We contracted with Coyote on February 29, 2024 upon the recommendation of a neighbor. Soon after we signed that contract, our neighbor told us we should choose someone else as they were having many problems with the company. Unfortunately, breaking the contract would cause us to lose over $20k. We expressed our concerns to Coyote Creek and they told our pool would be swim ready by early May. They had replaced a project manager who was the problem on the neighbor's project. Our pool was "swimable" until the end of August and the job remains incomplete to this day.Coyote Creek missed dates, were constantly late in providing services, and frequently changed project managers. They wanted us to communicate through their app, Builder Trend, which we did. Unfortunately, they weren't responsive in the app or by emails or phone calls. This job was started in March and we still haven't had a final inspection. In addition, the pool was set too low and now we have muddy water on our deck/pool whenever it rains hard.I have tried calling many times and they do not return phone calls, nor will they give a name/number of anyone I can call. I've tried emailing every member of their organization but emails aren't returned. I am at a loss as to how to get the work I paid over $100k for finished.Business response

We appreciate the opportunity to address this matter.
In mid-October, we were notified of a pump issue. Upon inspection, the issue was found to be a tripped breaker. We promptly resolved this and ensured that the pump was operating correctly before leaving the site. Since then, we have not received any further communication from the customer regarding additional concerns or warranty items.
If there are outstanding warranty items, we encourage the customer to email them to *********************************************************** so that they can be properly logged into our system, scheduled, and resolved in a timely manner.
Regarding the pool's elevation, the pool was installed at the approved grade as outlined in the signed construction documents. In fact, the pool was raised above the existing grade to prevent such issues. The runoff concerns mentioned are likely a result of the surrounding conditions rather than the pool installation itself. The decking contractor may have been able to adjust the grading, or additional measures such as a trench or barrier could be installed to redirect runoff.

I contracted with this company in March and they have not finished the job yet. I have contacted them now on a weekly basis with barely any feedback. The pool is disgusting and needs finished, cleaned, and turned on. Per the agreement I can't do this. The latest issue is that I just got a violation from **************** and if there are no footers by 12/5 they will charge me $50 a day. I need the company to resolve this so that I don't have to pay for those violations. I have tried to be patient but the lack of communication and finalizing of this job is getting ridiculous and now a fine on top of it. Outstanding Items: All remaining construction items have been completed. We are now focused on getting the equipment operational and ensuring the pool is cleaned and ready for use.
Violation Resolution: We recognize the importance of addressing the countys request for an engineered letter. Although this is an uncommon requirement, we are actively reaching out to the county inspector to fully understand and comply with their request.

This project is not completed yet. They have made progress but there are still two issues remaining.
1. The violation with the county that was due today
2. The pool being cleaned and turned on before it gets cold and ruins the pool since it has been filled.

Contracted with Coyote Creek in December of 2023. They actually were very helpful during this process. Although most of the tike frames suggested by them as their "typical" job time were... as I have come to find out COMPLETE BS. We started digging in January of 24 and we're not able to use the pool till July 4th... fine whatever. But here was are on October 30 and still the job is not complete. That fact not with standing. It has been one thing after another, most of which is a lack of communication with the project. We had an initial project coordinator.. and for weeks no work would go on and then Easter Sunday 8am a crew shows no... no notice from PM just showing up to work after nothing for weeeeeks. Anyway... that guy quit randomly.. no one ever told us. I called that guy over and over till he finally said I no longer work for Coyote. Coyote never said a word. Another PM shows up tries to get stuff moving and does a pretty good job but routinely directions we would give to Coyote would not make it to subs and jobs would be screwed up... again awful communication. 3rd PM... came out one day. We covered everything with him... 3 days later no response... called and called and he quit too. No communication from Coyote. Now 4th guy, he's ok. But still terrible at communication. We've used the pool but there are so many issues with the pool: air bubbles, coping issues, concrete s**** **** holes in grout, skimmer box issues, the list goes on and on and just this week the 4th PM said we plan to have a team come out and work on some of these things, I'll let you know when they come. Today get notice on my ring cam people are in my pool area and no notice from Coyote. These subs today have destroyed the pool. I can't post photos but concrete chunks and dust all inside the pool. Salt cell and filter are screwed. I'm ******. I want all these issues fixed but Coytoe is silent. Fix my pool, every single issue down to the smallest detail you screwed up, and get out of my lifeBusiness response

We entered into contract with Coyote Creek Outdoors / Canaan Builders / ************************ of ************, ** in December of 2023 for a pool that we were told would be ready to use by the upcoming summer season, specifically Memorial Day weekend. I feel we have been incredibly patient and understanding of the nature of changes, delays, etc. up until this point, October 7, 2024. August 26, 2024 - Pool Dug, Fiberglass Shell installed August 27, 2024 - Water installed September 30, 2024 - Coping partially installed and the portion that was installed is cracked and / or chipped We have paid over $116K, which is over 85% of contract price.Our requests are: 1) Stop ignoring repeated inquiries as to where our project stands and to be given a completion timeline 2) Complete contractor status / documentation portion of retaining wall permit in order for it to be approved 3) Repair pool coping where chipped and / or cracked 4) a: Complete total project (Pool coping, grading, pool decking, retaining wall) before any additional payments are paid by client OR b: Refund $27, ****** (This refund amount is based on the initial contract price $97, ****** less $6,565 for concrete pool decking and 4 hours of grading @ $1,300 not given. We appreciate the opportunity to address the concerns raised regarding the timeline of your pool project.
As agreed upon in our contract, we initiated the process for your pool project in December 2023. However, to proceed with the necessary permitting in your municipality, we required a finalized scope of work. Unfortunately, we were unable to submit for the permit until April 30, as there were delays in reaching a decision on the scope. The local municipality mandates that the full scope of work be provided in order to issue the necessary permits.
Once the permit was granted on August 9, we began excavation promptly on August 26. This start date was the earliest possible due to prior commitments made to other customers, which we communicated. Our typical project timeline for pool construction is 8-12 weeks from the start of excavation, and we were still well within this timeframe when we received the BBB complaint at week five of construction.
We understand your concerns and want to assure you that we remain committed to completing your pool in a timely and professional manner. Additionally, we have received correspondence from your legal counsel, and at this stage, our legal team is in communication with them to work through the matter.

I am rejecting this response because:In regards to the timeliness of permitting, entire 5,500+ sq ft homes are built in our municipality in less time than it has taken your company to install a pool. Its my understanding that the permit could have been issued once the city engineer and codes approved the plan (which was 7/1/24) and fees associated with the permit were paid. The permit issuance date correlates to the day the contractor actually pays for the permit, which didnt happen until 8/9/24.
Second, the initial dig date was never communicated to us in advance as our initial designated project manager left your company before our project started. We are at week 10 since permit was issued and not once has a completion date or update on completion been communicated, we have asked repeatedly.
The program used by your company (Builder Trend) has never been updated to correctly show the amounts we have paid, which is over $118K.
We would like one of two options below:
Option #1
Firm date for completion (with final inspection within next 3 weeks)
Builder Trend to be updated no later than 10/25/24 to include ALL payments made ($118, ******) and credits for fence repair, autofill, and spigot -Total of $2K to be applied
Option #2
Agree to Refund $60K which includes the $30,000 paid in advance for items not received (4 hours grading, plumbing, pool decking) and would help cover our cost for hiring new contractor, revised landscape plan, pulling new permits, pool cleaning, and attorneys fees.

Permitting Process:
We acknowledge that the city engineer and code officials approved the plan on July 1, 2024. However, following this approval, an initial site inspection was required, which we promptly provided. This inspection was completed on August 5, 2024. During that time, the city posed a few additional questions, which we answered promptly. The final approval was issued on August 9 at 3:24 pm, and within minutes, we paid for the permit at 3:34 pm, upon which it was formally issued.Communication and Project Updates:
We regret any inconvenience caused by delays in project updates, particularly with the transition of project managers. While our ************ software has encountered technical issues in reflecting payment updates accurately, we acknowledge your calculation of $118,436.11 as correct. We are actively working to resolve these software challenges to ensure accurate tracking and reporting.Response to Options Provided:
We appreciate the two options you proposed. I am rejecting this response because:Nothing has been resolved. We have not heard from anyone at your company in over a month, and our backyard has been unusable due to a mountain of dirt, construction debris and a green pool with non-functional plumbing.
The initial site inspection you referred to above is scheduled by the contractor once the erosion control and porta potty are in place, which took you 30 days. This was not a delay due to the City of *********, but by your company.
Your company's license was expired August 31 - Oct. 28, 2024, which may explain why no one communicated a timeline for completion and still has not.
We would like your company to refund $60K for the following: $30K paid in advance for items not received (4 hours grading, pool plumbing, pool decking), attorney's fees, hiring new contractor, revised plans, new permits, etc. *and* agree to end our contractural agreement once refund is issued.

In the summer of 2023 we entered into a contract with Coyote Creek Outdoors to have an in ground pool installed. The work began late July of 2022 and finished early September 2022. The installer did not install the liner lock system at this time. The pool liner started to separate from the wall of the pool so we called Coyote Creek and asked them to follow up and install the liner lock, which they did in October of 2023. Now the liner lock is coming out of the tract. I text my salesman and he let me know he does not handle pools anymore and gave me another contact. I text and called that person without a response. I then went online and filled out the warranty sheet they have on their website, still no return call. I called their number and spoke with ***** there three different times. I still have not been contacted bout the warranty claim.Business response

Our concerns are many: (Note- deposit on project put down in June 2023; pool delivered in August; was told pool completion 10-12 weeks from pool install. Today is March 22 and pool not complete and pool builder will not give us a completion date) • Pool paid 100% in December 2023 per the pool contract yet pool isn’t complete; no timeline given • Multiple project managers with seemingly little knowledge transfer • Overall lack of communication • Lack of project management- multiple inquires regarding project timeline and given vague responses • Overages outside of pool contract • Overall, breach of contract We would prefer to settle this through the BBB in an amicable manner prior to seeking legal action. What we are asking: 1. A firm deliverable date for final inspection and completion by April 8 a. Considering how long ago the “last of the list” was created with Coyote on Feb 8, this date should not be a problem. 2. Weekly updates until that final date 3. Weekly cleanings through inspection- we were told by Graham our pool would be kept clean by Coyote until it passed inspection and it hasn’t been cleaned since Feb 26 4. New skimmer basket with a handle 5. All scratches removed 6. We were told by Graham that he’d open the pool fountain for us. We want that scheduled and opened. 7. Additional items identified to be done in Feb 8 walk-through: a. Concrete cap replaced in professional manner b. Backwash hose added c. Scratches removed 8. While we appreciate Coyote Creek coming out to our home seemingly the day they received our BBB complaint, we are not satisfied with their response for these reasons. We have received vague responses from this pool builder throughout the almost 10 month project and feel that this is another vague response. Also, the monetary item has not been addressed with us at all.Outstanding requests:

Our apologies in our response sounding vague, but we do look forward to working through this matter amicably. To help keep everything in order, below is a response to each bullet point that was brought up.
1. We are unable to provide a firm date for the final inspection as that is performed by the local municipality. The final electrical inspection has been called in and once that passes, the next step is to call in the final inspection for the permit. We have no control on when those take place. We only know once they occur as we will receive notification with the results of the inspection.
2. We can update you weekly on the status of the inspections, but will not have any new information until the inspection(s) actually take place.
3. We apologize for the inconvenience of not conducting weekly cleanings. We do not provide construction cleanings once pool school has been conducted as that is when the pool maintenance is handed over to the homeowner.

GM: Thank you. We appreciate your willingness to work with us. We just want the project completed especially since we have paid in full for the pool. To have paid such a significant expense and not have the project complete, you can understand our concern.

GM: When was the final electrical inspection called in and why has it taken so long to be called in?

GM: Thank you. Weekly updates should include cleaning schedule, maintenance conducted, calls made, schedule (scratches work, inspections, etc)

GM: Pool school was conducted MONTHS ago. And….we paid the final payment. We were verbally told by Graham that cleanings would be conducted until and through final inspection was completed. Does Coyote not stand by what they verbally agree to? Have you reviewed the documentation I sent in? See “Blue Tape signed Feb 8”. You will see “will keep cleaning until finished”. Graham agreed to this on Feb 8. I copy of this document was sent via text to Graham. Yet cleanings only continued through Feb 26. Thus, this response from Coyote is not acceptable.
This is also an example of lack of clear communication between those who work at Coyote. I hope the company will review their practices as a result of this complaint so that other customers do not have the experience we have had.4. Competed as noted

GM: You are mistaken. This was not part of the retaining wall- nothing to do with the retaining wall. A piece of the concrete from an existing wall was broken when some of the trees were removed. Mike, the PM stated that Coyote would have TAC repair. Graham also confirmed during a separate visit that Coyote would repair. I think it was Graham who tried to repair it however the repair looks awful. When Graham completed a walk through with us on Feb 8, I showed him this “awful repair” and he agreed to have it fixed. You can see this noted on both of the blue tape documents I submitted.
Your comment about “scratches on the cap” indicate to me that you are not even aware of what this is. This is part of our overall frustration – the seemingly lack of communication between the various parties working for Coyote.
This response is not acceptable.Since Coyote agreed to both verbally, in email, text and on the blue tape sheet that this would be fixed/addressed, we expect it to be done.

GM: Response not acceptable. The key here is that we were left to pay expenses that were never discussed and that if not addressed, our pool would not have been safe nor passed inspection. We would expect a pool company, really any reputable company, to explain and note all potential costs associated with the project. And the fact that we were told in October that the project completion was three weeks out, AND we kept up our end of the contract and fully paid according to what is stated to pay what when in the contract yet Coyote has not completed the project months and months later, we expect some reimbursement. We would prefer to work together toward a multiple resolution however, this response indicates no responsibility in these additional incurred costs nor additional timeline to the overall project. This doesn't even include the overall lack of project management, lack of communication and overall, lack of urgency in delivering a completed project that has already been paid for, we are looking for Coyote to "make this right". We are hoping our willingness to meet in the middle will be agreeable to the company.
