I bought a van from Mr. *********************** My friend and I are disabled on social security. I gave $800 in cash and ***** as a request if I bought it would change the as part of my payment. He asked to leave it and pick it up at 4pm We return at 4 . Mr ******************** said it was good to go. He added that he replaced a brake line. He never me or my companion that it need more work . I feel like he is legally responsible to inform me if he thought it was unsafe. He never expressed concern and he was supposed to tell me the brakes wore bad. He could have told me that the pad wore metal on metal and it's in need of new ones. Nothing of a sort. He He then had me an as is agreement before we left. Thinking the van was ok to go to **********. We I hit another car because weather conditions were bad and the brakes failed. Luckily no one was hurt. I took it back to Mr. ********************** as he instructed me to do if I had anymore problems. I agreed to pay for parts and some for labor. He kept it for two months when he finally got it finished. His sister and my old friend I work with at WH told me the ***************** was$1048. Asked if I wanted to put new pads. This was strange thing to ask when the job was to put brakes on a vehicle. I said yes. Now he wants another $1,300 to get the van back. He said I signed the as is agreement. He knew it needed repair and as a professional self employed men should have told us it was dangerous. My dad, a 50 years experienced mechanic who also worked for the county. He told me it was the oldest trick in the book. I called the police and reported it as a scam. He. Calls Clarksville housing and asked what was going on with me in *********. That is my personal business and he had no right to make that call during a business conflict. Unlawful too. Cops says it's a civil matter. He works on cars for the sheriff's department and they gave him emunity. Who do I turn to when the laws are being ignored by the police themselves? He had no right to get involved in my personal

    Business response

On April ******* ***************************** purchased a 2004 Chevrolet Express Van from me.  On that day myself, ******** and her friend took at test drive of the vehicle.  I explained I felt the brakes were not exactly right so I returned to the shop and replaced the brake line that day on the vehicle.  She was satisfied with the vehicle and agreed to purchase it "As-Is" and explained she was going to live in the van.  I have attached the signed agreement / no warranty document with her signature.

On May 15, 2024 ******** returned with the van and said the brakes were bad and her  and her sister replaced the brake master cylinder but there was still issues with the vehicle.  I diagnosed what  was performed on the vehicle and found the Brake Caliper, Master cylinder and brake line needed replaced with an estimate of ******* plus tax.  ******** explained she was waiting on her SS check and she would let us know when she had the money to repair.  We completed the repairs on June 3rd & 4th and informed her then that the brake pads were in need of replacement also. This was not able to be seen until we had the brakes taken off the vehicle. Prior to her return in July, ******** was seen on my security camera attempting to take the van with out paying.  At that time she hit the fence at my shop and realized she would not be able to leave with the van. She came to the shop and was conducting herself in a manner that I decided to call the local law enforcement to have her removed.  She was using language and acting out of control with other customers at my shop.   On July 8, 2024 ******** returned to pick up her vehicle.   All information was disclosed to her about the condition of brake pads and repairs done on her vehicle.  She told my office manager to replace the brake pads.  ********* manager gave her a ride home and we continued to repair the vehicle.

In late June ******** started leaving harassing messages ( 5 in one day) on our answering machine; which we have saved for reference .  I wont repeat them but they are vulgar, disrespectful and very rude.   I am a small business owner, I don't have time or the desire to con anyone, especially someone buying an "AS-IS" vehicle.  We have tried to work with ******** but feel this situation has been exhausted.  I decline any refunds to her.  She was aware of the agreement and signed it showing her understanding.  I am empathetic to the situation but feel I have done all I can to resolve this situation.
