    I am filing a complaint against Eneix Enterprises for failing to adequately complete the work on my porch roof project so that it passes inspection. I entered into contract with the company in February 2024 for them to build a roof on top of my existing front porch. The total cost of the project was $8,500, the final installment of which was paid on August 10, 2024, the same date that the majority of the work was completed. Despite this, the project cannot be closed out due to a missing gutter, which is required for final inspection sign-off.Eneix Enterprises scheduled the gutter installation for November 30, 2024, but did not show up. Despite multiple follow-ups, no firm date has been provided for when the gutter will be installed. This is preventing my project from passing inspection and being officially closed ****** addition, there were issues with the painting and trim work that were either poorly completed or left unfinished. The company was supposed to supply the paint for the porch posts and complete the painting, but they failed to do so. As a result, I had to purchase the paint myself and complete the painting of the posts, which was an extra cost and effort on my part.Communication has been unprofessional, sparse, and inconsistent, with multiple missed deadlines and no follow-through on promised dates. The contractor has repeatedly failed to meet expectations and has not provided a realistic timeline to complete the work to meet inspection requirements.I am requesting immediate completion of the gutter installation and for the work to be finalized in a manner that passes inspection. This simple project has been dragging on for almost a year, due in part to inaction and poor communication on the part of Eneix Enterprises, and I am asking for a clear commitment to complete the remaining work.Thank you for your attention to this matter.

    I am the one who reached out to the customer to let him know that because his property encroaches on city property they are requiring a gutter to finalize the permit. One of three that I had to get to even build his porch. I ate the cost of the two that were not included to appease him. Then I offered a free gutter instead of asking for payment to install. He mentioned poor communication but I have counted 81 emails between us for this project. I will be installing his free gutter when I have time and weather to do so. It is too cold for the sealant used. This complaint is not about a contractual obligation but rather a person who wants to complain for no reason. I am attaching the original contract to show no gutter is on it as well as all three permits spread out over months of due diligence on my end. Thank you. The gutter will be installed when I can. It is not a pressing issue in the winter.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    Initially, please note that I am including copies of the full email record between myself and Eneix Enterprises as well as the Special Warranty Deed that lays out my property line. These documents are provided to offer further clarity regarding the ongoing issues.

    ********************** points out that they were the ones to inform me about the requirement for a gutter due to my property encroaching on city property, but the company, as a licensed contractor in ************, is legally obligated to ensure the work passes inspection. Although its true they informed me that a gutter was required to finalize the permit, failing to install it after the inspection constitutes a violation of their legal obligation. Simply providing me with this information does not absolve them of their responsibility to follow through with the installation. Additionally, the failure to consider that a gutter would be necessary to pass inspection only highlights **********************s lack of foresight, and their failure to install it in a timely manner demonstrates their inability to meet professional and legal standards.

    Regarding the issue of permit costs, ********************** claims they absorbed the cost of two additional permits, but this is misleading. The company failed to inform me about the cost of these permits when they were incurred and then included them in the final payment request without notifying me, which in and of itself is extremely dubious, as a contractor is obligated to discuss any change on a project that impacts the original estimated cost.When I inquired about the overage, I was initially given vague answers, and only after further insistence on clarity was I informed that the cost of the permits was being passed on to me. We then discussed the matter, and I agreed to split the cost. Only later did ********************** decide to absorb it in full, in spite of my explicit and repeated willingness to pay half, as shown in our August 10 exchange, part of the text message record enclosed herein. To now raise this as a counter-complaint is disingenuous and, given the legality and ethics of the situation, self-destructive.

    Moreover, this is the first time Ive been able to review the permits, and it appears they are the result of **********************s failure to properly communicate the boundaries of my property. One of the permitting offices said that the porch encroached on city property, based on a survey from when my wife and I purchased our home, which incorrectly shows our property line ending at our front door. As outlined in the Special Warranty Deed attached herein, my property line actually runs "by the line of ***************"not aboveor behind, not next to or adjacent to, but by, as in following. I communicated this to ********************** on April 4, as shown in the attached email record,and was told shortly after that the permitting office had revised their decision on the encroachment. I initially assumed this meant the office determined there was, in fact, no encroachment, leading me to believe there would be no additional cost. However, it now seems that ********************** either did not forward the Special Warranty Deed to the permitting office or the office was not convinced by it. In either case, I should have been informed, as the additional permits should not have been necessary in the first place. This issue, once again, points to **********************s failure to communicate effectively.

    ********************** claims that the gutter installation is being provided "for free," as if it were a gesture of goodwill, but this characterization misrepresents the actual situation. The company requested the final payment before the inspection was completed, and I agreeda mistake I will not repeat with future contractors. At that time, *****, the representative overseeing the project, advised me that the inspector might require a gutter to pass inspection, in which case they would take care of it. The fact that the gutter was not included in the original scope of work is irrelevant, as the gutter is necessary for the roof to pass inspection, making ********************** legally obligated to install it under the terms of their contractors license in the state of ************. Since ********************** accepted the final payment for the project, the contract is closed, making it illegal and unethical to add any charges after the fact, regardless of the companys failure to account for inspection requirements and fully address them prior to requesting payment. The gutter installation is not a goodwill gesture; it is a necessary step to fulfill the projects contractual and legal obligations. ********************** is legally obligated to complete this work, and their failure to do so on the agreed-upon dates has unnecessarily delayed and prolonged the closure of the project.

    ********************** claims that record of 81 emails demonstrates sufficient communication, but the volume of messages does not equate to effective communication. The emails and text messages attached herein demonstrates that I had to follow up repeatedly due to missed deadlines, vague responses, and unfulfilled commitments. If the communication had been clear and reliable, far fewer emails and messages would have been necessary. Throughout the project, ********************** repeatedly set dates for completionfor painting, inspection, and gutter installationbut failed to meet them without proactively notifying me. I have had to reach out after deadlines had passed with no explanation, and even then,I have received evasive and combative responses.

    Furthermore, ********************** misrepresented completed work, claiming on September 17, as shown in the email record, that painting had been completed when it had not. I had follow up with photos, also shown in the email record, to convince them. ********************** further undermines their own communication claim by acknowledging, on December 8, when Ms. ********************** claimed, I was out of storage on my Gmail and am finding that most of my messages over a two week span were lost somewhere,which is unacceptable for a professional business. The high volume of emails reflects my efforts to seek clarity and accountability, not a sign of strong communication from **********************. Professional communication requires timely,transparent updates and follow-through on commitmentssomething that ********************** repeatedly failed to provide.

    ********************** claims that weather conditions delayed the gutter installation, but this does not explain why they failed to inform me of the issue before, at the time, or even after they missed the scheduled gutter installation on November 30. I only learned of the cancellation after following up on December 8, at which point they cited a snowstorm. After that, they missed another promised date on December 14, again without informing me ahead of time or following up afterward. Rather than taking responsibility for these delays, ********************** dismissed my frustration by insisting that the gutter was being provided "for free," ignoring the fact that the project cannot pass inspection without it. Even when I requested a firm reschedule date, ********************** repeatedly avoided providing one, and now, Ms. ********************** defiantly insists, The gutter will be installed when I can. It is not a pressing issue in the ********* December 28, I was still following up with no confirmed date. A professional contractor should not schedule work unless they can reasonably commit to completing it, and **********************s ongoing failure to install the gutter, coupled with poor communication and lack of accountability, has unnecessarily prolonged the closure of this project.

    Regardless of whether the gutter was explicitly listed in the contract, ensuring that the work complies with necessary permits and passes inspection is a basic legal obligation for any professional contractor in the state of ************. When the requirement for a gutter aroseespecially since it arose after ********************** had already requested and accepted full paymentthe company should have addressed it promptly instead of repeatedly delaying the installation and failing to provide a firm completion date.

    Additionally, it is important to reiterate that, as noted in my original complaint, ********************** has violated the original agreement regarding painting. As shown in the attached Project Details document, the contract specifically states, posts used will be finished to match existing deck as closely as possible. Not only did ********************** fail to supply the paint or do the actual painting, as promised, but they also misrepresented the work as completed when it was not. ********************** now claims they are going "above and beyond" by offering a "free" gutter, but they have failed to follow through on their obligations and to complete work that I have already paid for.

    Finally, ********************** attempts to dismiss my complaint as unreasonable, suggesting that I am "complaining for no reason."However, the email record clearly shows that this characterization is unfair and inaccurate. From the outset, I maintained an unwaveringly cordial,accommodating, understanding, and even friendly tone in the face of repeated delays, missed deadlines, and unfulfilled commitments. It was only in the last 2-3 months, after enduring nearly a year of delays, poor communication, and frustration at every stage of this project, that I began to explicitly express my dissatisfaction. My responses have remained professional, but I was forced to become more direct after being repeatedly ignored or misled.

    In contrast, Ms. **********************'s replies have been consistently reactive,combative, rude, and laden with excuses, rather than focusing on finding solutions or accepting responsibility. Instead of a clear commitment to resolve the issues, I have received responses that deflect blame or downplay the importance of the project. Dismissing my valid concerns does not change the fact that the work remains incomplete due to **********************s repeated failures. If they are unwilling to install the gutter themselves, they should pay another contractor to complete the work they have failed to finish.

    This business owner Kevin is a scammer. Run at your own risk. He is a convicted felon and has basically stolen $15000 from my family and needs to be shut down. He started on our project last year and never showed back up to complete his unfinished and unprofessional work. He has avoided contact with us and wont return our calls nor money. He was paid and given an advance and never completed the project. We have a signed contract dated September 19, 2022 which is almost a year ago and only 40% of the work was completed. This has caused us a financial hardship as we now have to hire someone else to finish the work we paid him for. I don't think he should be allowed to practice in this line of business if he steals innocent customers money. He makes promises that he just don't keep. POTENTIAL CLIENTS PLEASE BEWARE KEVIN IS A FRAUD, DO NOT HIRE HIM

    ****** fails to mention several things here. First, she took several weeks of changing her mind on materials for the project. Next she insisted on ordering real limestone that took over four months, actually it was delivered in MARCH and we were there several days a week. She allowed an ex-employee to steal or scaffolding off of her property and we are issuing a contract cancellation notice through our attorney for theft. We had to call the Churchill Police. She owes us over $13,000 on her contracts and we are the ones taking a loss. ****** has had 3 other contractors walk away as well. I have receipts totaling way over the amount she has paid so far. Thank you.
