    Business has repeatedly sent me emails even after instructing them to remove me from their email marketing lists. They have said they "archived" my email and refuse to remove me from their system. I still receive emails today after having multiple email conversations with them about DELETING MY EMAIL. They are SERIAL SPAMMERS. Filing FCC complaint to stop this bad business practice.

    We entered into a 24-month marketing contract with Ageras on 06/24/2022, after having spent 1 year (since July 2021) in discussions with their lead sales manager, Paul D******* about the nature of their marketing services. We developed a very good rapport with Paul during that year and thought we had a clear and accurate understanding of what to expect from Ageras. They claimed to be a specialized marketing firm that sends referrals to accounting and tax firms like ours. They require a 24-month contract, which we agreed to in good faith, believing that they would hold up their end of the deal by providing us with qualified referrals, as specified in Section 1. We even signed up for the 1:1 ROI guarantee by choosing to spend $10,500 with them. They promised that we would have an ROI of at least what we paid into the contract. It became very clear very quickly that, once Ageras's "service" started on 07/01/2022, the "leads" they were sending us were not qualified. In fact, out of all the leads they have sent us so far, we have only been able to reach one of them by phone. We send quotes via the Ageras's messaging system no later than a few hours after the requests come in, every time. We also send texts, emails, and phone calls to every lead, as required by the contract, in far less than the required time in the contract. The vast majority of the "leads" Ageras has sent us are not even real leads at all. In fact, one "lead" instructed us to stop contacting them, even though Ageras specifically told us that that lead requested a consult call that day, which we offered. We have tried to resolve this with their management (Mikkel J***** & Stefani M****), and they have threatened legal action. We want to terminate this contract immediately and be refunded all fees paid. We believe that we have been scammed. We have not received any more "leads" since 08/09/2022, which means we have to continue paying for absolutely nothing in return, which is a scam and fraud.

    Hello ****, we are very sorry that you feel that you have had a bad experience with our platform so far. As you mentioned, you had spoken with one of our sales managers for 1 year. Afterwards, you started a contract on 7/1/2022, and then around 8/1/2022 decided that you did not want to work with us. Therefore, at the time you requested to cancel, it had only been 1 month and you were delivered only approximately 4 leads out of a 2 year, 41 lead contract. As you knew when signing the contract, this was an agreement that could not be terminated early, and leads were going to given to you 'as is'. This is why we have agreed not to cancel this contract. In addition, we have held up our end of the contract. In fact, we have sent 12 out of 41 leads that were agreed to so far, already by the end of August. All of these leads you have received, you have quoted on. You are still actively using the Ageras platform, willingly sending quotes to leads. I have attached the signed copy of your contract, where you can review the cancellation terms that you have agreed to.

    I am rejecting this response because:

    Ageras is in fact NOT meeting its obligations because the "leads" that have been sent to us are not "qualified" leads, and almost none of them respond to any of our communication. Ageras is in violation of Section 1 of the contract, quoted in pertinent part below (emphasis mine):

    "You are hiring Ageras to provide qualified referrals based on your selection criteria. By accepting these terms you promise you are authorized to enter into this contract. We will strive to provide the specified number of potential client referrals using our best efforts to ensure these referrals fit your segmentation goals. We at Ageras realize the key to a long and successful relationship with you is based on providing high quality potential clients that match your criteria."

    Ageras asserts that it is providing "qualified referrals" and "high quality potential clients that match your criteria." However, in fact, none of these referrals or potential clients are high quality. Ageras consistently is sending purported leads who neither answer our phone calls, text messages, emails, or Ageras platform messages. Ageras is misrepresenting the truth here. On multiple occasions, staff at Ageras has contacted us after a lead was sent to tell us that the lead wants to schedule a consult call that day. In every case, we had already offered a consult call to those leads even before Ageras communicated that request to us. However, to go the extra mile, we reached out to each of these leads again that same day very promptly, to offer again a same-day consult call. Ageras specifically told us that they had been in contact with these leads who had specifically requested consult calls that day. However, when we reached out to these leads, we receive absolutely no response. It appears that Ageras is lying because how could they be reaching the lead when we cannot? It does not add up, and again, no reasonable person would conclude that these leads are qualified or high quality, as stipulated by the contract in Section 1.

    For all we know, the "leads" that Ageras is sending are names on a list who have not even legitimately requested accounting or tax services at all. No wonder we've been told to stop contacting them!

    To Ageras's point that we continue to quote on the platform: yes, we continue to extend good faith to make every attempt to get our money's worth to salvage whatever is left of this "service". However, despite our prompt quoting and communications to these leads by phone, email, and text--nothing has changed. Nothing has materialized from any of these leads.

    In addition, the above-cited excerpt from the contract states that Ageras is obligated to provide "high quality potential clients that match your criteria." A significant number of leads that Ageras has sent us are for services that we did not select in our contract, such as external audit. Ageras continues to send us leads like this, and we continue to have to tell them that these are not services in our contract. If you look at the attached screenshot from Page 2 of the contract, you will see all the "Industries" (services) that we selected on our contract. You will notice that the boxes for "Internal Audit" and "External Audit" are not checked. Then why is Ageras sending us leads in those service areas? None of those leads are even serviceable by us.

    It is appalling that the only remedy that Ageras is offering is to continue to pay them money for absolutely nothing in return. This is the definition of a scam and fraud, and it is completely unacceptable. Ageras's should terminate this contract immediately and refund all fees.

    Referrals provided in the Ageras system are provided "as is" without any guarantee of any kind. We strive to make sure each referral is well qualified and a genuine potential customer, however, we cannot make any guarantee regarding quality and therefore don't offer any refunds if you are dissatisfied with a particular referral.

    As you can see here, we clearly state that we always do our best to make sure each referral is qualified according to our criteria. However, there is no guarantee, as is stated here. You have agreed to these terms in your contract. Therefore, your emphasis that we have not followed our end of the contract by not providing you qualified leads according to your standards is invalid. This is also reinstated in section 7. For reference:

    Although the language of this contract is simple, the intentions are serious and this contract is a legal document under the exclusive jurisdiction of the state of ************. We don't warranty any of the services or referrals provided by Ageras, everything you may receive from us is provided on an "as is" basis.
