    Date: August, 2021 Amount of money paid to business: $25,092.00 The business committed to provide us with a leak free roof. The nature of the dispute - Background information - We paid up front in full, two months before they started work. We were understanding when they did not have all the materials to complete the job within one week, stretching the renovation project to two weeks (sheet metal and snow birds.) February, 2022 They sent us a bill requesting $400.00. After discussing this with the employee that sold us the contract who no longer works there, she stated this company has been requesting additional money from other customers as well. We did not pay the requested money and the company ended up saying it was their fault and we did not need to pay. The Main Dispute - is our roof is leaking around the chimney due to the flashing being improperly installed. We let the company know, they were not quick to repair it. After multiple calls and voicemails, April 2022, they did attempt to repair the flashing by using low grade silicon around chimney. Silicon should not even be used with a metal roof. Silicone does not last long, and we will be lucky if the silicone holds up 2-3 years before letting water back in. Their repairs did not work and were done poorly. They have scratched up the roof during their repair attempt. There is water and mold damage in our attic and inside our living room due to this leak. Maldonado came to fix the leak but did not satisfactorily fix it. We would like a specialized roofer to fix the leak and have the drywall and mold problem fixed. Maldonado should be responsible to pay for these costs. We have attached photos of the poor repair job, Thank you.

    To Whom This May Concern: 

    Maldonado Construction Company has been in business since 2012. This company specializes in Standing Seam Metal Roofing, the metal is mechanically seamed when installed on the roof making it more durable than any other metal roofing in the industry." 
     
    When *** ********* called for an estimate, she had stated that there was a small leak around the chimney. We would like to make sure that the problem with the leak and damages prior to Maldonado Construction starting work was corrected. We were only responsible for the roof not damages done to the inside from the prior leak. On August 23, 2021, we started the ********* project, and the project was completed on September 16, 2021. *** ********* after job was complete was pleased with the work that was done. *** ********* had requested snow stops on the garage, there were additional snow stops placed on the garage that was not included on the original contract. There was an invoice sent to *** ********* on January 24, 2022, along with a letter stating that the person that sold her the contract was no longer employed with the company. 

    We sent an email asking if she received the invoice on February 2, 2022, and she responded with "I did receive the invoice. Is this for the snow stops that still need put on the back of the garage?", on February 15, 2022, the company respond back to the email "The invoice was for the front of the garage where the entrance is. Carlos (owner of company) stated that there is no need for snow stops at the back of the garage. If you have any questions or concerns, please do not hesitate to contract me.” We heard nothing from *** ********* until April 10, 2022, with an email stating "When we discussed snow stops with Alicia pre-installation, we confirmed with her that we were to have snow stops everywhere there was a rain gutter. There is a rain gutter on the back side of the garage. We spoke with Alicia after receiving your invoice for the snow stops and she insists we do not owe you a payment. The contract she created and sold us, was for the entire house which includes the two-car garage because it is : attached to the house via roof. If you have any questions, please reach out to her as she stated she is the one who sold us the contract. Unfortunately, we discovered our roof is leaking around the chimney. The insulation in the attic is very wet.” On April 11, 2022, the company responded back to the email “I received your email this morning and tried calling you. Unfortunately, Alicia no longer works for the company and this issue should have been addressed with Maldonado Construction Company: (The main office is only 2 minutes from their residence, the office is open Monday thru Friday 8am to 3pm) If you would like to reach out to the business owner himself, his number is ###-###-####. I do have a copy of the contract that states the entire house not the garage. If you have any further questions or concerns, please do not hesitate to contact the office or the business owner." *** ********* didn't reach out to the business owner, nor did she call the office until April 26, 2022, stating "her chimney is still leaking, and they would like this problem resolved. Carlos (the business owner) went to look at the issue on April 26, 2022, he did notice that there was some insulation that was wet, but it wasn't saturated. He also took the contract with him and decided to go ahead and just give them snow bars on the side of the garage, (the company was unable to get snow stops due to the metal shortage, there is a wait list that the company can't even give a time as to when they would be available), *** ********* and her i n boyfriend agreed with that. April 28, 2022, *** *********, and her boyfriend called the office and spoke with Cody the secretary about the chimney leaking, she stated that she would like to come up and measure for the snow bar that way we can get all this taken care for them. Her boyfriend started talking and was very agitated, stating "we don't care about the snow bars we just want the leak that is getting worse fixed." Cody informed them she would have someone there by the end of the day. Cody had two of the workers stop and look to see what was going on. The workers called Carlos (the business owner) about what they had found. There were several holes in the chimney and same kind of holes on the roof panel next to the chimney, (the same drill bit size was used on the chimney and on the roof panel) there were also a lot of scratches on the same panel with the holes. Maldonado Construction does not specialize in masonry work, chimney work or chimney flue work, with this being said someone else would have been hired to work on the chimney and we would like if our company was not slandered for the poor work of another company. Maldonado Construction only flashed the base of the chimney with. 24-gauge metal to match the metal being installed on the roof. They inspected the flashing and counter flashing around the chimney, and it was installed properly. They repaired the holes by using caulking to seal the holes. From the inspection of both Carlos and the crew it has come to the conclusion that the roof had been tampered with after installation and prior to the repair. I have enclosed pictures that: Carlos took on April 26, 2022, and from the crew on April 28, 2022. I have also enclosed a ******** post from *** *********'s boyfriend, (****** ******) and in the post, he had taken off the chimney cap. The pictures from when we first looked at it until we repaired it and from what they posted on ******** was like a totally different roof. We would also request that all post about this project that has Maldonado Construction Company's name in it be removed from the site that they posted it on.
