    We paid for multiple projects with this company dating as far back to February 16th, 2023, starting with invoice #****** through to April 27th with invoice #******. We paid in full a total of $38,603.00 for these projects. AWD Holdings LLC owes us $20,932.00 for not started projects and incomplete work; however, this does not include the cost of fixing his projects. June 12th we cancelled the prefab fireplace project which had not been started and owed us a refund of $5500.00 which he never refunded. June 26th we cancelled all remaining and ongoing projects as he failed to meet several deadlines and failed in communicating with us any type of resolution. AWD Holdings willingly agreed to the cancellation and agreed to refund us. We originally asked for a refund by July 10th of $22,000 to cover the cost of lost plants, fixing the bathroom, the master bedroom, and the phase2 landscaping project. However, AWD Holdings says that is too much and does not have the money. Today, July 10th, I said I was willing to settle for $21,000 and he still said no, and does not have our money. Here is a list of the following unmet contractual obligations: 1. The non-completion of contracted landscaping for both phase 1 and phase 2 projects. 2. Incomplete major bathroom renovation for the main house. 3. The installation of vinyl flooring in the master bedroom did not match the one specified and agreed upon with the homeowner. 4. The unauthorized installation of an incorrect threshold in the master bedroom. 5. Consistently not showing up when scheduled to perform work on remaining projects. 6. Death of the many purchased plants for landscaping projects. 7. Failure to refund full payment of $5500.00 for the not started fireplace prefab creation as requested on 6/12/2023.

    Good morning sir... the reason i've not responded, is because thos is the forst correspondence i've received from your company. Yes, unfortunately *** ******* and myself have severed ties in our business relationship due to not seeing eye to eye on the projects she contracted my company to complete. although we completed several projects for *** ******* & her sister the resides in the same house and I might ad to their complete satisfaction!! I have text messages & post comments backing that statement to be 100% factual. Project scheduling was our biggest obstacle, they " *** ******* & her sister" insisted they wanted the inside work to be completed 1st, and I obliged, against my better judgement & recommendations to complete the exterior landscaping 1st. Weather was our biggest obstacle, and of course as many employers have, staffing issues.. As time progressed we in *** *******s eyes where not completing the projects fast enough although we completed several larger projects within a few months. *** ******* was a very difficult and hard to please client, yet I tried my best. I went above and beyond for *** ******* securing permissions from their HOA and many side jobs they asked me to complete while I was on site with no compensation. as in this case, when individuals do not see eye to eye, and emotions get the best of you " the client" it's best to sever ties and part ways. *** ******* is due a refund, nothing close to what she is stating. I've been advised to communicate directly with her attorney, whom I've not heard from yet, but I will gladly engage in conversation with when I'm contacted. I would like once again to emphasize I have responded to you, the same day I received your correspondence.

    Thank you for providing us with the response from AWD Holdings. It appears that we remember things very differently. We struggled with AWD Holdings to keep to a schedule. We literally begged him for meetings to come up with a schedule and he refused stating that he was in charge of his own schedule. He often never showed and when he did he was late. His excuses for being late were always having to go to the dump for the previous day's work, needing to go to his garage as he forgot to do it or forgot one of his tools, or that he needed to do a store run. Again, all of this can be seen within the text messages. When we asked that he schedule us after all of that had been completed, he still refused or just ignored our pleas. He had at one point offered us Thursdays and Fridays to do our work but we were often rescheduled due to a conflict he had with another client. His actions made it very clear that although we paid him upfront we were not a priority for him. We later learned that we should not have paid him in full and that HICPA, Home Improvement Consumer Protection Act, states he should have only taken a deposit, and given us a contract. Neither of which occurred. AWD Holdings also violated HICPA by not informing us that he hired a subcontractor for our fireplace mantle fabrication. AWD Holdings had told us he was going to do the work himself and was excited to take this project on. Prior to us learning of this we had cancelled that project on June 5th and had asked for a refund of our $5500 to which he agreed to and said he needed time to get the money together as he had spent the money on other things. We had agreed to wait, but weeks passed and he then informed us he had hired this subcontractor and that this person was owed part of the refund for his services. Again, he had not informed us of this alleged subcontractor earlier and now was telling us we would only get a partial refund. June 26th we cancelled all remaining projects due to being unsatisfied with how he had finished the master bedroom, as well as the incomplete and shoddy work he had started with the backyard. He quickly agreed to these cancellations and that he would again need time to refund us our money as he spent all of our money on other things. At this point, he still had not refunded us for the fireplace project. AWD Holdings disagrees with the amount owed which is roughly $22,000.00 regardless of the fact that it adds up to this from his own invoices and our cashed checks. We did not make this number up as it literally is outlined in his own invoices with his own descriptions of the work to be done. He then asked us to discount his expenses but when we requested that he produce receipts for any of his purchases, he outright ignored our requests. AWD Holdings asked us to send him copies of his own invoices as well as copies of our payments but our lawyer's told us to not release that information to him as he should have these records already. Since that time, AWD Holdings has not refunded us any of our money. I would also like it noted that the last time I responded to a text message from AWD Holdings was on August 9, 2023, and that he started responding to us with “Who’s this??”. After informing him that this was *** *******, he then responded with “??” and never responded again.  Whether this was meant to be funny, I don’t know, but it shows a complete lack of professionalism by pretending that he does not know who we are.
