We hired Ryerson on January 2024, they walked away of our project on November 18th crediting us the remaining amount of $4,637.88 to finish what they left as an accomplished. Noting that what is left to be done is way more than the credited amount of $4,637.88. They were intentionally delaying our project and they refused to finish the project after being paid and we as homeowner respected the contract terms while the contractor didnt respect neither adhere to the terms of the contract. Their intentionally delays affected negatively our quality of life.Business response

Mr and Mrs ****** Unfortunately, you have not represented our parting in a wholly truthful light. We completed your project through the Final Inspection with ***********, completing all contracted work required by the recognized ** Building Code, the ** State requirements, and the York County Building Department for your residential addition. A Certificate of Occupancy was issued for your completed addition. The only items left outstanding were the completion of your gutters (reason noted in email 11/18/24) and interior "punch items" (installing shelving in 2 closets, installing accessories in the bathroom, and any other misc paint touch **** I have attached copies of our last few e-mails for your records and for those that care to review them. We treated you with integrity and fairness and finished our work. Additionally, we have issued you a WARRANTY for the addition we completed. Our company in no way has walked away from your project. We stand behind it. Lastly, we did not intentionally delay your project- we pushed to the end to the best of our abilities. As you know, but others do not, the superintendent who was running your project tragically was killed on 28 June 2024 in an accident outside of work. That admittedly delayed the project for a few weeks as we mourned his loss and pivoted to recover and assign another lead on your project. You were assigned ****** ********, our Production Manager, who ran the project to the end in November. We pressed on despite our challenges in order to deliver to you a beautiful, finished product.
I welcome anyone to call me on my personal cell phone to discuss this project in greater depth. ************. We are not the company that you have accused us of being.

I am rejecting this response because:
Ryerson Brothers Construction didn't adhere to the contract terms by refusing to perform contractual obligations that are listed in the bullets below:
Mid-October Mr. *** Ryerson sent us an email stating: "if we don't accept their credit toward replacing the sink window, they will stop the project AS IS and stop the permit allowing us to finish the project and crediting us for a remaining balance". We came to a resolution, we accepted their credit and took the responsibility of replacing the window later on. (check attached email screenshot). Noting that the window agreement (***) was signed back in June and as per Ryerson Brothers Construction the window takes 5 to 6 weeks for delivery. The window was delivered on October 7th.
I would like to mention that the window Estimate delivery is 2 weeks as per century lumber communication for estimated delivery time and history fulfillment of a window order that I placed (email can be provided upon request).
The project has been delayed a few months and not only a few weeks, initially it was supposed to be delivered at the end of July. Ryerson Brothers Construction didn't provide us with correct drawings as the drawings that we have had wrong measurements and different upstairs layout.
Gutters installation that was not completed by ******** per agreement. I got 3 estimates and all companies affirm the ability to install gutters without going into our Neighbour's property (communication from *************** is attached).
Garage door opener is not installed as per the previously provided picture; it is still dangling from the ceiling. Every time I have followed up with ******, she was telling me that the garage door company is the one who takes care of it and as per the attached email Ryerson Brothers Construction advised us to contact the garage door company. I contacted the garage door company and their response was it is an electrician's task to fish the wire in the ceiling and in the walls, not them. Ryerson Brothers contractor installed the sheetrock without fishing the garage door wire in the ceiling and in the wall.
Also as per Ryerson's email concerning the shower faucet being defective, it voided the shower warranty and Ryerson refused to replace it despite our will to buy another shower set and pay them extra labor charges to replace it.
I had a plumber evaluate the faucet condition to find out that the faucet wasn't installed properly. It took him a minute to latch it properly. I would like to mention that as per Ryerson Brothers Construction installed a temporary tub filler to pass the inspection that doesn't divert the water to shower head, the tub filler works only.The materials provided for the window installation were not enough. I had to buy more materials (receipt could be provided).
Crawl space left in a very bad condition (pictures already provided)
Failed to do the post cleaning, nor yard maintenance to be back to the condition prior to the addition project and Pavers still stacked in the backyard.In addition they failed to execute the "Punch list" that includes replacing or fixing the thing that they damaged during the construction.
These are a few items that I mentioned here that were not completed by ******** and were placed on my back to struggle with different contractors for their completion. I attempted many times to communicate with them peacefully to ensure that the project is completed per agreement to the final stages but found obstacles every time. Either they did not order the materials timely or short in labor and management coordination of individuals who did not carry on from the previous worker. One person starts with something correctly and then another person comes in with different instructions and directions for installations that are different from what was agreed upon. All these caused us delay in the timely completion of the project and forced us to take other costly measures for residency. The house is still an open project with materials and a construction site that prevents us from residing in it, especially that my children have asthma and breathing difficulty. We are very disappointed, upset and frustrated from such treatment and incompetent service from this company. I hope that our bad experience and treatment from this company stand as an example about the fraudulent activities and the work around to pass inspection and failure to adhere to the contract obligation.In summary, the list below are items we need completed:
- Nonfunctional garage door (door opener and sensors not installed)
- The bathroom faucet as mentioned in my previous email its not defected but not well installed, we took care of that, so Ryerson warranty on plumbing works shouldnt be voided.
- Replace interior garage hinges as ****** ordered a door with chrome hinges instead of black ones
- Not installing shelves in the bedroom closet
- Not installing bathroom accessories
- Not installing door stoppers
- Not installing gutters (other alternative to ladders are available to complete installation safely and securely)
- Punch list
- Post construction cleaning (debris in crawlspace, cleaning construction site inside and outside)
- Brining the yard to the condition prior to the work
- Replacing mailbox and secure the post
- Replacing the broken concrete waterspout tray etc...
Kindly check attached the latest invoice received from Ryerson showing the credit AWA5 is the one that we agreed on so Ryerson would come back and continue the project. Then Ryerson again decided to stop and crediting us the remaining balance $4637.88 AWA6 that we didn't approve or agreed on.Business response

I am rejecting this response because:Ryerson Brothers construction is in repudiation of the contract for more than 74 days.
The fact is that the two windows are 6 ft apart not 15 ft apart as claiming in your last email 12/30/2024. Attached windows picture showing the difference of size between the one that was installed by Ryerson Brothers Construction and the sink window. The window had to match with the sink window size.
As per your email dated October 24th to reorder the window you need to remove the sink window trim for exact measurements. So, the breakfast window wrong size was due to not accurate way of window measurements!!!
An acceptance of window credit and master bathroom wall and door credit was emailed to you (check attached screenshot email dated October 24th and your email dated October 29th affirming receiving my acceptance for the credit that you documented in the ***6 and in the final invoice determining the remaining credit amount and now you are backing out as you backed out previously of your contractual obligations).
Attached another ***1 showing email approval method noted as signature.
It has been since mid of October we as homeowner trying to find a resolution for this situation and Ryerson Brothers Construction refusing to finish what they agreed on in the attached signed contract.
We paid Ryerson Brothers Construction to accomplish the addition project but Ryerson Brothers Construction selected to walk away without our acceptance leaving behind the following unfinished Contractual obligations. in addition to the cost of accomplishing the job we paid Ryerson Brothers Construction OHP (overhead and profit) fees for every single task in the contract and every additional ***.

Not to forget to mention that we as homeowner purchased the hardware ( interior door knobs, main back door lock and garage interior door lock, hardware for interior staircase handrail) that we didn't get reimbursed for as this supposedly to be under hardware allowance included in the contract.
In conclusion, it seems that Ryerson Brothers Construction are not honoring the *** that was mutually agreed upon and your credit arrangement that you initiated. It is a fact that you keep changing your mind in every step you can to justify your completion failure of the project. Perfect example of disrespecting yourself and changing your mind is the credit that you offered to me for the window and for master bathroom door and wall. I approved to take credit and acknowledged that by emails sent to you. However, you are changing the credit reimbursement to justify other wrong doing that fits your new story!
