the PA Attorney General's Bureau of Consumer Protection (BCP) filed a civil lawsuit against this company alleging numerous violations of the Pennsylvania Consumer Protection law and the PA Home Improvement Contractor Act. More specifically, the BCP alleges that the company, its manager and field supervisor violated the Acts by misleading many consumers into purchasing unnecessary or inappropriate products and services. Consumers were allegedly required to sign incomplete invoices which were later amended, and were told that price breakdowns and expectations, including cancellation rights, were not required under PA law when they are. Further the BCP stated the company used high pressure, scare tactics including implying that consumers health and/or safety was at risk without immediate repairs causing consumers not to seek second opinions. The BCP also alleged the company mislead consumers into believing they were obtaining loans for work through when they were actually being offered a credit card. Other statutory violations alleged include deceptive advertising, failure to complete home improvement contracts in a workmanlike manner, and making false statements to consumers about the financing offered. The BCP is requesting that the court enjoin the company from future violations, pay restitution to consumers, revoke the company's Home Improvement Contractor registration, and pay civil fines and costs of the investigation.
