Received a letter from commercial acceptance on Feb 21 2023 addressed to my minor son as well as a call on February 22nd for my son who is a minor. The letter was in clear violation of the fdcpa as well as collection was less than a year old placed on credit report with all Three credit bureaus. A letter which is attached was sent certified mail back in February of this year with no response from the company. Only response was to report account in error.

    Business response

    11/19/2023

The letter we had received in February 2023 was a cease communication request, which we have adhered to per consumer's request. We have also updated our system and the credit reporting agencies as we are required to do by federal law.

     Complaint: ********

I am rejecting this response because:
This is in clear violation of the FDCPA as when the letter and call were made where asking for my 4 year old son. The letter also clearly stated that if any adverse information be placed on my credit reports as a result of the notice that appropriate actions will be taken.

    Regards,

    ***************************

    Business response

    11/21/2023

The information was placed in our office under the minor's name but at that point we had no way of knowing the consumer was a minor. Once we found out we updated our system to the parent's information.

I am being harassed by a ***** from Commercial Acceptance Company. Not only is she calling and harassing me, she is contacting family members. I have no idea how she obtained my sister in laws phone number. She did not release any information of why she is calling and when I return the call it only rings and goes to a generic voicemail. I left a voicemail asking to stop calling me and my family members and it still has not stopped. The calls need to end and send verification of debt as requested. I will take further action if it does not stop.

On 8/31/2023 @1422 hrs. and 1452 hrs., ******************** of: Commercial Acceptance Corporation **************************************, Camp Hill, PA attempted contact via phone, reference an alleged ambulance billing debt. I advised **************** that the alleged debt was not mine to pay and that I had attempted repeated past email and phone correspondence with the reporting ambulance company refererence this matter. I advised that I had previously offered to provide this information to CAC, so that they may contact said ambulance company and amend their records accordingly. As an additional measure, I had the erroneous debt scrubbed from my credit reports and advised **************** of this fact and that, "I monitor my reports closely!" Said statement seemed to anger ****************, who viewed the statement as a challenge to my resolve, by threatening to immediately reapply any derogatory marks to my reports. She subsequently stated, "You will be calling us back next month, when your reports get dinged again!", and she hung up the phone on me. Her attitude amounts to what can only be described as a lack of maturity, harassment, as well as an unlawful shakedown for monies not owed by myself or my wife. This is about principal and the fact that CAC presents as a predatory collection agency, seeking a weak mark for a debt which is not legally owed, with no regard to the actual responsible liable party, nor supporting facts! As such, this "business", (CAC), is to have No Further contact with me, nor my wife, nor my Department in any way moving forward! Further, if necessary, I am prepared to immediately retain legal counsel holding ALL liable parties accountable!
