I was stopped at a red light trying to turn right when one of their employees came around near my vehicle with the lawn mower and a rock flew out and hit my vehicle. I tried to resolve this between me and the owner but he was unwilling to provide insurance information. The workers at the gas station where the incident occurred saw that the mower guard wasn't down. They are not taking responsibility and I want the damage to my vehicle repaired. I hope they are actually an insured business.

            Business response

            11/22/2022

Business Response /* (1000, 5, 2022/10/27) */ On the day mentioned, our mowing crew was mowing at one of our commercial properties. Unfortunately, it is a common occurrence for people to claim that body damage to their car or property was caused by a mowing crew in hopes to receive money for pre-existing damage to their property/vehicle. Therefore, we do not take any accusation lightly and immediately thoroughly investigate the complaint. Once the complaint was received I immediately questioned all the employees on the site to ask if the mowing guard was down, if there was a loud noise, and if there was any chance it was damage caused by us. I saw photos of the car damage and it did not look like anything a rock would be able to do. It was a long and deep scratch in the side of the car that would be better explained by having a car run up against something, not something thrown into the car. I also asked the crew to come back to the shop so we could inspect the blades to see if they were chipped at all because it would take a good sized and heavy object to inflict the damage that was shown. The mower blades were pristine and did not have a mark on them. Finally, we reviewed the gas station cameras and could not see any evidence whatsoever of the mower throwing an object into the car. In the case that we ever damage property, I am adamant to repair or replace whatever is necessary and have multiple cases where we have and this is not one of them. Consumer Response /* (3000, 7, 2022/10/27) */ (The consumer indicated he/she DID NOT accept the response from the business.) The workers at the gas station saw that the guards were not down on multiple occasions and there's no way the cameras could have seen anything because it was too far away from the building. I had my son in the car and had to stop with a 9 month old and get out and talk to several people to get any information. My car hasn't been in any accidents except the one that was caused by your mower. And if you can see anything on that camera you could see the before and after of my car. I would love to know how a man that was on the mower and the guy weed eating could actually hear anything smack my car. I'm a very honest person and wouldn't try to cheat anyone out of something but that is obviously not how you run a business. Business Response /* (4000, 9, 2022/10/28) */ I am truly sorry that you had to get out of the car with a nine month old and have had this happen. If you've ever been on a mower and hit something large enough to cause that damage, then you would know that it is a loud noise when you hit rocks or metal. You even hear noises when you hit sticks but you definitely hear and feel when you hit something large enough to damage anything. Not only that, it will nick the blade of a mower. The mower blades were sharp and smooth at the end of the day. We do not take claims lightly and always reimburse or repair damages caused to any personal property but I also don't pull my checkbook out or file insurance claims every time someone claims we did something. I can only go by evidence and the word of my employees. I know you say this isn't how you should run a business, but I am unsure of how you believe we should operate. Reviewing evidence is the first step in any of this and I just don't see how the mark on your car would have even been caused by a thrown object from a mower or weedeater. Furthermore, you were at a red light so I don't know how multiple gas station employees were watching to see that a mower guard was up, especially on multiple occasions during the duration of a red light. We tried calling yesterday to figure out a resolution to all of this but didn't receive a response. If you want to file an insurance claim, I don't think you will be successful in your claim but we can go that route. Homeworkx has always carried $1M liability insurance since the day we started so having insurance is not the issue. If you want, we can write a check but I am not sure how much you are wanting but I would like to resolve this instead of going back and forth. If you are adamant that it was us at fault, I would like to figure out a middle ground to resolving this case. I will await your response.
