    On 4/25/22, we signed a Landscaping Contract (attached) with 360 Landscaping. A $3000 check was given to ******* ******* (company rep). A truck load of river rock was delivered on 4/26 and put in our side yard and on our neighbors yard at **** ********** without their consent. 360 Landscaping crew started working on 4/27. Their crew placed 2 large particle boards across our neighbors yard (**** ********** ****) for their tractor to move the rock (without consent again) to the backyard rock beds. Landscaping fabric was provided, but not used in all hardscape beds. On 4/28 ******* ******* sent a text asking if we want to add a walkway on the side yard to utilize the extra rocks. We consented to this and provided the pavers, the walkway frame and the landscaping fabric which ******* * installed. On 4/29, $1000 check was written to ******* for 360 Landscaping. Several texts were exchanged between ******* & ******** ******** and ******* ******* (attached) about poor quality of work and requesting them to remedy. On 5/4, 4 pallets of sod was delivered to our side yard. Sod was installed in our backyard without topsoil or grading. There were hills/mounds and the quality was poor. On 5/6, a pallet of sod was taken from our home by 360 Landscaping crew and used at another home they were working on without our consent (**** ********** ****) . On 5/7, 360 Landscaping crew returned to fix the backyard sod by adding topsoil and "grading" the area with a rake. ******* ******* sent a text stating the job was complete and asked for a credit card number over the phone. We declined to give her a credit card number until we inspected the final work. We arrived home to find a huge pile of rock remaining and the job incomplete. We sent an email with the outstanding items that needed to be completed for us to release the final payment (as outlined in the contract). We continue to receive invoices and have not heard from anyone at 360 Landscaping about remedying the issues.

    Per signing with this customer drip line was suppose to be installed, rocks, sod, plants, Everything that was suppose to be installed has been installed they even wanted to make changes by bringing out a walkway from back yard to use up rocks that they over ordered myself and employees help them with that as well. in picture they ordered rock and they said leave there rock because they wanted to use rocks in other part of beds at house. I told them you all ordered rocks his wife Mrs. ********* was there upon rock arrival and told driver where she wanted rock to be drop at. My job was not to clean up rock I stated to Mr. ********* if we clean up rock there will be a fee for helping clean up rock. Everything per contract have been done.

    I am rejecting this response because:

    1. Landscape rock: the quantity was decided by 360 Landscaping. 360 Landscaping ordered and paid for the rock. In our opinion, the rock was not distributed properly throughout our beds. Irrigation lines are still visible as well as fabric in some areas. Her workers showed up some days after 5 pm and were too tired to continue working. Per their contract under Responsibilities, it states 360 Landscaping agrees to remove all materials and perform all tasks for the addressed listed above. The workers were instructed where to put the rock, they just refused to do so. 

    2. The walkway was suggested by 360 Landscaping (******* *******) on April 28th "to utilize the extra rocks".  ******* or ******** ******** DID NOT specify the amount of rock to be delivered. ******* or ******** ******** DID NOT consent to moving the rocks independently. 360 Landscaping crew was told where to place the rocks. They refused. Sod around the walkway was not completed and left bare. 

    3. 4 pallets of sod were promised and delivered to **** ********** ****. 1 pallet of sod was removed (taken without our consent) to another property 360 Landscaping is in litigation with. This money for the pallet was NOT refunded. Now we have to pay another company to move the rock and to fill in the areas with sod that 360 Landscaping did not complete as outlined in the contract. 

    4. Drip line was completed only on one side of the beds, not on both sides. ******* claims she was not responsible for this, but she installed the plants on the bed and where the drip line was to be tied into. ******* refused to do this as well. 

    5. The quality of work did not meet industry or our standards. 

    6. 360 Landscaping caused damage to **** ********** ****'s front yard by placing wood planks over the grass and leaving the rock on their property.

    When rock was delivered Mrs. ********* instructed truck where to put rocks at she put rocks on neighbor property that was her fault.  Stated that rocks could be move at an additional cost it was a money issue from the beginning of this job when I ask for a draw, money draw was shorted stated that he gets paid on Friday. When Friday came I still got shorted and wasn't provided the amount that I asked for. Drip line wasn't discuss for other side because, customer said sprinkler system was on that side. Everything per contract has been installed for customer
