I got an Online loan for $600 and they are charging my $2500 in Interest and Finace chargers over 9 months. This is Indian company and they should be put out of business.Business response

Due to ongoing identity issues related to recent data breach issues from Team Moble in 2021 and 2023, then a notification from the Department Of Justice on April 8, 2024 of another data breach from a company named “ ********* ******** * ********** and recently a notification from ************ via US mail of a data breach of my personal information was compromised/ exposed to 3rd party unauthorized actors that happened twice, once on April 2, 2024 and again in May 18, 2024. FTC identity theft report was filed and reports to the Department of consumer affairs was or has been filed numerous times as to inaccurate credit reporting. Some of these included collection agencies such as LVNV and the Burease Financial appearing on my credit report. After disputes with all three credit reporting agencies, both LVNV and the Bureau’s Financial collections were removed from my credit report. Due to ongoing issues and as a result of their investigation outcome. I ask for a credit report from experian that arrived today in an electronic email. While viewing my report, I noticed an entity, named “ Clarity/CreditFresh, Clarity/RVRVLY-SWARD-CRDS and or Clarity/CCBank-OPPLOANS appearing on my experian credit report under soft inquiries all done by the above named entity on the same day, 06/01/2024 or 5 , five times in one day. I do not know why this entity is running a soft inquiry of my personal credit report, I have never did business with this entity or applied for credit or loans from such company or entity. I’ve already opt out of advising from all three credit reporting agencies and also have active military alerts on all three credit reporting agency’s as further protection. As a now retired law enforcement official both state and federal levels, my identity and per information paramount to not only my safety but my family as well. I did not authorized this entity to run my credit report either officially or for advertising purposes.Business response

Level Up Funding is a sovereign enterprise, an economic development arm and instrumentality of, and wholly-owned and controlled by, the Crow Creek Sioux Tribe, a federally-recognized sovereign American Indian Tribe (the “Tribe”). The consumer’s loan was made by us pursuant to Level Up Funding lending license and as provided by the Nation’s Tribal Credit Transaction Code. LUF, contracts, including the executed loan agreement, clearly designate LUF’s tribal law as governing its transactions and provides all disclosures required by Level Up Funding and U.S federal law
After thoroughly reviewing the complaint submitted by *** **********, we have determined that the concerns raised are not related to Level Up Funding. The entities mentioned in the complaint have no connection or affiliation with our company. As these matters fall outside our scope and are unrelated to our operations, we regret to inform you that we are unable to address or respond to *** **********’s concerns.
We strongly recommend that *** ********** direct his complaint to the appropriate entity to seek the resolution he desires.

I am rejecting this response because:
1st, this business/ entity has respond as to more of a defense/ arguable law as to being, somehow covered by “Sovereign Immunity, weather using words as enterprises or economic development arm to way a defense or use language that , somehow covers their illegal practices. This will not hold up in federal court as sovereignty issues or not argumentative issues as in international law. The Supreme Court has already passed certain constitutional protections against these kinds of businesses who use such language to get around privacy concerns, which I will now invoke and file a more aggressive complaint. Together, the Department of Defense, the Federal Trade Commission along with this state attorney general’s office will forward this response to the appropriate oversight committee chairman of congressional review. Although a lengthy process, I’m confident this company and its agents will be 100% accountable for this, “Intrusion “ of my personal information and soft pull of my credit report. A confidential, secure and protected account, this company/ entity will have to show where they claim so called sovereignty issues overseas the federal and international courts of our institution. Thank you to the BBB for your support and forwarding me this response from this company. It’s exactly what we need and this will be extremely useful in discovery subpoenas to not only this company, but any and all correspondence, including but not limited to electronic records and communications in their business. I will file the appropriate legal documents to bring further transparency in the near future, moving forward.Sincerely,
