Hardy Contracting was hired to resolve an erosion and run off problem in my yard. While their work did not resolve the problem, they also did not perform the job as written (barrier landscape was not installed under the river rock, they did not finish the job as fence posts were not concreted back in, one panel of fence was put on backwards, and another post and cap was run over by their equipment, broken and never replaced or even reported to me…I discovered it later when trying to walk along the fence and discovered it was all wobbly and broken). The job was started the end of October 2023. The owner/contractor, Barrett H****, does not respond to texts or call me back. On October 30th I was told Milton was going to concrete the post in. On October 31, I discovered the additional broken post. On November 30 I sent an additional text to follow up, he responded he was coming over to measure the post. On January 28th I’m still waiting…I was giving him a break because weather was bad but now I’m getting tired of this not being fixed. I saw he was over at the neighbors and I called over there and relayed a message for him to call me. He didn't like that at all. On Jan 31st, still no call so I sent a text again. I was responded to that I was surly, he didn't appreciate my attitude, my fence hadn’t fallen over, I was nit picky and he’d let me know when he’d come to fix it. I followed up March 7 with a text, March 8th with clarification that I was looking for a completion date, and again today April 5th. No response. If he doesn’t want to finish the job, and do it as promised, he should refund my money less the cost of plants/materials. I have been aggravated by this for 6 months. Frankly, now I am fearful of him as well because he doesn't seem to have the maturity one would expect. Who tells their customer you get more flies with honey than vinegar? I’m the customer, he’s the one not doing his job. He needs to come and put the landscape fabric under the river rock and around the drain, finish the trench at the fence line so the water doesn’t just run to the lower level, replace the damaged post and cap, and concrete the posts in.

    To whom it may concern,

I would like to respond to the complaint described below. First off just for clarification this is a neighbor that I was recommended to by other neighbors that I have worked for with no problems or complaints. I have worked at 20-25 houses in my community with no problems or complaints until now.

From the very first time I stepped foot on her property this disgruntled widow has been nothing but problems. Partly because I did not respond to her sexual advances towards me. She also made comments to my employees and myself such as " Who is the real boss here? " After I discussed her job with my employees, It was completely rude and uncalled for. Something that I did not take kindly too and I knew there would be no more future work with this person. Other than the rude comments to my staff and sexual advances and questioning about my personal life,  *** **** frequently tried to get extra work done for free with no additional charge. Cutting down trees that were not quoted, installation of plants that were not quoted, weeding flower bed areas etc.

I originally quoted *** **** a retaining wall that would have completely solved her water drainage issues but that was out of her budget. So we went with a more cost-friendly option in hopes to redirect her water. I have attached photos of work that was completed and a photo of the hairline crack in her fence post that is such a huge dilemma for her. All the work that was completed on her job site was done professionally and in a timely manner. I ensure that her property looks better now than before I started.

*** **** would not let me access the backyard through her 8 foot gate on the opposite side of the property and travel through overgrown natural areas to access the work site. Therefore, we were forced to remove a section of the fence and try to squeeze through it overall contacting the fence and starting this entire issue. If courtesy and pleasant sensible communication would have been used this issue would have already been resolved.

To make this headache go away I am willing to replace her fence post and set it in concrete per her request. I will do this  with a sheriff's deputy and or witness on site. I do not care to be harrassed by this woman any more.

I will not refund any money towards this job and I am not offering any rework other than fence post for this nightmare of a customer because I have completed everything we agreed on initially and then some.

    Better Business Bureau,

I have reviewed the response made by the Hardy Contracting in reference to complaint ID ********, and agree that he should come and finish his work concreting in one post and replacing the damaged fence post.

It might be a good idea to have a representative from the Sheriff’s office here as his suggestion of me making sexual advances is untrue and unwarranted and after being treated so unfairly I am not comfortable with him on my property. If there is a charge for this service, I would expect it would be at his expense.

I would like the job completed in the next 10 days if possible as I have struggled with this issue since last October.

    Regards,

    **** ****

One post was put in backwards and never concreted in.  This needs to be reversed and reset.

A second post was discovered as broken while waiting for them to come back to cement the first.   This post and cap needs to be replaced and concreted in.  He already measured for the post and told me he had it months ago.

I would like a confirmation of when this will work will be done and I would like it completed in the next ten days.

If he wants the sheriff there, he should pay for it.  The Sheriff can also he an independent 3rd party to witness the work was never completed.

If this can’t be done I would suggest he contact the fence installer ******** and arrange for them to repair and reset the fence at his expense.

I would like a response of when they will do the work because I have been told numerous times they would be coming back.   I’m tired of waiting.

    Respectfully
    **** ****  *** ********
