    I signed a contract with **** of SHS Construction in March 2024 to erect a standing roof kit I purchased. At that time, **** stated it would be about 2 weeks before he could start. **** agreed to accept an almost new generator as a $2000 dollar deposit. Each month I would check with **** for an update, always having an excuse of why it wasn't completed. His crew did attempt to install the post, but seemed to be out of their expertise ********* were not square). I contacted **** on October 17 asking for an update, with no response. I then hired another company to install the standing roof kit on Oct. 22, and notified **** requesting he return the key to my gate and $2000 for the generator. Again with no response. I am attempting this for resolution before ****** claims court.

    We take full responsibility for this situation. At the time of the contact signing we had our crew and a sub contracted crew ready to install the building. We did install a small drive, minimum rough grade on the pad, and installed the post (pre setting). The squaring of the post was to come as we installed the roof. We also rented a lift from Herc rental for the install. We had all intentions of completing. 
    Our issues were that it started raining enough to not be able to get back out. Our subs backed out and we had internal employee and hiring issues as well. This put the job on the back burner and it got delayed. 
    We will reach out to the owner to return the generator. It was only used for approximately 8-10 hrs. We will also reach out to the owner to see if this is will close this complaint or if more is desired

    I am rejecting this response because: I do not have a need for the generator at this time.  I do not have anywhere for it to be returned to.

    In response to the rejection I offer to store the generator until you return, or you have a place to store it safely. We will 1) store it in a locked building 2) record the hours when stored to show we have not used it since stored, 3) put the product 'Sea Foam' in the fuel as a fuel stabilizer (this is done when storing an engine over a longer period) 4) Deliver the generator back to the job site when needed, or to an agreed address within 30 minutes of our address. We will takes photos of the building it is stored in, when installing the fuel stabilizer, and of the hours of the generator. We will submit these to the BBB

    I am rejecting this response because I have had to pay someone else to do this job.  I need the money to cover the expense of hiring another contractor to complete the job.

    I respectfully disagree on any money being exchanged between us to alleviate this. We agreed on the generator as a down payment for the job. We were not able to complete the job as signed so the only reasonable response would be to return the generator, and it would be even.

    We spent over $2,200.oo on payroll and renting of the lift from Herc rentals. Remember that it rained off and on for a long time to where we could not do ANY work. The hold on the rental was out so it was to be charged daily after that. We also installed the culvert, spread stone and rough leveled the pad outside of the contract, for NO CHARGE. 

    Again I will return the generator, or store it for you until you have a place or are back in town
