I called Duncan Motors on February 13th, spoke with the manager, asking about the 2011 Infiniti. When I called he informed me there was another gentleman prior to me interested and had paid $500 down but was having a hard time getting finance so he had given him until 5 oclock that day to get the vehicle. The manager said either way he would call to inform me, which he did around 5pm and said the other person didnt qualify and told me to go on the website and complete the application because I was next in line for that vehicle. I completed the application immediately and was approved. The manager called me the next morning to inform me that he had sold the vehicle at an auction at 11pm. I asked him why did he have me to fill out an application, pull my credit, and informed me I was the next in line for the vehicle? He said he did not know the vehicle was going to be sold that night at an auction. I later went to his office to discuss about the credit pull face to face which he stated he was going to speak with his rep to see what he could do to have the hard credit inquiry removed from my credit report and I have yet heard anything. While on my way to his office I seen the vehicle on a tow truck leaving Hendersonville heading toward Gallatin.

I am rejecting this response because: I most definitely was contacted by the manager and advised to complete an application online. Also, the next morning during the same conversation when I was told the vehicle had been sold, I was told verbatim I had been approved and at that time the manager had suggested other vehicles they had available which I declined because I was only interested in the vehicle I had inquired about. I do have phone records to show that the dealership had contacted me. My pressing issue is the hard inquiry on my credit report (which I was told by the manager it would only be a soft inquiry) doesn't seem equitable to have on my credit as the vehicle was sold overnight before I even had an opportunity to purchase. When I had this conversation with the manager of the dealership, they stated they would speak to their rep and call back however I have yet to receive a call or update as it is still showing on my credit report. No one is trying to hurt their business as this would not benefit either me or them, I just want the inquiry from my credit report removed.

    Sincerely,
