    On 3/8/24 I purchased pastry from *** in Chester S.C. The following day, after eating the pastry, i became very sick . After observing the pastry, it was visibly contaminated and molded. The following day i returned it to the manager, where he took my statement, contact information and submitted a report on his computer. I was then contacted by the manufacturer. They also took some basic information and said some one would be in touch. I have been patient and its been 8 months now. In that 8 months i've had only 3 conversations with the manufacturer (*********), where he is brushing me off saying they are trying to find a lot number. I don't believe it that difficult to track their own product. The last email i sent was met with **** ******* *******) "I have resigned from CT Bakery. You will have to contact Mr. ******* at *********". This was 9/30/24. I contacted Mr. ******* and he continued to "kick the can down the road". Repeating "trying to find a lot number". Well, as have it, he says he contacted the store (IGA Chester), and now the manager **** *****) whom submitted the report, has also resigned ! This incident cost me a day/night in the emergency room, 2days on a ****, numerous tests and scans and a week of work. I have dates, names times, bills and receipts. Some one needs to take reasonability (IGA or CT Bakery) but no wants to

    The accident was 1.16.24 around 6:30 pm. We were driving on hwy 9 (4 lane) and our van was struck by a buggy from Kj's market out of nowhere. I looked in parking lot and saw an associate standing beside the buggy rack looking down ***********. He watched as I pulled in parking lot and got out to view the damage. My bumper, headlight, turn signal, grill, and hood all had damage from this accident with buggy. I went inside and spoke with store manager. He came outside and apologized along with taking several pictures of damage. He then picked up the buggy that was bent all up from accident. We both went back inside and he took down information. He again apologized and stated that someone would call soon. No one ever called! The following week I received a letter in the mail stating that they had investigated the accident and were not at fault. They recommended filing insurance claim. I noticed that the letter was dated Jan. 18, **** (day after accident). I went down to the store and took letter. I spoke with the store manager again who apologized and admitted that no one had spoken to him about accident. He asked if they had called and I told him no and he again apologized. When I pointed out the date on letter he stated this looks like an auto-generated letter. I told him yes it did to me as well and that is what made me upset even more to have no call or true investigation. He agreed and stated he would reach out to someone. After a few days I contacted the person name on letter about progress on case. She stated she had investigated and they were not at fault. I then asked who did she speak with because she did not speak to the manager on duty (which she admitted) nor to me prior to this call. She stated I called and spoke to front end manager the next day asking if they were emptying buggies regular and they replied yes, so I sent letter. I then asked why did you not ask someone who was there that night? Why did you not ask the manager? She again denied fault.

    We apologize that our guest has been inconvenienced by this incident.The accident was thoroughly investigated. I reviewed video of the parking lot and could see our employees gathering carts as necessary. There were no overflowing cart corrals. There was no storms on that day or extenuating circumstances at store level that would have been a contributing factor. I was able to confirm with the store that they were gathering carts as necessary as well as by viewing the video. The damage pictures show a front end collision with the vehicle traveling on highway 9 indicating that the cart was already in the road and did not strike the vehicle from an unknown direction, but rather struck by the vehicle as the vehicle was traveling. As discussed with ************, this would be a claim to report to his personal auto insurance.

    I am rejecting this response because:
    there is no admission on the part of the company for the damages I have received to my van due to their property. Also no attempt at all of a settlement to pay the cost or even help with the cost that resulted due to no fault of myself. The buggy was not sitting in highway and then struck by vehicle out of negligence on my part as they stated in response (Evidence please).That is a lie!! The location and force of damage is too great to have been an idle cart in the road. I have 4 eye witnesses that were in van who can state otherwise. Instead It rolled out into highway and struck my vehicle due to bagger not properly keeping control as he was clearing lot and not using bungee cord or safety device to keep buggies together.
