********************* repaved my driveway and expanded part of it and the newly expanded part has been sinking ever since I started parking in it. He has said hed resolve the issue in multiple occasions but never follows thru. Multiple customers have had the same issue. Due to his inability to repave my driveway I am no longer willing to wait and will be filing suit to get my money back and have another company repave the driveway. I had the entire driveway repaved to avoid a seam so I am not ok with him doing a partial repave of my driveway. Picture file was too big but they have all been submitted to the attorney general and will be available in court.

The owner will treat you like garbage, scream at you. He came and did my driveway and did nothing of what he said he would do. Fast forward 4 weeks: driveway puddles everywhere when it rains. First time I drove on it with a small suv, giant ruts everywhere (as if they didn’t properly prepare the site for the driveway). Once at my house the owner was very rude and argues with every concern you have. “He knows more than you” “he’s been doing this his whole life” “those people don’t know what they are talking about”.I asked him to dig out the driveway and properly prepare the area so it would stop sinking and he argued saying that the proper fix was to simply “top” the existing work. Once fall arrived it took me again about a month to get the owner on site and check out the driveway. Then an additional month to schedule the repair. The crew shows up and hand shoveled about .5-1” of asphalt on top of the driveway Fast forward 4 weeks. The entire driveway is lumpy and chipping. He writes me a new contract to excavate and start over in the summer. Shows up, digs it all out and states he can’t find stone on a Saturday it’ll have to wait until Monday. Pours Sunday. Shows up Monday and says the driveway is dry enough to do the job. I bring to his attention his lack of digging deep enough AGAIN and he insist he knows what he’s doing. Fast forward a month. Huge section of the driveway is sinking/shifting when driven on (same section I pointed out that was “fine”). Continues to get into yelling fits with me. Tells me it’s my property’s fault. I’ve had multiple contractors out and they all confirm it was installation error. He again treats me like garbage because I’m “talking to people about his work”. Offers to saw-cut and patch my driveway (for the 4th time!). I refuse and insist on my money back. He continues to argue and tel at me about how I should have “paid him more” to do a better job.

The owner came out to repair a hole in my driveway. He and a man I understood to be his brother manually patched the hole I called about and some other small spots and blew away stone with a leafblower. During that visit he offered to come back and improve the rest of my driveway with excess asphalts from other jobs. He said that he had to pay fees to dump those excesses and he could save those fees by putting the excesses on my driveway, I agreed to the price of $1,000 and paid him $1,000 on the spot because I was so appreciative of the offer and could not afford to pay the thousands of dollars a brand new driveway would cost and was willing to have it done piece by piece. I had used his company before and when he gave me a card with the $1,000 denoted as a receipt, he said his name was important to him and I could trust him. Again, I had used his company before. When he didn't come, I followed up a few times and was able to connect at least twice, once with him via telephone and once with his wife via email and he reassured me that $1,000 was nothing to him even though it was probably a lot to me but when he continued to not come, I asked for a refund. At that point they became unresponsive.I can understand how it simply could not have worked out but it is simply unfair to just keep the money and be unresponsive. I never wanted to get to the point of a formal complaint and implored them providing text, email and paper communications telling them what I would be forced to look into and giving them one month and then one week notices and even offering a reduced settlement offer. They remained unresponsive.I am not due the entire $1,000. The bucket of asphalt patch and their labor needs to be deducted. I think I am due $750, but I offered and would be happy to at least get back $500 for the asphalt and work.

    Customer response

    Dear *** ********

I tried one last time to reach the principal of this company and I finally did this morning.

He said his position was that he did not give me a timeframe of when he would do the work and he didn't seem to understand that a year or how much longer than that year, or if it worked out ever, was unreasonable.

However, he told me a number of things that were happening in his personal life that could explain why this isn't important enough to him to resolve and for the first time, he seemed willing to continue talking about what could be done to make it right.

So, given that, and in human compassion for what he is going through in his personal life, I would like to do whatever is necessary to remove my complaint.
