The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven.
On November 13, 2020, the Pennsylvania Attorney General’s Bureau of Consumer Protection (BCP) filed a lawsuit against this firm and its owner for allegedly violating the Pennsylvania Unfair Trade Practices, Consumer Protection Law, and Home Improvement Consumer Protection Act (HICPA). Specifically, the suit alleges these parties failed to perform contracted projects as promised; failed to provide refunds to the consumer when appropriate; failed to perform in a workmanlike manner; failed to use contracts that comply with the requirements of HICPA and the Consumer Protection Law; and accepted a prohibited deposit from at least one consumer.
The BCP seeks a permanent injunction against the defendants from engaging in trade and commerce within Pennsylvania and continuing to engage in any deceptive or illegal business practices, revocation of its current HIC registration, civil penalties, full restitution, and costs of the investigation. The trial date has been set for November 20, 2023.
